Broadway Ave. , Bay Point, APX # 096-042-008 Mabilehome Owner: .Jeff Hunt SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: After hearing the appeal, it is recommended to deny the appeal and affirsr, the determinations of the County Abatement Officer and direct the County Abatement Officer to proceed and perform the work of abatement. FISCAZ, IMPACT: $8, 000, if the County does the abatement. BACKOROUNDjREASONS FOR RECOMMENDATIONS: On january 27, 1999 a complaint was received regarding two mobilehomes placed partly on a right of way. On February 1, 1999 a site inspection was conducted and the inspection revealed the following violations: installation of electrical, sewer, water and gas supply lines without permits and improperly installed mobilehomes which encroached onto a Contra Costa County owned right of way. The following violations of the County Ordinance exist: Title 7, Section 72-6. 020, 74-1.002, 74-3 .101, 74-3 .305, 76-2.202, 76- 2 .702, 76-2.1,002, 76-4 .202, 76-8 .202, 76-8.402, 76-1 .501., 78-3 .002 (Electrical, sewer, water and gas installed without permits, ) Title 7 Section. 76-5 .202, 76-6 .204 (Non-permitted electrical equipment energized. ) Title 7 Section 71.2-2 .002, 712-2 .004 & 712-4 .004d (1) (Substandard dwelling) Title 8 Section 82-12 .202, 84-12 .202, 84--68 .1.306, and 84-68.14 2 (Obstruction of a public right of way and improper placement of a structure regarding property lines . ) Title 8 Section 84-68 .502 & 84-58 .1402 (Conversion of spaces to accommodate mobilehomes without required permits . ) The owner of the property has been notified through written correspondence and certified mail of these violations. As of this date, compliance has not been gained. On April. 9, 1999, the Building Inspection Department declared the property a Public Nuisance and posted a notice a+nd Carder to Abate under Title 1 Chapter 14-6, This appeal is being made under the provisions of this title. Costa County Ordinance Code Section 14-6.410 (public nuisance), You are hereby notified that Tuesday, June 8, 1999, 9:00 a.m. is the date and time set for the hearing of your appeal from the decision of the County Abatement Officer. The County Abatement Officer declared that two mobilehomes obstruct a public right-of-way and have been installed without regard to building permits in violation of C.C.C. Code, Title 7, 72-6.020, 74-1.002 (adopting by reference the Uniform Building Code) 74-.3.101, 74-3.305, 76-2.202, 76-2.702, 76-2.1002, 76- 4.202, 76-8.202, 76-8.402, 78-1.501, 78-3.002 (adopting by reference the Uniform Plumbing Code.); Non-permitted electrical equipment installations have been energized without approval of the Building Inspector, (C.C.C. Code, Title 7, 76- 6.202, 76-6.204.) ; Two mobilehomes have been set-up in the park which project beyond lot lines and obstruct a public right-of-way and a park roadway (C.C.C. Code, Title 8, 82-12.202, 84-68.1306, 84-68.1402(2).); Spaces in the original trailer park were converted to accommodate mobile homes without required permits from the Building Inspection Department (C.C.C. Code, Title 8, 84- +68.602, 84-68.1402.); The two mobilehomes constitute substandard housing in violation of the Contra Costa. County Ordinance Code (C.C.C. Code, Title 7, 712- 2002, 71.2-2.004 (adopting by reference the Uniform Housing Code), 712-4.004 (d)(1).) , and said listed violations constitute a public nuisance. The hearing will be held in the Board of Supervisor's Chambers, Room 107, 651 .pine Street (Administration Building), Martinez, C.A. 1 6 t The hearing will be conducted in accordance with procedures set forth in Contra Costa County Ordinance Code Section 14-6.410. A copy of the Uniform Public Nuisance Abatement Procedure is enclosed for your reference. If you challenge this matter in Court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the County at, or prior to, the public hearing.
