RECOMMENDATIONS
1, Adopt the Categorical Exemption, Section 15305, Class 5 prepared for this
project as being adequate.
2, Approve rezoning application RZ983065 as recommended by the County
Planning Commission.
3. Adopt the County Planning Commission's findings as set forth in Resolution
No. 14-1999 as the determination for these actions.
4. Introduce the ordinance giving effect to the aforesaid rezoning, waive reading
and set date for adoption of same.

RESOLUTION OF THE PLANNING COMMISSION OF THE COUNTY OF CONTRA
COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS AND
RECOMMENDATIONS OF THE REQUESTED CHANGE IN ZONING BY JOHN &
TRACY LAMONII (Applicants & Owners) (RZ983065), IN THE ORDINANCE CODE
SECTION PERTAINING TO THE PRECISE ZONING FOR THE CONCORD AREA OF
SAID COUNTY.
WHEREAS, a request by John& Tracy Lamond (Applicants& Owners), (RZ983065), to
rezone a 2 acre-parcel from Single Family Residential District (R-20) to Single Family Residential
District -10), for which an application was received by the Cornrnunity Development Department
on September 23, 1995; and
WHEREAS, for purposes of compliance with the provisions of the California Environmental
Quality Act and the State and County CEQA guidelines, the project was determined to be Categorical
Exempt from the requirements of the California Environmental Quality Act (Class 5, Minor
Alterations); and
AREAS, after notice having been lawfully given, a public hearing was scheduled before
the Planning Commission on Tuesday, February 23, 1999, whereat all persons interested therein
might appear and be heard; and
WHEREAS, on Tuesday, February 23, 1999, the County Planning Commission having fully
reviewed, considered and evaluated all the testimony and evidence submitted in this matter;
NOW, THEREFORE, BE IT RESOLVED that the County Planning Commission
recorends to the Board of Supervisors of the County of Contra Costa, State of California, that the
rezoning request of John & Tracy Lamond (Applicants & Owners) (RZ983065), be approved to
change from the Single Family Residential Zoning District (R-20) to the Single Family Residential
Zoaning District(R-10) and that this zoning change be made as indicated on the entitled findings map:
BE IT FURTHER RESOLVED that the reasons for this recommendation are as follows:
A. REZQ G FINDINGS:
1. Required Finding- The change proposed will substantially comply with the General
Plan.
Project Finding- The project is consistent with the goals and policies of the General
Plan relative to the site.
2. Required Finding: - The uses authorized or proposed in the land use district are
compatible within the district and to uses authorized in adjacent districts.

Project Finding-The R-10 single family residential use and density is consistent with
the General Plan designation for this site, (Single Family Residential -Figh Density).
The R-10 single family use will also be compatible with single family uses in the
surrounding area.
3. wired Finding- Community need has been demonstrated for the use proposed, but
this does not require demonstration of future financial success.
PLgj finding: The R-10 zoning district will assist in meeting the high density range
of 5.0 to 7.2 units per net acre identify in the LAND USE ELE'MENTT of the General
Plan.
BE IT FURTHER RESOLVED that the Chairperson and Secretary of this Planning
Commission will sign and attest the certified copy of this resolution and deliver the same to the Board
of Supervisors, all in accordance with the Government Code of the State of California.
The instructions by the Planning Commission to prepare this resolution was given by motion
of the County Planning Commission on'Tuesday, February 23, 1999 by the following vote:

The site is a 2.11 acre mostly vacant parcel with a few agricultural type accessory
structures.

The surrounding area consists of single family residences of the neighboring homes,
some a new and up-scale.

dated September 23, 1998. The site must be developed by use of public water
supply and sanitary sewers.
B. Contra. Costa County Fire Protection District: Memorandum stamped dated
October 22, 1998. No comments for rezone.
C. California. Historical Resources Information Ste: Memorandum stamped
dated October 22, 1998. The proposed project area has the passibility of
containing unrecorded archaeological site(s). A study is recommended prior
to commencement of project activities.
Staff will require an Archaeological Report to be submitted as a part of the
subdivision application..

dated October 26, 1998. No comments.

