All costs will be covered with revenue generated through parcel assessments for the GHAD. III. Reasons for Recommendations and Background: William Lyon Homes, Inc. (formerly Presley Homes)is in the process of obtaining final map approval to develop certain property located within the Henry Ranch(the"Henry Ranch Project"). The Henry Ranch Project is a 91.49 acre area within the City of San Ramon that William Lyon Homes, Inc.plans to develop into 100 residential units. Under Condition 28 of the City of San Ramon conditons of approval (City Planning Commission Resolution 80-99) for the Vesting Tentative Map and Development Plan, William Lyon Homes,Inc. is required to petition for formation of a Geologic Hazard Abatement District("GHAD") or for annexation into an existing GHAD for the purpose of undertaking all site-related geotechnical repair work. The CHAD will mitigate or abate landslide or erosion hazards that could directly affect improved, developed, and accepted properties within the Henry Ranch Project. The Henry Ranch Project has a common boundary with Wiedemann Ranch; furthermore,property within the Henry Ranch Project has geologic conditions that are similar to those in the Wiedemann Ranch. Consequently, the Henry Trust, current owners of the Henry Ranch Project property, filed a Petition for Annexation of Territory to the Wiedemann Ranch CHAD on February 23, 2000. Annexation of territory to a CHAD must also be approved by the legislative body that ordered formation of the existing GRAD. § 26581. On September 1, 1998,the Contra Costa County Board of Supervisors ordered by resolution the formation of the Wiedemann Ranch GHAD. Therefore, after the GHAD Board orders the annexation, the Contra Costa County Board of Supervisors must approve the annexation by resolution. IV. This resolution is made pursuant to Division 17 (Sections 26500 et seq.)of the Public Resources Code. 2. On March 21,2000 the Board was presented with the Petition for Annexation of Subdivision,Tract 7822 to the Wiedemann Ranch Geologic Hazard Abatement District("GHAD Petition"), including a plan of control("Plan of Control").Upon recommendation of the GHAD General Manager,the Board concludes that the GHAD Petition(and Plan of Control)is substantially in the form described in Section 26551 and 26552 of the Public Resources Code. 3. The Board has reviewed the Plan of Control presented to it with the GHAD Petition and determined that the health, safety, and welfare issues required in the formation of the proposed district,were adequately addressed. 4. The Board will conduct a public hearing(the"Hearing")on the proposed annexation of the project into the existing Wiedemann Ranch GHAD on April 11, 2000 at 1U:00 a.m. in Room 107 of the Board of Supervisors' Chambers, 651 Pine Street,Martinez, California 94553. At the Hearing, any objections to the proposed formation shall be presented. 5. Notice of the Hearing shall be mailed to each owner of real property to be included within the proposed district as shown on the assessment roll last equalized by the County. Notice of the Hearing shall be mailed first-class,postage prepaid,in the United States mail and postmarked not less than 20 days preceding the date of the Hearing. Notice of the hearing shall include a copy of the GHAD Petition. Notice of the Hearing shall indicate where the Plan of Control may be reviewed or duplicated. Notice of the Hearing shall also set forth the address where objections to the proposed formation may be mailed or otherwise delivered up to and including the time of the Hearing. 6. At any time not later than the time set for hearing objections to the proposed formation,any owner of real property within the proposed district may make a written objection to the formation. Authority and Scope The Wiedemann Ranch Geologic Hazard Abatement District ("GHAD" or "District") has been formed under authority of the California Public Resources Code (Division 17, commencing with Section 26500). Formation of the GHAD was necessary to satisfy a project condition of approval on the Wiedemann Ranch Project. Similarly, a condition of approval has been placed on the Presley Henry Ranch Project to form a GHAD or annex to an existing District. Given the similar geologic conditions between the two projects, it is desirable for the Presley Henry Ranch Project to annex into the Wiedemann Ranch CHAD. Development of a Plan of Control prepared by a State Certified Engineering Geologist is a requirement for formation of a CHAD. Pursuant to Section 26509, a Plan of Control has been prepared for the Wiedemann Ranch GHAD by an engineering geologist certified pursuant to Section 7822 of the Business and Professions Code and describes in detail the