SUBJECT: Conditionally Approving Annexation of City of San Ramon Subdivision 8188 (Lyon-
Henry Ranch)to Wiedemann Ranch Geologic Hazard Abatement District
The Board of Supervisors of Contra Costa County(the"Board of Supervisors")RESOLVES
THAT:
1. On May 21, 1985,pursuant to the provisions of Section 26550 of the Public Resources Code,this
Board adopted Resolution No. 85/276 declaring the Board is subject to the provisions of Division
17(Sections 26550 et seq.)of said Code,and forwarded a copy of said Resolution to the State
Controller.
2. Pursuant to the provisions of Division 17 of the Public Resources Code, a Petition("Petition")
was filed with the Clerk of the Board of Directors("GHAD Board")of the Wiedemann Ranch
Geologic Hazard Abatement District("GHAD"or"District")dated February 23, 2000,for the
annexation of City of San Ramon Subdivision 8188(Lyon-Henry Ranch)to the GHAD.
3. On March 21,2000,the GRAD Board adopted Resolution No. 2000/119 accepting the Petition
and setting a hearing on the Petition for April 11, 2000 at 10:00 a.m. Notice of the hearing was
given in accordance with the provisions of Public Resources Code Sections 26561 through 26563.
4. A public hearing before the GHAD Board on the proposed annexation to the GHAD was held on
April 11, 2000, at 10:00 a.m. At the time set for the hearing,no owner of real property to be
annexed to the GHAD had made a written obj ection to its formation in accordance with the
provisions of Public Resources Code Section 26564. At the hearing the owners of more than 50
percent of the assessed valuation of the property to be annexed to the GRAD did not object to the
annexation.
5. The GHAD Board closed the hearing and,by Resolution No. 2000/167 adopted on April 11,
2000, conditionally ordered the annexation of City of San Ramon Subdivision 8188 (Lyon-Henry
Ranch)to the GHAD, as described in the Petition. The effective date of the annexation will be
June 13,2000,or such later date as the GHAD Board holds the Public Hearing,tabulates the
Assessment Ballots,and authorizes the assessment.
6. Public Resources Code Section 26581 states that a proposed annexation is subject to approval of
the legislative body which ordered formation of the GRAD. The Board of Supervisors ordered
formation of the Wiedemann Ranch GHAD on September 1, 1998. The Board of Supervisors
hereby conditionally APPROVES the annexation of City of San Ramon Subdivision 8188 (Lyon-
Henry Ranch)to the Wiedemann Ranch GHAD as conditionally ordered by the GHAD Board.

The Board of Supervisors of Contra Costa County acting in its capacity as the Board of
Directors of the Wiedemann Ranch Geologic Hazard Abatement District (the "Board")
RESOLVES THAT:
1. On May 21, 1985, pursuant to the provisions of Section 26550 of the Public Resources
Code, the Board of Supervisors of Contra Costa County adopted Resolution No. 85/276
declaring the Board is subject to the provisions of Division 17 (Sections 26550 et seq.) of
said Code, and forwarded a copy of said Resolution to the State Controller.
2. Pursuant to the provisions of Division 17 (Sections 26550 et seq.)- of the Public
Resources Code, a Petition ("Petition") was filed with the Clerk of the Board, dated
February 23, 2000, for the annexation of City of San Ramon Subdivision 8188 (Lyon-
Henry Ranch) to the Wiedemann Ranch Geologic Hazard Abatement District ("GHAD"
or"District").
3. On March 21, 2000, this Board adopted Resolution No. 2000/119 accepting the Petition
and setting a hearing on the Petition for April 11, 2000 at 10:00 a.m. Notice of the
hearing was given in accordance with the provisions of Public Resources Code Sections
26561 through 26563.
4. A public hearing before the Board on the proposed annexation to the GHAD was held on
April 11, 2000, at 10:00 a.m. At the time set for the hearing, no owner of real property to
be annexed to the CHAD had made a written objection to its formation in accordance
with the provisions of Public Resources Code Section 26564. At the hearing the owners
of more than 50 percent of the assessed valuation of the property proposed to be annexed
to the GHAD did not object to the annexation; thereafter,the Board closed the hearing.
5. The annexation to the GHAD is exempt from the provisions of the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.) in accordance
with Public Resources Code Sections 21080(b)(4) and 26559.
6. In accordance with Article XIII D of the California Constitution, the Board is adopting a
separate Resolution on April 11, 2000, to initiate the establishment and authorization of
an assessment on the annexed property for the purpose of defraying the costs and
expenses of maintaining and operating the CHAD improvements necessitated by the