The applicant is requesting a rezoning from R-20 to R.-10 to establish consistency
with the General Plan designation of Single Family Residential-High Density.
The zoning district within the surrounding area consists of R-15, X410 and R.-6. The
properties immediately adjacent to the subject property are zoned R.m15 and R-40 with.
a pocket of R-6 across the street.
Section, 26-2.1806 of the County Ordinance Code requires specific findings to be
made by the planning agency when a request for change in a land use district is made,
They are as follows:
A. A change proposed will substantially comply with the General Plan.
B. The uses authorized or proposed in the land use district are compatible within.
the district and to uses authorized in adjacent district.
C. Community need has been demonstrated for the use proposed, but this does
not require demonstration of future success.
STAFF FINDS the following in regards to the above:
A. The General Plan for the subject property is Single 'family residential-High
Density with a density range of 5.0 to 7.2 dwelling wits per acre. The
requested zoning to R-10 is consistent with the General Plan.
B. The uses with the R-20 district are compatible to those within.the R-10.
C. The subject property is within the City of Concord's sphere of influence. The
City did not forward comments.

Ayers Ranch Subdivision, A PN 117-030-045
While this office has no significant qualms about the requested use modification of above noted
parcel from vacant to single family homes, we do offer the following information based on the
expectation of the construction of said homes. These guidelines are based upon OPTED (Crime
Prevention Through Environmental Design) security strategies and are strongly recommended
for planned future usage of this land.
1. Security Planting
a. Landscape shall be of the type and situated in locations to maximize observation while
providing the desired degree of aesthetics and privacy. Security planting materials are
encouraged along fence and property lines and under vulnerable windows.
2. Doors
a. All exterior wood doors and doors leading from enclosed garage areas shall be solid core
with a minimum thickness of 1-314".
b. Main entrance doors, pedestrian garage exit doors, and doors leading from enclosed
garage areas into single-family dwellings shall be secured with a single-cylinder deadbolt
lock with a minimum throw of one inch.
1) The locks into the residence shall be so constructed that both deadbolt and
deadlocking latch can be retracted by a single action of the inside doorknob. (garage
exit doors and rear French doors may have a regular deadbolt lock.)
2) Strike plates shall be secured to wooden jambs with at least 2-inch wood screws.
c. A viewing device or peephole shall be installed in main entrance doors and shall allow
for 180-degree vision minimum.
d. Sliding glass doors
1) Single sliding glass doors shall have the movable section of the door adjusted in such
a manner that the up and down play is taken up to prevent lifting with a pry tool to
defeat the locking mechanism.
2) Secondary dead locks shall be installed on all single sliding glass doors.
e. Vision panels in exterior doors or within reach of the inside locking device shall be of
burglary-resistant glazing or equivalent (5/16" security laminate, 1/4" polycarbonate or
approved security film treatment, minimum).
f. Overhead garage doers shall be equipped with automatic openers and shall not have
bottom vents except those doors having double louvered or shielded vents.
3. Windows
a. Windows shall be constructed so that when the window is locked it cannot be lifted from
the frame.
b. The sliding portion of a sliding glass window shall be on the inside track.
c. Window locking devices shall be capable of withstanding a force of 300 lbs. in any
direction..
4. lumbering
a. A street number shall be displayed in a prominent location on the street side of the
residence in such a position that the number is easily visible to approaching emergency
vehicles.
1) The numerals shall be no less than four inches in height and shall be of a contrasting
color to the background to which they are attached.
2) The numerals shalt be lit at night.
5. bighting
a. Each entry and exit door shad be equipped with a light source of sufficient wattage to
illuminate the door, porch, stairway, etc. Area lights, switch controlled from inside the
residence, are encouraged to illuminate the rear and side yards.
