Any instance where an 6 entity, its owners, officers, or managing employees 7 submitted a bid on a public works project and were found 8 to be nonresponsive, or were found by an awarding body 9 not to be a responsible bidder. 10 (vii) Any instance where the entity, its owner, officers, 11 or managing employees defaulted on a construction 12 contract. 13 (viii) Any violations of the Contractors' State License 14 Law (Chapter 9 (commencing with Section 7000) of 15 Division 3 of the Business and Professions Code), 16 excluding alleged violations of federal or state law 17 including the payment of wages, benefits, apprenticeship 18 requirements, or personal income tax withholding, or of 19 Federal Insurance Contribution Act (FICA) withholding 20 requirements settled against any member of the 21 design-build entity. 22 (ix) Information concerning the bankruptcy or 23 receivership of any member of the entity, including 24 information concerning any work completed by a surety. 25 (B) The information required pursuant to this 26 subdivision shall be verified under oath by the entity and 27 its members in the manner in which civil pleadings in 28 civil actions are verified. The information required is not 29 a public record and shall not be open to public inspection. 30 (3) The county shall establish a procedure for final 31 selection of the design-build entity. Selection shall be 32 based on any of the following criteria 33 (A) A competitive bidding process resulting in 34 lump-sum bids by the prequalified design-build entities. 35 Awards shall be made on the basis of the lowest 36 responsible bid. 37 (B) A county may use a design-build competition 38 based upon performance and other criteria set forth by 39 the board of supervisors in the solicitation of proposals. 40 Criteria used in this evaluation of proposals may include, 99 i z, YIZI 4-7 AB 2296 1 but need not be limited to, the proposed design approach, 2 life-cycle costs, project features, and project functions. 3 However, any criteria and methods used to evaluate 4 proposals shall be limited to those contained in the 5 request for design-build proposals. Any architectural or 6 engineering firm or individual retained by the board of 7 supervisors to assist in the development of criteria or 8 preparation of the solicitation is not eligible to participate 9 in the competition with any design-build entity. The 10 award shall be made to the design-build entity whose 11 proposal is judged as providing the best value, and 12 meeting the interest of the board of supervisors and the 13 objectives of the project. 14 (e) (1) Any design-build entity that is selected to 15 design and build a project pursuant to this section shall 16 possess or obtain sufficient bonding consistent with this 17 section. This section does not prohibit a general or 18 engineering contractor from being designated the lead 19 entity on a the activities of the design-build entity. 20 (2) Any payment or performance bond written for the 21 purposes of this part shall be written using a bond form 22 developed by the county risk management. 23 (f) All subcontracts that were not listed by the 24 design-build entity in accordance with clause (i) of 25 subparagraph (A) of paragraph (2) of subdivision (d) 26 shall be awarded by the design-build entity in accordance 27 with the design-build process set forth by the county in 28 the design-build package. The design-build entity shall do 29 both of the following: 30 (1) Provide public notice of the availability of work to 31 be subcontracted in accordance with the publication 32 requirements applicable to the competitive bidding 33 process of the county. 34 (2) Provide a fixed date and time on which the 35 subcontracted work will be awarded in accordance with 36 the procedure established pursuant to this section. 37 (g) The minimum performance criteria and design 38 standards established pursuant to this article by a county 39 for quality, durability, longevity, life-cycle costs, and 40 other criteria deemed appropriate by the county shall be 99 i AB 2296 —6- 1 6- 1 adhered to by the design-build entity. Any deviations 2 from those standards may only be allowed by written 3 consent of the county. The board of supervisors may 4 retain the services of a design professional through the 5 course of the project in order to ensure compliance with 6 this section. 7 (h) The total price of the project shall be determined 8 either upon receipt of the lump-sum bids or by 9 completion of the process of evaluation previously stated. 10 (i) Each contract with a design-build entity shall 11 provide that construction or alteration of any county 12 project pursuant to this section may not commence prior 13 to the receipt of the written approval of the plans, as to 14 the safety of design and construction, from the county, 15 unless specifically agreed to by the county.
