DATE: .TLNTE 22, 1999 PAGE. -2- storm drain facility that is maintained by the Centra Costa Flood Control District(Drainage Area 75A). The landslide was a reoccurrence of a previous landslide that was repaired by the golf course, in cooperation with the Flood Control District. Since the landslide damaged facilities maintained by the Flood Control District(FCD)as well as portions of the Canyon Lakes Country Club's golf course,the General Manager proposed a joint project under which both the landslide and the damaged flood control facility could be repaired. A Memorandum of Understanding(MMU)was developed to define and assign responsibilities of the GHAD and the FCD with respect to the proposed project. The Canyon Lakes Country Club agreed to assume responsibility for repair of landscaping and irrigation improvements damaged by the landslide and/or repair work. On September 3, 1998,the CHAD advertised for bids for repair of the landslide and the storm drain system. Because of the emergency nature of the project and the requirements of the regulatory agencies,a contract was awarded to Independent Construction on September 17, 1998 after consultation with the Flood Control District, The Board of Directors ratified the General Manager's decision to award the emergency repair contract on October 6, 1998. Subsequent to award of the contract,the General Manager issued a total of three Contract Change Orders, increasing the contract payment limit by$34,881.14 to a total of$159,561.14. The Change Orders were required to compensate Independent Construction for work related to the installation of a concrete lined drainage ditch and unanticipated earthwork. All of the extra work was performed at the recommendation of Engeo,Inc.,the GHAD's geotechnical engineering consultant and David Evans Associates,the GHAD's civil engineering consultant. Sufficient funds are available in the GHAD budget and it's reserve account for the project, including the recommended change orders. Pursuant to the terms of the MOU with the Flood Control(District,the GRAD and the Floud Control District will share in the cast of the project and the change orders. Consequences of legative Action: The change orders have been issued and the work completed. Board action is necessary to ratify the General Manager's decision to issue the Change Orders and complete this emergency project.