7. The Board hereby conditionally ORDERS the annexation of City of San Ramon
Subdivision 8188 (Lyon-Henry Ranch) to the Wiedemann Ranch GRAD, as described in
the Petition. The effective date of the annexation will be June 13, 2000, or such later date
as the Board holds the Public Hearing, tabulates the Assessment Ballots, and authorizes
the assessment.

SUBJECT: Resolution of Intent to Order Assessment on Property Proposed to be Annexed to
the Wiedemann Ranch Geologic Hazard Abatement District, Ordering an
Assessment Ballot Proceeding and Setting a Public Hearing to Consider All
Protests Against Said Assessment.
The Board of Directors of the Wiedemann Ranch Geologic Hazard Abatement District,
RESOLVES:
1. On March 21, 2000, the Board of Directors of the Wiedemann Ranch Geologic Hazard
Abatement District ("GHAD" or."District") adopted Resolution No. 2000/119 and
accepted the Petition for Annexation of City of San Ramon Subdivision, 8188 (Lyon-
Henry Ranch) to the Wiedemann Ranch GHAD ("GHAD Petition"), including a Plan of
Control. Upon recommendation of the GRAD General Manager, the Board concluded
that the GHAD Petition, including the Plan of Control, is substantially in the form
described in Section 26552 of the Public Resources Code.
2. The Board has reviewed the Plan of Control presented to it with the GHAD Petition and.
has determined that the Plan of Control adequately addresses the health, safety and
welfare issues raised by the proposed annexation.
3. By Resolution No. 2000/119, the Board has scheduled a public hearing on the GRAD
Petition on April 11, 2000, at 10:00 a.m. in Room 107 of the Board of Supervisors'
Chambers, 651 Pine Street, Martinez, California 94553 and has directed that the Board
Clerk give notice of same.
4. In order to defray the costs and expenses of maintaining and operating the CHAD
improvements necessitated by the property proposed to be annexed to the GRAD, it will
be necessary to provide for a reliable source of funding for the District..
5. Public Resources Code Sections 26650 et seq. authorize, after a noticed Public Hearing,
the levy and collection of an assessment upon the property proposed to be annexed to the
District to pay for the maintenance and operation of the GHAD improvements
necessitated by the annexed property. Article XIII D of the California Constitution,
Government Code Sections 53750 et seq. and Elections Code Section 4000 impose
additional requirements for the levy and collection of the assessment.
6. The property proposed to be annexed to the GHAD that will be subject to the assessment
is identified on the map attached as Exhibit A.

7. An Engineer's Report, attached as Exhibit B, has been prepared by a registered
professional engineer, certified by the State of California. The Engineer's Report
separates the special benefits provided by the CHAD on the property proposed to be
annexed from the general benefits conferred on the public at large, identifies the specially
benefited parcels, describes the total assessment, identifies the method for apportioning
the total assessment to the individual residential parcels, and sets forth the assessment per
residential parcel. The assessments on the parcels to be annexed to the existing
Wiedemann Ranch GHAD are identified in Exhibit A.
NOW, THEREFORE, the Board of Directors, hereby RESOLVES, FINDS, CERTIFIES and
ORDERS that:
1. The Board hereby declares its intention, consistent with the requirements of Public
Resources Code Sections 26650 et seq., Article XIII D of the California Constitution,
Government Code Section 53750, and Elections Code Section 4000, to order that the
costs and expenses of the CHAD improvements necessitated by the property proposed to
be annexed to the GHAD shall be assessed against the annexed property which is
benefited by the GHAD.
2. The Board further declares its intention to assess against the property proposed to be
annexed to the GRAD, for the 2000-2001 fiscal year and for subsequent years, all or part
of the amounts set forth in the Budget attached to the Engineer's Report.
3. Notwithstanding paragraph 2 above, the Board shall not order this assessment if a
majority protest exists as defined in Section 4(e) of Article XIII D of the California
Constitution and Government Code Section 53753(d)(2).
4. Each of the parcels in the property identified in Exhibit A will receive a particular and
distinct special benefit in the form of GHAD-provided services and GHAD-maintained
improvements that are over and above the general benefits received by the general public
at large. The services the GRAD may provide and the improvements it may maintain
includes, (a) evaluating the performance of the natural and excavated slopes, the surface
drainage and ditches to prevent certain geologic hazards within the District, (b)
performing certain temporary and permanent mitigation, repairs and improvement
measures to control geologic hazards within the GRAD, (c) maintaining debris benches,
drainage systems and instruments such as piezometers, settlement monitors and
inclinometers; and (d) maintaining wildlife mitigation ponds. These special benefits are
described in detail in Revision 1 to the Wiedemann Ranch Plan of Control for the GHAD
on file with the Contra Costa County Department of Public Works.
5. The Board has reviewed and considered the Engineer's Report. The Engineer's Report
identifies the special benefits conferred on the entire District and each parcel to be
annexed to the District, and separates that special benefit from the general benefit
conferred on the public at large. Such special benefit derived from the GHAD is
proportionate to the entire costs of the GHAD, and the amount of the assessment is
proportional to and no greater than, the reasonable cost of the special benefits conferred
on each parcel to be annexed.
6. No later than April 13, 2000, the Board directs the Public Works Director to mail a copy
of this Resolution along with the "Notice of Assessment" attached as Exhibit C of the
Public Hearing, and the"Notice of Adoption of Resolution," attached as Exhibit D, to the