geologic hazards, their location, who is affected by them, and provides a plan for the prevention, mitigation, abatement, or control thereof. As used in this Plan of Control, and as provided in Section 26507, "geologic hazard" means an actual or threatened landslide, land subsidence, soil erosion, earthquake, fault movement, or any other natural or unnatural movement of land or earth. The existing Wiedemann. Ranch Plan of Control is suitable, as modified herein, for the proposed annexation of Presley Henry Ranch Project. Property Identification The GHAD boundaries for Wiedemann Ranch and Presley Henry Ranch Project are shown on Figures 1 and 2, respectively. INCORPORATED Prropgrty.Not Located Within GRAD Boundaries Except as herein provided, the GRAD will not prevent, mitigate, abate or control geologic hazards located on property which is not within the GHAD boundaries. In the event, however, that a geologic hazard exists entirely on property located outside the CHAD boundaries, but said hazard has damaged or poses a significant risk of damage to site improvements located on property existing within the GLAD boundaries, the GHAD, in the general manager's sole discretion, may prevent, mitigate, abate, or control the geologic hazard provided said work is limited to that which is necessary to address only the damage or threat of damage to the site improvements. Emergency response and scheduled repair expenditures by the GHAD are to be prioritized by the general manager, utilizing his discretion, based upon available funds and the approved operating budget. When available funds are not sufficient to undertake all of the identified remedial and preventive stabilization measures,the expenditures are to be prioritized as follows in descending order of priority. A. Prevention, mitigation, abatement or control of geologic hazards which have either damaged or pose a significant threat of damage to residences, critical underground utilities or paved streets. B. Prevention, mitigation, abatement or control of geologic hazards which have either damaged or pose a significant threat of damage to ancillary structures, including but not # limited to pool cabanas or restroom buildings. C. Prevention, mitigation, abatement or control of geologic hazards existing entirely on open-space property and which have neither damaged nor pose a significant threat of damage to any site improvements. D. Prevention, mitigation, abatement or control of geologic hazards which have either damaged or pose a significant threat of damage limited to loss of landscaping or other similar non-essential amenities. 4412-W3 February i, 2000 3 EAGEO// INCORPORATE[) The GHAD shall also be responsible for maintenance of the detention basins shown on Figures 3 and 6 and the mitigation ponds shown on Figure 4. Consistent with the Governing Documents of the HOA, the GHAD shall have the right to approve any construction, maintenance or repair in the open space which the GLAD determines has the potential to impact geologic stability. rr 4412-W3 February 1, 2000 5 EAG EO INCORPORATED drainages, and locally on hillslopes. In particular, sandstone of this unit locally crops out as resistant layers traversing slopes and capping ridges in the southeastern portion of the site. The siltstone is typically softer than the sandstone, more weathered, closely fractured, and more prone to erosion and landsllding. Colluvium. Colluvial material consists of unconsolidated slopewash deposits composed of silt, clay and lesser amounts of sand, gravel, and cobbles in a heterogeneous mixture. Colluvium generally mantles lower slopes and occupies hillside swales where it is subject to creep (the gradual downslope movement of soil by gravity) and landsliding. Colluvium is typically about 5 to 10 feet thick in swales. It is generally unstratified to weakly stratified, moderately permeable, moderately to highly plastic, and easily erodible. The colluvium grades into and inter ngers with alluvial deposits on the lower slopes of the valleys of the unnamed creek and San Catanio Creek. Alluvium. Alluvial material consists of unconsolidated crudely stratified stream deposits predominantly composed of silt, clay, and sand, with occasional thin lenses of gravel. Alluvium occurs as fans at the mouths of some drainages, and occupies the broad, gently sloping portions of the valleys of the unnamed creek and San Catanio Creek. Alluvium grades into and interfingers with colluvium on the lower slopes. The alluvium is generally moderately permeable and easily eroded. Alluvium up to tens of feet in thickness was encountered in some borings. Landslides. Landslide deposits consist of masses of unconsolidated material and/or bedrock that have moved downslope by sliding, falling, or flowing. Many landslides, ranging in size from very small to large, occur on the site. The landslides range in age from active (recent) to Pleistocene(10,000 to 2 million years ago) and include soil slips, earth flows, debris slides, areas of shallow slumps and gullying, several large predominantly rotational slumps, and translational slides. 