I. RECOMMENDED ACTION:
Approve and authorize the Chair of the Board of Supervisors to execute on behalf of the
County an agreement with State of California-Department of Insurance, for a CLETS
(California Law Enforcement Telecommunications Systems) connection;through the
County's computers.
This contract will generate monthly revenue of$165.00.
II. REASON FOR RECOMMENDATION AND BACKGROUND:
Through the County's computers and communication networks we are able to provide
inter-agency communications capabilities to City, County, State and federal agencies.
One of these programs is known as the ACCJIN which ties most of the County, City and
special district police agencies into a single network. ACCJIN is able to access the
state's CLETS network enabling all the ACCJIN agencies to access CLETS information.
Qualified non-county law enforcement agencies can access ACCJIN through the
County's computers for a monthly service charge.
III. CONSEQUENCES OF NEGATIVE ACTION:
If this request is not approved,the County will not be able to enerate this rev

WITNESSETH: That the Contractor for and in consideration of the covenants, conditions, agreements, and stipulations of the State
hereinafter expressed, does hereby agree to furnish to the State all ser✓ices, materials, tabor and equipment necessary to perforin the

This Agreement is entered into by and between the California Department of Insurance CCDI'�, and the County of Contra
Costa, ("County" to provide CDI with access to the California Law Enforcement Telecommunications System ("CLETS")
network.
The term of this Agreement shall be effective July 1, 1999 through Jude 30, 2000.
For these services, the State agrees to compensate the County at the rates established in Exhibit A, Service Marr and
Budget. The maximum amount payable under this Agreement shall not exceed $5,000.00. 'Payment will be made
monthly in arrears of service upon receipt of invoices in triplicate from the Contractor,

GENERAL TERMS AND CONDITIONS

3. 'Term: The effective date of this Contract is July €, €999 and it terminates June 30, 2000 unless sooner
terminated as provided herein.
4. Term ination:"his Contract may be terminated by either party, at their sole discretion, upon thirty day
advance written notice thereof to the other,and may be cancelled immediately by written mutual consent.
5. Agency's Obligations: In consideration of County's provision of services as described below, Agency
shall:
21 a. (all public agencies) shall pay County monthly for services provided hereunder upon
submission of a properly documented demand for payment, in accordance with the per-unit costs expressed in
the Service Plan.
0 b. (all non-public agencies) pay County (quarterly, monthly, yearly) for services provided
hereunder, upon submission of a properly documented demand for payment, in accordance with the per-unit
costs expressed in Services flan.

7. Third Party use of Data: User's Indemnification.
User hereby agrees to defend, save, hold harmless and indemnity County and its officers, employees and
agents, against claims by anyone for any loss, injury, damage, rise, cause of action, or liability of any type
(including legal fees)occurring to User or any other person, relating to or arising out of the subject matter of
this Contract, or which may be alleged to have been caused, either directly or indirectly,by the acts, conduct,
omissions, negligence or lacy of good faith of County, its officers, agents or employees in any way related to
or arising out of the subject matter of this contract.
8. County's Disclosure and Disclaimer: Warning to User; User's Waiver:
a. That County makes absolutely no warranty whatsoever, whether expressed or implied, as to the
accuracy, thoroughness, value, quality, validity, merchantability, suitability, condition, or fitness for a
particular purpose of the data, nor as to whether the data is up-to-date, complete or based upon accurate or
meaningfill-facts. User agrees to take the records "as is," fully expecting that there may well be errors and
emissions in the data obtained through the system.

b. That User hereby forever waives any and all rights, claims, causes of action or other recourse that it
might otherwise have against County for any injury or damage of any type, whether direct, indirect,
incidental, consequential or otherwise, resulting from any error or omission in such data, or in any manner
arising out of or related to this agreement or the data providers hereunder.
g. Defenses of County.
a. User understands and agrees that this is the entire agreement for the service prodded and that nothing
that may be stated or done by any County employee, agent or official shall be deemed to waive or toll any
statute of limitations, waive any defense or it, any way stop the County from asserting any and all defenses
provided by law or this Agreement.
b. County assumes no responsibility for loss or damages to User's equipment installed in Contra Costa
County's Central Data Processing Center.
10.Independent Contractor Status: This Contract is by and between two independent contractors and is
not intended to and shall not be construed to create the relationship of agent, servant, employee, partnership,
joint venture or association.

California Government Code Sections 23008 and 26227.

SERVICE FLAN ANIS} BUDGET
The County Department of Information Technology will provide the CCI with a CLETS
connection through the County's central computer systema The fees for this service are listed
below. At some future date it may be necessary to raise the monthly fees. If this occurs, the
County will provide a thirty (30) day written notice. At this paint there will be not charge for the
monthly reports generated by the system. If the size of the reports increase there may be a
future charge.