B, shall be attached to the Notice.
7. The Board will conduct the Public Hearing on June 13, 2000, at 10:00 a.m. in Room 107
of the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California 94553.
The Clerk of the GHAD shall deliver all the Assessment Ballots received from record
owners of parcels within the property proposed to be annexed to the GHAD to the Board
prior to the start of the Public Hearing. The Board shall permit a change, withdrawal or
submittal of an Assessment Ballot at any time prior to the conclusion of the public
testimony on the proposed assessment at the Public Hearing. After the conclusion of the
public testimony on the proposed assessment, the Board shall consider all protests against
the proposed assessment and tabulate the Assessment Ballots. In tabulating the
Assessment Ballots, the Assessment Ballots shall be weighted according to the
proportional financial obligation of the affected property. The Board shall not impose the
assessment if there is a majority protest as that term is defined by Section 4(e) of Article
XIII D of the California Constitution and Goverment Code Section 53753(d)(2). If
there is no majority protest,the Board may authorize the assessment.

The Board of Supervisors of Contra Costa County acting in its capacity as the Board of Directors
of the Wiedemann Ranch Geologic Hazard Abatement District RESOLVES THAT:
A. On September 1, 1998,the Board of Supervisors of Contra Costa County("Board of
Supervisors"),adopted Resolution No. 98/438,forming the Wiedemann Ranch Geologic Hazard
Abatement District("GHAD"or"District")and appointing itself to act as the Board of Directors
of the GHAD ("GHAD Board").
B. On September 1, 1998,the GHAD Board adopted Resolution No. 98/439,appointing officers for
the GHAD.
C. On April 11,2000,the GHAD Board and the Board of Supervisors adopted Resolution Nos.
2000/167 and 2000/166 ,respectively,conditionally approving the annexation of City of San
Ramon Subdivision 8188(Lyon-Henry Ranch)to the GHAD.
D. In order for the GHAD to proceed to efficiently implement the GHAD Plan of Control and to
undertake repair,maintenance and improvement projects and related operations relating to the
annexed property,it is necessary to approve an annual budget and a repair,maintenance and
improvement program.
NOW,THEREFORE,THE GHAD BOARD HEREBY RESOLVES AND ORDERS,AS
FOLLOWS:
1. The GHAD Board approves the GHAD budget for the Wiedemann Ranch GHAD,including the
annexed property,for the fiscal year 2000,attached hereto as Exhibit A and incorporated herein
by this reference, including the estimated budget for the fiscal years 2001 to 2041.
2. The GHAD Board approves the GHAD Repair,Maintenance and Improvement Program,
attached hereto as Exhibit B and incorporated herein by this reference, for the annexed property.
3. This resolution shall take effect immediately upon its adoption.