4412-W3 February 1, 2000 7 EAGEO"l INCORPORATED variable resistance to weathering and erosion. When composed of soil finer than gravel size, the flowing material is commonly called a mudflow. A debris flow/dris avalanche is composed of natural earth materials, artificial fill, and/or organic debris which flow downslope with speed. Most of the material is transported away from the area of initial ground failure. Soil cry is the slow, often imperceptible, deformation of slope materials under low stress levels, which normally affects the shallow portion of the slopes, but can be deep seated where a weak zone of soil or bedrock exists. It results from gravitational and seepage forces, and may be indicative of conditions favorable for landsliding. Creep can be caused by wetting and drying of clays, by solution and crystallization of salts, by the growth of roots, by burrowing animals and by down slope movement of saturated ground. Colluvium refers to the mantle of loose soil and weathered bedrock debris that progresses down hillsides by creep. The District shall also be concerned with erosion and sedimentation in open space or affecting developed lots or improvements, subject to the provisions of Section 11. 1✓ son is defined as the process by which earth materials are loosened and removed by running water on the ground surface or in the subsurface. Sedimentat on is the depositing or settling of soil or rock particles from a state of suspension in a liquid. Hilly terrain open space either in a natural condition or particularly on excavated slopes can be subject to erosion. Landslide deposits which are sometimes in a loosened condition are particularly prone to erosion. Earth flow-, debris flow- and mud flow-type landslides typically have an area of deposition or accumulation (sedimentation area) at their base. Graded slopes in the District particularly those in excess of 20 feet in vertical height or those not sufficiently vegetated can be subject to erosion and therefore a source of transported sediment. Creek banks can be oversteepened by natural processes such as stream cutting and erosion, which can cause the banks to slump, The slumped material can then be transported downstream. 4412-W3 February 1, 2000 11 INCORPORATED Known active landslides which will be adversely affected by the proposed grading or which may constitute a threat to the proposed development will either be completely removed and replaced as subdrained engineered fills, or buttressed with drained, engineered fills. The cuts will be viewed by the project geologist during grading to provide mitigation schemes for unsuspected slope conditions which could decrease the slope stability. Such conditions include unfavorable bedrock attitudes and seepage conditions. A geology map will be prepared by the project geologist for use by the GHA.D. In repaired or buttressed landslide areas, the landslide debris will be overexcavated to firm undisturbed materials below the landslide plane as determined by the Geotechnical Engineer or Engineering Geologist at the time of grading. In the case of the complete removal of a landslide, systems of surface and subsurface drains will be installed to collect the subsurface waters which may have initially caused the landslide. The configuration of each subdrainage system will be tailored to the individual landslide at the time of grading. The Geotechnical Engineer and/or the Engineering Geologist will determine the location and depths of subdrains at that time. A Licensed Land Surveyor will record the location and elevation of subdrains and outlets. Each landslide subexcavation will then be reconstructed to final grade by keying and benching below the landslide plan with a compacted drained engineered fill. Landslides that will not be completely removed either will be stabilized in place or are situated outside of the proposed development areas. Buttress fills will be constructed at the toes of major cut slopes near the base of known landslide areas. 