III, REASONS FOR_REC RECOMMENDATION/BACKGROUND:
On May 3, 1999, the Board of Supervisors approved plans and specifications for this project.
Addendum No. 2 is needed to extend the bid due date to June 22, 1999. Addendum No. 3 is
needed to clarify ®BE requirements, bid submittal requirements, and plan and specification
clarifications.
1V. CONSEQUENCES OF NEGATIVE ACTION:
If Addendum No. 2 and No. 3 are not approved, the bid due date would remain on June 6, 1999,
and the DBE requirements, bid submittal requirements, and plans and specifications may not be
clear to the bidder.

The estimated contract cost of the project is $91,000, funded by FEMA Funds (75%), State ice

111, REASONS FOR RECOMMENDATION/BACK ROUND:
The project is needed to repair storm damage during the 1996 EI Nino Storms.
The project has been determined to be in compliance with the General Plan and is exempt from.,
CEQA because it consists of minor alteration of existing facilities that will not involve an expansion
of use beyond that previously existing nor result in the removal of any scenic resources,
The Chief Engineer has filed with the Board of Supervisors the Flans and Specifications for the
project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the project is not approved for advertising, it will not be constructed.

GENERAL CONSIDERATIONS:
1. Location:The project Is located along a 1.5 toile section of Rodeo Creek in the west county area
rear the Town of Rodeo and the City of Hercules(Figures 1,2)..
2. project Description: The project consists of the repair of nine slipouts on a 1.5 mile section of
Roden Creek., Four of the slipouts(Sites ', 2, 6, and 9 on the attached plan)will be repaired
through bloengineering techniques exclusively'i.e.,native grass plugs will be installed to stabilize
the banks). Two of the sites (Sites 3 and 7) will be repaired through a combination of
bloenginsering and armoring the banks with rock slope protection. The remaining three areas
(Sites 4, 5, and 6) are damaged severely enough that they must be repaired with rock slope
protection exclusively. On the sites that will be repaired with rock slope protection,the entire work
area will be dewatered and flows will be diverted around the construction zone to ensure
continuous flows downstream of the project area. Equipment will not be operated within the live
stream channel. A sediment titer darn will be Installed downstream of the project area to minimize
sedimentation, C{sturbed areas on the banks of the channel will be hydroseeded at the
complet#on of construction. The wont will impact the minimum amount of vegetation possible.A

from the Canyons at Blackhawk Owner's Association requesting annexation to the Blackhawk GHAD.

111. Reasons for Recommendations and Bac round:
By letter dated December 11, 1998,David Larsen of Berding&Weil,LLP, on behalf of The Canyons at
Blackhawk Owner's Association(Association)requested that the Beard of Directors authorize William R.
Gray and Company,as General Manager of the Blackhawk GRAD,to review and report back on the viability
of the Association becoming a member of the Blackhawk Geologic Hazard Abatement District GHAD. The
following is a summary of our findings:
1. County Service Area(CSA)M-23 was formed in June of 1977 by Resolution 77/767 to fund a number of
specified extended services. Geologic hazard abatement was added to the list of authorized services by the
Board of Supervisors in April of 1986(Resolution 86/209).
2. The Board of Supervisors formed the Blackhawk CHAD in April of 1986(Resolution 86/210). The
geographic area covered by the GRAD corresponds to the geographic area of the Blackhawk project and
was initially coterminous with the geographic area of County Service Area(CSA)M-23.
3. In April of 1986 the Board of Supervisors and the Board of Directors of the GLAD entered into a Joint
Exercise of Powers Agreement(JEPA)under which the County(Resolution 86/211)agreed to fund
operation of the GHAD using"CSA M-23 surplus"revenues(as defined).
4. CSA M-23 is comprised of four Tax Rate Areas(IRA's). The TRA allocation factors for the four TRA's
are 6.92040%for TRA 66050; 6.84109%for TRA 66162;6.86203%for TRA,66166 and 0.00%for TRA
66343 (Blackhills annexation,not in GHAD,see#6 below).
5. On September 20, 1990,the Board of Supervisors approved the Blackhills project,now known as The
Canyons at Blackhawk. The conditions of approval for the project were silent with respect to participation
in the Blackhawk CHAD.
6. On October 10, 1990 the Local Area Formation Commission(LAFCO)approved the"Blackhills Boundary
Reorganization"(LAFC 90-29)which,among other things,annexed the developed portions of the
Blackhills development into County Service Area M-23. Prior to final approval by LAFCO,the Board of
Supervisors approved a Determination of Property Tax Transfer for the Blackhills Boundary
Reorganization(Resolution.90/589)and determined that there should be"no transfer of property tax to
CSA M-23"as a result of the reorganization.
7. While The Canyons at Blackhawk is within CSA M-23,the action of the Board with respect to the
Property Tax Transfer for the Blackhills Boundary Reorganization(Resolution 90/589),makes annexation
into the CHAD problematic.
8. The boundaries of CSA M-23 and the Blackhawk GRAD are no longer coterminous.
As noted above, operation of the Blackhawk CHAD is funded through a transfer of"surplus CSA M-23
revenues"under a Joint Exercise of Powers Agreement(JEPA)between the Blackhawk CHAD and the
County. "Surplus revenues"are defined to include all M-23 revenue after deductions for 1)drainage
maintenance extended services(defined)and 2)street lighting extended services(defined).
Before The Canyons at Blackhawk can be annexed into the Blackhawk CHAD,a source of revenue to support
GHAD operations would be needed. At this point,there would appear to be two options:

1. Modify the existing Property Tax Transfer Agreement for Tax Rate Area(TRA)66343 to provide funding
for CSA M-23 at a level similar to that provided by TRA's 66050,66162 and 66166(approx. 6,87451%).
This could be difficult because all other agencies in the TRA receiving tax revenges would need to concur.
2. The second option would be to establish a separate annual assessment for properties within The Canyons at
Blackhawk. Linder proposition 218, imposition of the assessment would require 2l3 affirmative vote of
owners of property within the"area of benefit"—likely the 37 properties within The Canyons at
Blackhawk. Although an Engineering Study would be required to formally establish the level of the
annual assessment, it would likely be close to 0.0683%of the average assessed value of property within
the development or approximately$350 per parcel per year. It would be our recommendation that any
such assessment be subject to annual increases based on increases in the Consumer Price Index(CPI).
In addition to identifying a revenue stream to support CHAD operations, a precondition to annexation into the
GHAD should be a"buy-in"to reflect the fact that the Blackhawk CHAD currently has a fairly substantial
reserve account. Once The Canyons at Blackhawk joins the CHAD,they would have benefit of existing
reserves. As a result, it is recommended that any property annexed to the GHAD property be required to"buy-
in"to reflect the fact that existing properties within the CHAD have been contributing to the reserve account.
A Reserve Study is currently underway and, if the owners of property within the Canyons at Blackhawk desire
to purse annexation,the consultant retained by the CHAD to perform the reserve study should be asked to
recommend an appropriate buy-in amount.
IV. Consequences of Negative Action:
The GHAD's response to the Canyons at Blackhawk would not be authorized by the Board of Directors.