On a periodic basis during each year,the GRAD may monitor repairs and maintain the

perform temporary and permanent mitigation,repairs and improvement measures when

PROJECT DESCRIPTION
The Henry Ranch is located on the southwest side of San Ramon Valley Blvd. in San Ramon,
rlifornia. It consists of a rectangular parcel oriented in an east-west direction. The topography
consists of generally easterly-facing ridge noses and valleys. Several drainages are located in the
southern portion of the property and drain to the southeast.
The highest elevation proposed for development is approximately elevation 685 feet, located in
the central portion of the site. The lowest elevations are in the eastern portion of the site where a
strip of nearly-level land fronts San .Ramon Valley Blvd. at an elevation of approximately
410 feet. The hillsides have slope gradients generally ranging between 2.5 and 4.0 horizontal to
1.0 vertical. Site vegetation includes oak trees and wild grasses. Site geology is described in
References 1 and 2.

The site presently contains two residences that are to remain, along with several corrals, sheds,
barns and dirt roads, some of which are to remain. Water lines for the existing residences
traverse the site in an east-west direction from San Ramon Valley Blvd. An old well is located
on the level portion of the property near the northeastern corner. Septic tanks/leach fields
presently service both existing homes. Access to the property is from one of two gates located
along the eastern boundary adjacent to San Ramon Valley Blvd.
PROPOSED DEVELOPMENT
Residential development is proposed for the eastern portion of,the the site. Development will
include,quavated cuts on some of the ridges and lulls in most of tie valleys and drainages. The
remaining western portion of the proper will remain undeveloped.
According to the Grading and Development Plans prepared by P/A Design Resources, Inc., the
proposed development consists of 100 new single+-family residential units. Higher-density
residential development is planned within the flatter area adjacent to San Ramon Valley Blvd.
Approximately fifty single-family residential lots are planned on the ridges and valleys to the
west of the level area. This will require some cutting on the ridges and filling over the drainages
and valleys. Access to the single-family residences will be from two gently curving,
60-foot-wide roadways entering the site from the south(Figure 4).
As a condition of approval, this project will be required to be within a Geologic Hazard
Abatement District (GHAD) which will be funded through property tax assessments on the
parcels within the project. Given the size of the Henry Ranch project, its proximity to
Wiedemann Ranch and the geologic similarities between the two developments, it has been
proposed to annex the Henry Ranch into the existing Wiedemann Ranch GRAD.
FINANCIAL ANALYSIS
,A financial analysis was performed to provide a framework for an operating budget for the

on-going abatement, mitigation, prevention and control of geologic h:iavards within the Henry
Ranch. In preparation of the budget,several factors were considered including:

• Proposed Remedial Grading
• Proximity of Geologic Hazards to Proposed Residences
• Site Access Considerations
• Elements Requiring Routine Maintenance Including:
Surface Drainage Facilities
Graded Slopes
Detention Basin
Mitigation Ponds
In addition, the General Manager for the existing Wiedemann Ranch GRAD, William R. Gray
and Company, was consulted for the development of the operating budget and reserve analysis.

Annual expenses were estimated (in 2001 dollars) both for a stand-alone Henry Ranch GHAD

the Wiedemann Ranch Plan of Control and historic operating expenses for similar GHADs.

This budget was proposed for the purpose of establishing assessment levels based on the above-
estimated expenses for on-going operations, and allowing for larger (approximately $250,000)
geologic events at 10-year intervals (See Exhibit 1). In order to establish a reasonable reserve in
the early years following formation of the GHAD, an initial seed fund would be required of the
developer and there would be an initial deferral of GHAD expenses. To compute the amount of
initial seed fund, the GHAD's total reserve needs during the 3-year projected buildout period
(based. on $276/unit/year and 100 units as shown above) were compared to the actual revenues
expected during this period. The difference or"shortfall" during this initial period was then used
to establish the initial funding. Based on this analysis, a seed fund of$50,000 is recommended.

