HomeMy WebLinkAboutMINUTES - 02082000 - D3 TO: ' BOARD OF SUPERVISORS Contra osta FROM: CARLOS BALTODANO, DIRECTOR ...." :Younty BUILDING INSPECTION DEPARTMENT DATE: January 26, 2000 SUBJECT: Appeal of Abatement action at 711 Pacifica Ave., Bay Point APN # 099-110-031 Owner: George & Alberta Boeger SPECIFIC REQUEST (S) OR RECOMMENDATION (S) & BACKGROUND AND JUSTIFICATION REcobmNDATIONs: After hearing the appeal, it is recommended to deny the appeal and affirm the determination of the County Abatement Officer and direct the County Abatement Officer to proceed and perform the work of abatement, if the property owner does not complete the project within (6) six months. Should the project not be completed within the time-frame the County Abatement Officer will proceed with the abatement. FISCAL IMPACT: $10,000, if the County does the abatement. This amount to be offset by Performance bonds collected in the amount of$8,789.00 on permits #167484 & #167485. BACKGROUND/REASONS FOR RECOmmNDATIONS: Two (2) homes were moved onto the property and remain on blocks in an unfinished condition. A record research of the parcel revealed permit #167484 and #167485 were issued on November 6, 1990 to move these houses and place them on foundations. Permit#194141 and #194142 were issued on June 22, 1994 to reinstate the previous expired permits. These reissued permits expired on November 2, 1995. On March 23, 1999 a site inspection was conducted and the inspection revealed the following violations of the county ordinance: Title 7, Chapter 712-2.002 (substandard building) Title 7, Chapter 712-2.004 (Housing Code) The owner of the property has been notified of the violation(s)through written correspondence and certified mail. As of this date, compliance has not been gained. On April 22, 1999,the Building Inspection Department declared the property a public nuisance and posted a Notice Order to Abate under Title 1, Chapter 14-6. This appeal is being made under the provisions of this title. The public hearing on this matter was opened on July 13, 1999, at that time, the hearing was continued to September 14, 1999 at 11:00 am in the Board's Chambers. It was continued until November 2, 1999 at 10:00 am in the Board's Chambers. On November 2, 1999 the hearing was continued to February 8, 2000 at 11:00am.