'These fills consist of drained-engineered keyways, excavated to firm bedrock, with an overlying engineered fill. Debris benches will generally be constructed with concrete-lined ditches discharging into approved outlets. It is important to note that to preserve the natural topography, wildlife habitat, and vegetation of the site, stabilization of landslide masses is currently planned only for landslides that directly 4412-W3 February 1, 2000 13 EMEO INCORPORATED VI. Acceptance 1. Activation of Assessment An annual assessment is already being levied at the Wiedemann Ranch. An annual assessment shall be promptly authorized on all residential parcels in the Presley Henry Ranch Project. The assessment shall be levied by the GHAD on each parcel in the Presley Henry Ranch Project beginning the f ot fiscal year following recordation of a Final Map for such parcel. The owners of the Presley Henry Ranch Project shall cooperate in and support the authorization and levy of such assessment. 2. R?,%mnsi Uht for-GHAP Activities Except as otherwise provided, the parry that, on the date a Final Map within the boundaries of the GRAD is approved by Contra Costa County (if the Final Map is for Wiedemann Ranch) or by the City (if the Final Map is for the Presley Henry Ranch Project), owns the developable parcels shown on that Final Map shall have the responsibility to perform all the activities of the CHAD on property within that Final Map. Such responsibility shall transfer automatically to the CHAD at 9:00 a.m. on the day exactly three years after that Final Map was approved by the City or the County, as the case may be, or two years after the completion of rough grading (as defined by approved grading plans), whichever is later. During the period from approval of the Final Map for the Presley Henry Ranch Project to the date of transfer of responsibility to the GHAD, Presley will assume GHAD responsibilities for the property within that Final Map. The petitioners for formation of the Wiedemann Ranch CHAD and the petitioners for annexation of the Presley Henry Ranch Project into the Wiedemann Ranch CHAD intend that the approximately three year period between the levying of the GHAD assessment and the GHAD 4412-W3 February 1, 2000 15 eW ENGEM INCORPORATED VII. Open Space Plan of Control The CHAD shall be responsible for oversight of the maintenance of geologic stabilization features (e.g. ditches, benches, walls, etc.) in the common open space and the unimproved areas including the hillside slopes extending uphill from debris benches and outside of the private lot boundaries. The GHAD's maintenance responsibilities include prevention, abatement, vegetation control, and control of landslide and erosion hazards within the subdivision open space and hillsides, as provided in Section IL The CHAD will also assume responsibility for maintenance of the selected creep corridors, two detention basins, and the mitigation ponds west of the Presley Henry Ranch Project. General maintenance of the surface drainage improvements in the open space and on the hillsides, such as the concrete V-ditches, will be the GHAD's responsibility. The GHAD is also responsible for general maintenance of the storm drain inlets and outlets in open space and creek corridors and subdrain outlets. Potential geologic hazards such as landslides and slope erosion within the open space including the unimproved hillsides shall be the responsibility of the CHAD. Clearing of fire breaks and maintenance of the open space (other than hazard abatement) will be approved by the CHAD (as described in the Governing Documents of the HOA) and conducted and funded by the HOA. The GHAD's creels maintenance duties will include only the repair of substantial bank failures that directly damage or threaten actual site improvements (including buildings, utilities, trails, and roads). Such creels bank improvements, including armoring of channels with rock or other materials,will be undertaken by the GHAD as necessary. As part of the environmental approval process for the Presley Henry Ranch Project, wildlife mitigation ponds will be established to the west of the Project (Figure 4). Maintenance of these ponds will be the responsibility of the GHAD since improper functioning of the ponds could result in slope failures and consequent siltation within the improved portions of the Presley Henry Ranch Project. Maintenance of these areas shall be in accordance with the mitigation monitoring plan approved for the Project. 