SUBJECT: Appeal of Abatement action at 711 Pacifica Ave., Bay Point

SPECIFIC REQUEST (S) OR RECOMMENDATION (S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS: After hearing the appeal, it is recommended to deny the appeal and
affirm the determinations of the County Abatement Officer and direct the County Abatement
Officer to proceed and perform the work of abatement.
FISCAL IMPACT: $10,000, if the County does the abatement. This amount to be offset
by Performance bonds collected in the amount of$8,759.00 on permits#167484 𨸾.
BACKGROUND/REASONS FOR RECOMMPMATIONS: Two (2) homes were moved onto the
property and remain on blocks in an unfinished condition. A record research of the parcel
revealed permit #167484 and #167485 were issued on November 6, 1590 to move these
houses and place them on foundations. Permit#194141 and #194142 were issued on June
22, 1994 to reinstate the previous expired permits. These reissued permits expired on
November 2, 1995. .On March 23, 1999 a site inspection was conducted and the inspection
revealed the following violations of the county ordinance:
Title 7,Chanter 71.2-2.002 (substandard building)
Title 7. Chapter 712.2.004 (Housing Code)
The owner of the property has been notified of the violation(s)through written correspondence
and certified mail. As of this date, compliance has not been gained.
On April 22, 1999,the Building Inspection Department declared the property a public nuisance
and posted a Notice Order to Abate under Title 1, Chapter 14-6. This appeal is being made
under the previsions of this title. The public hearing on this matter was opened on July 13,
1999, at that time, the hearing was continued to September 14, 1999 at 11:00 am in the
Board's Chambers.

you are hereby notified that Tuesday, July 13, 1999, at 9.00 a.m. , 651 fine Street,
Rooms 107, Martinez is the date,time and location set for the hearing of your appeal from
the decision of the County Abatement Officer declaring moved houses,mobilehome and
junkyard conditions in violation of C.C.C. Ordinance Code 14-6.410 Sections 712-2.002 and
712-2.004. The hearing will be conducted in accordance with procedures setforth in Contra
Costa.County Ordinance Code Section 14-6.410. A copy of the Uniform Public Nuisance
Abatement Procedure is enclosed for your reference.

This office is in receipt of the attached Appeal and check for the $125 filing fee
from Karl W. Boeger, from the decision of the County Abatement Officer declaring
as a public nuisance, moved houses, mobilehome and junkyard conditions in violation of
sections 712-2.002 and 712-2.004 of the Contra Costa County Ordinance Code (C.C.C.
Ordinance Code 14-6.410), on property located at 711 Pacific Ave., Bay Point
The Board of Supervisors has tentatively scheduled this appeal for hearing on July 13,
1999, at 9:00 a.m. in the Board Chambers.
Please notify this office in writing by June 8, 1999, whether the Board of Supervisors
should hear this appeal on the calendared date. If the appeal is timely and should be heard,

This letter is to request an appeal of the"NOTICE AND ORDER TO ABATE" issaed by
Mr. Tire Griffith on April 22, 1999. It demands the abatement of"the N-Tove Douses;

bequi~es me to Nvaste a $121-5.00 feu,and then to appear in front of the board of
Supervisors a coo-plete waste of the Boards time. I explained to Mr. Grit ith w,by the
lionies are not completed, about the. 41obile. I have detailed v,7hat is happening at tl;e
property to no avai L
I could not install the needed sewer line the move homes required until K.&B. resolved
here problem with the detention pond,which just happened. I am now atble to proceed
with the homes. My plan is to complete it all by the end of surnmer. I believe that Mr.
Griffith has rushed to the opinion that the mobile hone was not ever permitted; and giver}
a reasonable opportunity I should be able resolve this also.
The final complaint M. Griffith has is "Thejunkyard conditions"when 1 asked him to
please define what he thought was junkyard, he said:the metal pile, and.a boat.
I answered, "the pile of meta is a stall barn to be erected on site, and asked why I could
not park a boat.
I Believe mr, Griffith has over reacted to the situation. if lie had only called me as I
asked him to do the notice would.not have occurred.
