RECOMMENDATIONS:
I, ACKNOWLEDGE that the Animal Services Department's shelter in Martinez
is nearly 50 years old and needs to be replaced since it is currently
inadequate to meet the needs of a growing community of 900,000 residents.
2. RECOGNIZE that 36,515 animals a year are processed through the Animal
Services Department.
. ACKNOWLEDGE that two pieces of legislation were enacted in 1995 that will
put severe additional pressure on the resources of the Animal Services
Department, SB 1735 by Senator Tons Hayden (Chapter 752, Statutes of
1998)and AB 1855 by Assemblyman Edward Vincent(Chapter 747, Statutes
of 998) by requiring that animals be held longer before they are euthanized,
requiring that all animals be spayed or neutered before they are sold or given
away, and prohibiting any "treatable" animal from being euthanized.
4. RECOGNIZE that replacement of the Martinez animal shelter will cost
approximately $6 million.
5. RECOGNIZE Haat the Central Contra Costa Sanitary District is interested in
acquiring from the County the property the Animal Services Department
presently occupies across the street from the Sanitary District's
headquarters.

6. CONCLUDE that the County owns an appropriate parcel of property adjacent
to the Public Works/General Services corporation yard near the intersection
of Waterbird Way and Imhoff Road in Martinez which would be a suitable
location for a new animal shelter.
7. AUTHORIZE the County Administrator and Animal Services Director to
complete negotiations with the Central Contra Costa Sanitary District for sale
of the property presently occupied by the Animal Services Department in
Martinez,with the proceeds being dedicated to the replacement of the shelter
in Martinez.
8. AGREE to dedicate the property adjacent to the Public Works/General
Services corporation yard in Martinez as the site for a new animal services
shelter.
9. AUTHORIZE the Animal Services Director to solicit donations from the public
and nonprofit agencies that will benefit from improved animal care facilities
and REQUEST the Auditor-Controller to establish an Animal Services Shelter
Fund to receive the funds raised by this and related actions noted below.
10. DI RECT the County Administrator and Animal Services Director to work with
the Auditor-Controller to file the necessary claims with the State to attempt
to recover the additional costs mandated by SB 1785 and AB 1856, with the
proceeds being dedicated toward the retirement of the debt which will be
incurred to replace the Martinez shelter.
11. DIRECT the County Administrator and Animal Services Director to examine
the animal services fee schedule and revenues currently being contributed
by the agencies which currently use the shelter, determine whether any
adjustments to those fees is justified and report their conclusions and
recommendations to the Board of Supervisors.
12. DIRECT the County Administrator to determine the balance of funding which
is needed to complete the construction of the Martinez shelter and make
recommendations to the Board of Supervisors for the sale of bonds to cover
this remaining balance.
BACKGROUND:
The State of California, by enacting SB 1785 and AB 1856, has imposed costly
modifications on the programs administered by the Animal Services Department.
SB 1785:
1. Effective July 1, 1999
2. Declares as State policy that animal adoption is favored over euthanasia and
that public and private shelters and humane groups should work together to
end euthanasia of adoptable and treatable animals by 2010. Adoptable
animals are those eight weeks or older that do not have untreatable health
problems or display a dangerous behavioral or temperamental defect that
could pose a health or safety risk or otherwise make the animal unsuitable
as a pet,

1 Requires an increase in the holding period for stray dogs and cats from three
days to six days.
4. Allows a reduction in the holding period to four days if an animal has been
rade available for redemption until 7:00 P.M. one night a week or one
weekend day.
5. Extends the holding time provisions to other animals that may legally be kept
as pets, i.e., birds, reptiles, rabbits, etc.
6. Requires that surrendered animals be held two days. The holding period is
increased to six or four days effective July 1, 2001.
7. Requires that "... no treatable animal should be euthanized. A treatable
animal is any animal that is not adoptable but could become adoptable with
reasonable efforts,"
AB 1866:
1. Effective January 1, 2000.
2. requires that all dogs and oats that are sold or given away by a public or
private agency be spayed or neutered.
3. Imposes a series of escalating fines on the owners of animals that are
impounded that are not spayed or neutered.
4. Will require increasing the capacity of the County Spay/Neuter Clinic,
contracting for spay/neuter services and cooperation among other
government agencies and non-profit organizations or a combination of the
above for successful implementation.
Fiscal Impact:
This legislation will require the expenditure of County funds for building replacement
and improvement as well as ongoing personnel cost increases. The extend of
these expenditures will depend on:
1. The amount the Central Contra Costa unitary District is willing to pay for the
Martinez animal shelter property.
2. The cost of a new shelter sufficient to meet the needs of the citizens of the
County and humanely house and care for the animals in the custody of the
Animal Services Department.
1 The dollar amount of donations received by the project.
4. The extent of efficiencies realized as a result of a new Martinez animal
shelter.
5. The amount to be received from the State as a result of SB 00 claiming.
