RECOMMENDATION APPROVE a License, commencing January 1, 1999, with Watson Communication Systems, Inc. for the premises at the Rocky Ridge communications site, Danville, California, for continued occupancy by the General Services Department, under the terms and conditions more particularly set forth in said License, and AUTHORIZE the Director of General Services to EXECUTE said License on behalf of the County and RESCIND the Board Order dated June 23, 1998 for the same site. IL FINANCIAL IMPACT Payments required are to come from the budget of the General Services Department. Ill. REASONS FOR RECOMMENDATION d BACKGROUND This license requested by the General Services Department will provide for continued use of the Rocky Ridge communications site, which is an essential link in the County's microwave system. Gilbert, Director of General Services SUBJECT: Additional Information on Agenda Item C135, License Agreement for Rocky Ridge Communications Site, Held from June 15, 1999 Board Agenda to be Placed on Consent Calendar for June 22, 1999 Due to the meteoric increase in the use of wireless communications, plus a public concern on environmental issues related to siting of communication towers on hilltops, existing hilltop communication sites have become a valuable asset to owners/lessors. Public safety agencies must compete with the demand from private wireless communication providers for limited tower/repeater communication sites that have towers, vaults, microwave dishes, and antennas. The license agreement proposed with Watson Communication for the County's continued use of the Rocky Ridge site in Danville reflects the increased value of that communications site. Rocky Ridge site is a critical link in the County's microwave communications loop that serves the entire County and is used daily for public safety communications for police, fire, and medical response. The microwave system is critical in the event of a major disaster. There is no alternate location for the County that serves this area. BACKGROUND OF ROCKY RIDGE • The County moved onto Rocky Ridge 21years ago. For many years the County was charged $532.00 per month with no inflationary increases in the rent. It was only recently that Watson Communication determined that the rents should be set to reflect the enhanced value of the communication site. • Watson initially requested a new rent of $8,775.00 per month. In consideration for having worked with the County for 21 years, Watson proposed to give the County a 30% discount for a monthly rate of $6,142.50. Because this was still such a large increase for the County, even with a 30% discount, Lease Management staff spent Rea Additional Information on Agenda Item 0135, License Agreement for Rocky Midge Communications Site, Meld. from June 15, 1999 Board Agenda to be Placed on Consent Calendar for June 22, 1999 Page—2- many months negotiating a better deal for the County. o Watson recognized the public safety use for the County and eventually agreed to charge the County the same amount of rent for equipment in the communications vault at Rocky Ridge as the County charges for equipment in its vaults at other communication sites. This worked out to $3,600.00 per month, based on the County's fee schedule. If the County removes equipment, the rent goes down. If the County adds equipment, the rent ,goes up. While this new rental amount is significantly higher than the previous rent paid by the County, Watson undoubtedly could find other tenants that would pay the higher rent. The County would lose an important communications site if the County doesn't agree to the negotiated rent of $3,640 per month, which is 59% less than the first rental increase Watson requested.
