HomeMy WebLinkAboutMINUTES - 03212000 - SD2 SP2, TO: BOARD OF SUPERVISORS FROM: Warren E.Rupf,Sheriff-Coroner Contra Costa DATE: March 9,2000 County SUBJECT: Contracts With Superior Courts and Personnel Allocation SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION Resolution # 2(700/122 RECOMMENDATION: AUTHORIZE the Sheriff or designee to execute on behalf of the County a contract with the Superior Court of Contra Costa County, for Court Security Services; AUTHORIZE the Sheriff or designee to execute on behalf of the County a contract with the Superior Court of Contra Costa County, for Perimeter Screening Services; APPROVE this Resolution ADDING 20.0 permanent full time Sheriff Ranger (64WR) positions and 5.0 permanent full time Deputy Sheriff(6XWA) positions to the Sheriff's Office departmental list of allocated positions. FISCAL IMPACT: No increased General Fund costs are anticipated. All costs for services provided under these contracts are Trial Court Funding, California Rule 810, allowable and reimbursable by the Superior Court. The Court and the Sheriff anticipate that the amount specified in the payment provisions of the perimeter screening contract is sufficient to cover the costs of perimeter screening services. In the unlikely event that costs exceed that amount, the Sheriff will absorb such costs within the Sheriffs Office budget. BACKGROUND: On June 23, 1998 the Board of Supervisors authorized the County Administrator to execute an agreement with the Presiding Judge of the Contra Costa County Superior Court. Among other provisions, said agreement provided for the continuation of services by the County to the Court. The continued services referenced in that MOU included the Court Security services provided by the Office of the Sheriff. Government Code Section 77212.5 requires that the Superior Court enter into an agreement with the Sheriffs Office, which is statutorily responsible for providing security to the Superior Courts, for the provision of Court Security services. In addition to the Court Security services provided to the Superior Court, the Superior Court has requested that the Office of the Sheriff provide Perimeter Screening services at all courthouse facilities. Providing these additional services requires the addition of twenty Sheriffs Ranger and five Deputy Sheriff positions to the Sheriffs departmental personnel allocation. PARTIES. This Contract is entered by-and between the Superior Court of Contra Costa County (hereinafter called COURT) and the County of Contra Costa, for its Sheriff's Office (hereinafter called SHERIFF) . 2. TE This Contract shall become effective 2000, and continue in force year to year, unless (1) terminated at the end of the respective year period by either party upon written notice thereof to the other party at least 90 days before the end of the respective year period, or (2) canceled immediately by written mutual consent. 3. LOUR OB IGATIONS. COURT shall authorize and direct payments to SHERIFF according to the attached Payment Provisions, incorporated by reference herein, subject to all the terms and conditions contained or incorporated in this Contract. 4. SHERIFF OBLIGATIONS. SHERIFF shall provide those services and carry out that work described in the attached Service Plan, incorporated by reference herein, subject to all the terms and conditions contained or incorporated in this Contract. 5. ENTIRE AGIREENT. This Contract and the June 26, 1998 Memorandum of Understanding between the parties contain all the terms and conditions agreed upon by the parties. Except as expressly provided herein, no other understanding, oral or otherwise, regarding the subject matter of this Contract, shall be deemed to exist or to bind any of the parties hereto. 6. LEGAL AUTHORITX. This contract is entered under and subject to the Joint Exercise of Powers Act (Government Code section 6500 et seq. ) , Government Code sections 77009, 77212, and 77212.5, and any other applicable authority. 7. LABOR RELATIONS. a. Contra Costa County, on behalf of the Sheriff, negotiates and administers all labor relation agreements and personnel rules and procedures between SHERIFF and its employees rendering services under this Contract. In the event the COURT requests any exceptions to personnel rules or labor relations agreements, SHERIFF shall make reasonable efforts to achieve such exceptions. b. SHERIFF retains authority to assign specific duties and responsibilities to SHERIFF personnel performing services under this Contract. c. COURT may object in writing to SHERIFF about SHERIFF personnel performing services under this Contract. 'Within thirty (30) days of receipt of said objection, SHERIFF shall reassign such SHERIFF personnel. 8. INTERRUPTION IN SERVICES. In the event SHERIFF`s services hereunder are interrupted by strikes, boycotts, "blue flu," sickout, any other job action, or other forces beyond control of SHERIFF, SHERIFF shall prorate its payment demands or refund COURT as appropriate, and SHERIFF will exert reasonable means to continue the provision of security services to COURT. COURT may, at its option, secure security services from another source during the term of any such Pagel 3 interruption. 9. INDM FICATION. a. SHERIFF shall defend, save harmless and indemnify COURT and its officers, agents, employees and directors from all liabilities, including, but not limited to, damages, attorneys' fees and costs and claims for damages for death, sickness or injury to persons or property, including, without limitation, all consequential damages from any cause whatsoever arising from or connected with the operations or the services to COURT hereunder, resulting from the conduct, negligent or otherwise, of SHERIFF, its officers, agents or employees, while acting in the scope of their employment as employees of SHERIFF, and only to the extent the employees are entitled to defense and/or indemnification for such conduct pursuant to California Government Code sections 815-515.3, 825- 825.6, and 995-995.6, inclusive. b. COURT shall defend, save harmless and indemnify SHERIFF and its officers, agents, employees and directors from all liabilities, including, but not limited to, damages, attorneys' fees and costs and claims for damages for death, sickness or injury to persons or property, including, without limitation, all consequential damages from any cause whatsoever arising from or connected with the operations or the services by COURT hereunder, resulting from the conduct, negligent or otherwise, of COURT, its officers, agents or employees, while acting in the scope of their employment as employees of COURT, and only to the extent the employees are entitled to defense and/or indemnification for such conduct pursuant to California Government Code sections 815-815.3, 825-825.6, and 995-996.6, inclusive. c. This provision shall survive any termination or expiration of this Contract. 10. NO- THIRD-PART ZNE ICIARIES. This Contract is made solely for the benefit of the entities that are the parties to this Contract (SHERIFF and COURT) , and no other person, including employees of SHERIFF and COURT, and no other entity, shall have or acquire any right by virtue of this Contract. 11. COURT COOPERATION. COURT shall give SHERIFF the full cooperation and assistance of its officers, agents and employees, and designates the Presiding Judge or designee as its representative to coordinate with SHERIFF all activities under this Contract. 12. WORK SPACE, SUPPORT SERVICES, AND EOU P =. COURT agrees to provide SHERIFF personnel with work space within COURT facilities, support services, and supplies required for SHERIFF's performance of services under this Contract. SHERIFF shall furnish uniforms, weapons, radios, and other law enforcement equipment (excluding security equipment, such as metal detectors) necessary in SHERIFF's performance of services hereunder. All security equipment purchased by COURT will remain property of COURT. 13. REPORTS. Any reports, and drawings, plans, studies, memoranda, video programs and other documents assembled or prepared by or for, or furnished to SHERIFF in connection with this Contract, shall be the property of COURT, excepting personnel records and law enforcement reports and data prepared by SHERIFF. SHERIFF shall permit the authorized representatives of COURT to inspect Wage 2