Although financial exposures due to geotechnical risk within the Henry Ranch are likely
substantially lower on a per-unit basis than in the adjacent Wiedemann Ranch, the small number
of units within the Henry Ranch would necessitate an assessment level of over $750 per unit per
year if a stand-alone GHAD were established for the Henry Ranch (see table above).
As shown above, when combining the two projects into a single GHAD, economies can be
realized from more efficient operations and, more significantly, from the establishment of only a
single reserve fund. Consequently, the incremental,increase in costs to the Wiedemann Ranch
GHAD from annexing the Henry Ranch can be funded by assessing the Henry Ranch parcels at
roughly the same level of assessment as the Wiedemann Ranch parcels, which is approximately
$555 per unit per year (see Exhibit II). This assessment level may increase annually in
accordance with the Consumer Price Index (CPI).
This approach would benefit the Henry Ranch by allowing a lower overall assessment level and
access to a larger reserve. It will also benefit the Wiedemann Ranch by generating additional
revenue from parcels which, on the average, face lower geotechnical risk (because of flatter
overall slope gradients, the general absence of creeks, greater clustering of residential units,
lower property values, greater site access, etc.).

Notice of Adoption of Resolution by the Board of Directors
of Wiedemann Ranch Geologic Hazard Abatement District
On March 21, 2000, the Board of Directors of the Wiedemann Ranch Geologic
Hazard Abatement District ("GHAD" or "District") adopted Resolution No. 2000/119,
accepting the Petition for Annexation of City of San Ramon Subdivision, Tract 8188 to

the Wiedemann Ranch GHAD ("GHAD Petition"), including a Plan of Control.
NOTICE IS HEREBY GIVEN that:
On April 11, 2000, the Board adopted Resolution No. 2000/168 setting a Public
%.W
Hearing to consider adoption of an assessment to finance the costs and expenses of the
GHAD improvements necessitated by the property proposed to be annexed to the GHAD.
If the assessment is adopted, each parcel you own will be assessed $555 per year,
plus an annual adjustment to reflect the percentage change in the Consumer Price Index
("CPI") over the previous twelve-month period. The assessment will be levied on each
parcel beginning the first fiscal year following recordation of a Final Map for such parcel,
estimated to commence in Fiscal Year 2000-2001. William Lyon Homes, Inc. will
contribute $50,000.00 as up-front seed money and also will have the responsibility to
perform all the activities and cover all expenses of the GHAD on the annexed property
either for three years after the Final Map is approved by the City of San Ramon, or for
two years after the completion of rough grading, whichever is later. Upon the conclusion
of the three or two-year period, as the case may be, responsibility for performing the
GHAD activities and covering the expenses of the GHAD on the annexed property will
transfer to the GHAD.
The attached Engineer's Report (Exhibit B) for the Wiedemann Ranch GHAD
was prepared by a registered professional engineer certified in the State of California, and
describes in detail the reason for the assessment and the basis upon which the amount of
the proposed assessment was calculated. The Engineer's Report specifically sets forth
the yearly estimated budget, the total assessment that will be chargeable to the entire
GHAD, the proposed estimated assessments to be levied each year against each parcel of
property, and a description of the method used in formulating the estimated assessment.
A copy of the Engineer's Report is also available for inspection at the County Public
Works Department, 255 Glacier Drive, Martinez, California, 94553.
The GHAD Board will conduct a Public Hearing on June 13, 2000, at 10:00 a.m.
in Room 107 of the Board of Supervisors' Chambers, 651 Pine Street., Martinez,,
California 94553 to tabulate Assessment Ballots and to hear any protests on the proposed
assessment.
The following paragraph provides the procedures for returning and tabulating the
Assessment-Ballots. A copy of this Notice, Assessment Ballot and Engineer's Report has

been sent to each of the owners of property proposed to be annexed to the CHAD; your
Assessment Ballgt is attached to this Notice. The Assessment Ballot may be completed
and mailed or hand-delivered to the Public Works Department, 255 Glacier Drive,
Martinez, CA 94553, or you may submit your Assessment Ballot at the Public Hearing.
You may submit, withdraw, or change your Assessment Ballot at any time prior to the
conclusion of the public testimony on the proposed assessment at the Public Hearing. At
the Public Hearing, the GHAD Clerk will deliver the Assessment Ballots it has received
to the GHAD Board of Directors, which will then consider all protests and tabulate the
Assessment Ballots. The GHAD Board will not impose the proposed assessment if there
is a majority protest. A majority protest exists if, upon the conclusion of the Public
Hearing, the number of Assessment Ballots submitted in opposition to the assessment
exceeds the number of Assessment Ballots submitted in favor of the assessment. In
tabulating the Assessment Ballots, the Ballots will be weighted according to the
proportional financial obligation of the affected property.