SUBJECT: Approval For Submission and Execution of Contract With the State of California, Department of
Insurance, for the Purpose of Combating Worker's Compensation Insurance Fraud for the Period
of July 1, 1999 through June 30, 2000.
REQUEST(S)OR RECOMMENDATIONS&BACKGROUND AND JUSTIFICATION
I. Recommended Action
Authorize the District Attorney to submit an application and execute a grant award contract, including any
extensions and amendments thereto, with the State of California, Department of Insurance, for funding
of the prosecution of worker's compensation insurance fraud for the period July 1, 1999 through June
30, 2000, in the amount of $433,985.
11. Financial Impact
Done, The grant application in the amount of$433,985 will fund the salary and benefits for two attorneys,
an investigator, and one-half clerk assigned to the program. The worker's compensation insurance fraud
award is allocated from a trust fund financed by an assessment payable by the insurer. Of the
assessment amount, approximately one-half is earmarked for distribution to district attorneys for
enhanced prosecution of worker's compensation insurance fraud. Supplantation is prohibited.
Expenditures and revenue for these positions are included in the District Attorney's 1999/00 proposed
budget.
111. Reasons for Recommendations/ Background
The Legislature has determined that one of the significant factors driving up the costs of worker's
compensation insurance is fraud. While fraud is recognized a4aowing problem across the country,
California is an area of concerted criminal activity in insurancd. The cast of insurance coverage
has been a major factor in the high cost of doing business in te. SB 1218 (Presley) was enacted

to put teeth into the law and to provide resources for enforcement.
If the grant is approved, it will allow the District Attorney to continue to place specially trained staff
in the Criminal Fraud Division who will be able to concentrate on the growing problem of worker's
compensation fraud.
IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to approve this recommendation would result in the inability of the District Attorney to apply for
$433,995 in state funds designated for use by Contra Costa County in the prosecution of worker's
compensation insurance fraud. A county which fails to submit this application shall not be considered
for funding, and their undistributed funds shall be returned to the Department of Insurance to be
reprogrammed.

RESOLUTION OF THE GOVERNING BOARD
WHEREAS the Board of Supervisors, Contra Costa County, desires to undertake a certain
project designated as the Worker's Compensation Insurance Fraud Prosecution Program to be
funded in part from funds made available under the authority of California Insurance Code section
1872.83 and administered by the California Department of Insurance (hereinafter referred to as
DOI).
NOW,THEREFORE, BE IT RESOLVED that the District Attorney of the County of Contra
Costa is authorized to execute on behalf of the Board of Supervisors the Grant Award
Agreement, including any extensions or amendments thereof.
IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement,
including civil court actions or damages, shall be the responsibility of the grant recipient and the
authorizing agency. The State of California and the California Department of Insurance disclaim
any responsibility for such liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used to
supplant expenditures controlled by this body.

Costa County Redevelopment Agency; and as the Governing Board of the Contra Costa
County Redevelopment Agency, APPROVE AND AUTHORIZE the Deputy Director
Redevelopment to execute a Service Agreement with the County of Contra Costa.

None. The Service Agreement formalizes current practice, County pays administrative
expenses associated with the Redevelopment Agency and then bills the Agency for payment.

Staff services to the Contra Costa County Redevelopment Agency are provided primarily by
personnel of the Contra Costa County Community Development Department. Cather services
to the Agency are provided by other County departments, including the County Administrator's
Office, County Counsel, and Public Works, among others. In order for the Agency to declare
its.debt and thereby qualify for its receipt of tax increments, the Agency and the County should
formalize this arrangement in contractual form. The Service Agreement will accomplish that.

1999-2000 Title IIIIVII State Standard Agreement in the amount of$2,284,654
and submit future Standard Agreement amendments that only reflect an
adjustment of line items or increased revenues when amendments do not result in
a decrease in grant revenue or additional County cost beyond funds already
available in the approved budget for the Social Service Department.
Il. FINANCIAL IMPACT
The FY 1999-2000 Sub-grant Award will provide $2,284,654.00 of Federal and
State funds to conduct programs and activities on behalf of county residents age
60+under Title III and Title VII of the Older Americans Act. The Area Plan
Budget for FY 1999-2000 provides for a required County match of approximately
$110,000. This County revenue has been included in the FY 1999-2000 budget of
the Social Service Department.

III. REASONS EQR REQ MM NTDATIONI ACKGRQUND
Since 1976 the Office on Aging has been providing services for ober residents of
the County udder"Title III of the Older Americans Act. Under the 1999-2000
Area flan Update and State Standard Agreement Budget Display the Office on
Aging will continue to fund contractor agencies to provide congregate meals,
home-delivered meals, legal assistance, home visiting, in-home services registry,
transportation, long term care ombudsman services, and social day care. In
addition, the Office on Aging will provide information and referral services,
preventive health care, and disease prevention program and perform the program
development, coordination,administrative and planning functions of an Area
Agency on Aging.