4412-W3 February 1, 2000 17 C Ile EEO ! INCORPORATED IX. Biotechnical Recommendations for Prevention and Mitigation of Eidsting or Potential Erasion Hazards Fill slopes on this project may be expected to be as erodible as the cut slopes in bedrock. Therefore, maintenance of vegetative cover following grading is especially important on fill slopes. Vegetation provides a protective role on soil and exposed rock. It absorbs the impact of raindrops, reduces the velocity of runoff, and retards erosion. In many instances, adequate erosion protection for slopes can be accomplished solely with carefully selected and placed biological elements (plants) without the use of structures (e.g.brush layering and willow waddling). In other areas, biotechnical slope protection may involve the use of mechanical elements or structures in combination with biological elements to provide erosion control and help prevent small scale slope failures. Locally, Crib walls, welded-wire walls, gabion walls, rock walls, riprap, and reinforced earth walls used in combination with Carefully selected and planted vegetation can provide high quality slope protection. The vegetation may be planted on the slope above a low retaining structure or toe wall,or the interstices of the structure can be planted. 4412-W3 February 1, 2000 19 I nt'? EMEO INCORPORATED The portions of the creek corridor which are to be maintained by the GHAD should be inspected at least twice a year. One inspection should be in the fall prior to the onset of winter rains. A second inspection should be undertaken during the rainy season to monitor potential creek bank failures which could imminently threaten or damage site improvements. The maintenance program should include the monitoring of the subdrain outfalls from the mass grading operations which outlet to the creek in a number of locations along the creek bank. An annual inspection shall be made by the engineer and/or engineering geologist to assess the effectiveness of the preventive maintenance program and to make recommendations as to which landslide or erosion measures should be undertaken in the next fiscal year. Any appropriate site-specific study of landslide or erosion conditions shall be determined at that time. Consultants,if necessary, will be retained to undertake the needed studies. An annual inspection report to the GHAD shall be prepared by the District Engineer and/or engineering geologist. Notice of the hearing set pursuant to Section 26557 or subdivision (c) of section 26558 shall be mailed first-class, postage prepaid, in the United States mail, at least 20 days preceding the date of the public hearing, to each owner of real property within the proposed district as shown on the last equalized county assessment roll, or the State Board of Equalization assessment roll, as the case may be. 26562. A copy of the petition described in Section 26552 or the resolution described in Section 26558 shall be attached to the notice. 26563. The notice shall set forth the time, date, and place of the hearing, briefly describe the purpose thereof, and indicate where the plan of control may be reviewed or duplicated, at a cost not to exceed the cost of duplication. At any time not later than the time set for hearing objections to the proposed formation, any owner of real property within the proposed district may make a written objection to the formation. Such objection shall be in writing, shall contain a description of the land by lot, tract, and map number, and shall be signed by such owner. If the person whose signature appears on such objection is not shown on the assessment roll last equalized by the county as the owner of the subject real property, the written objection shall be accompanied by evidence sufficient to indicate that such person is the owner of such property. The determination by the legislative body of ownership for purposes of this section shall be final and conclusive. 26565. At the time set for hearing objections, the legislative body shall be presented with all objections made pursuant to Section 26564. Chi EREAS, Louis has devoted years of service to the Contra Costa County Fairgrounds in Antioch. In 1983 Governor George Deukmejian appointed him to the Board of Directors and was reappointed by Governor Pete Milson. Louis was-elected president of the Fair Board in 1985 and has served continuously to the present. He has been persuasive and persistent in the promotion of the Fairgrounds, the annual fair and agricultural education programs for children and community groups. WHEREAS; Louis' dedication and vision inspired planning an agricultural museum at the Fairgrounds, culminating in the fundraising and construction of the facility in 1998. The Fair Board named the building the Mangini "cultural Museum The museum opened in the summer of 1998 and exhibits feature farm equipment, a restored fire engine, a blacksmith shop and early, historic California farm implements. Part of the building is dedicated to an Agricultural Classroom Facility where students will have state-of-the-art instructional aids and hands-on opportunities for experiments and growing plants. The classroom, when complete will serve the county's schools for field trips and summertime programs focusing on agriculture, food, nutrition, and the environment.
