Project No. 0602-5R4127, CDD-CR# 98-5 Specific Request(s) or Recommendation(s) & Background and & Justification L RECOMMENDED ACTION: APPROVE Addendum to the Mitigated Negative Declaration, CP#98-5, (the custodian of which is the Redevelopment Agency located at 551 Pine Street, North Wing-4th Floor, Martinez), FIND that an easement over Assessor's Parcel Numbers 037-100-003 and 037-100-016 is needed for utilities related to the project, DIRECT the Public storks Director to begin right of way acquisition for the necessary easement. DIRECT the Director of Community Development to filo a Notice of Determination and a Certificate of Fee Exemption: De Minimis Impact Finding with the County Clerk, and DIRECT the Deputy Director, Redevelopment to arrange for payment of the $25.00 handling fee to the County Clerk, and DIRECT the Director of Community Development to file a Notice of Determination and a Certificate of Fee Exemption: De Minimis Impact Finding with the County Clerk. FINANCIAL IMPACT: No general funds are involved. The estimated total project cost is approximately 3 million. The project is to be funded by the Redevelopment Agency. III. REASONS FOR RECOMMENDATION/BACKGROUND: On December 15, 1999, the Board of Supervisors approved the Oakley Light-Industrial Infrastructure Phase I (Carol Lana Extension and and Cul-de-sac) Project. More precise engineering of this area determined a problem in providing sanitary suer facilities from the cul-de-sac. The solution to this situation is to provide utilities via an easement from the end of the cul-de-sac to Carol Lane. The Addendum to the Litigated Legative Declaration for the Oakley Light-Industrial Infrastructure -phase I `Carol Lane Extension and Cul-de-sac) Project identifies the need to acquire a 15 ft. permanent easement for utilities and an additional 15 ft. temporary construction easement. The Addendum is consistent with County policies and does not lead directly or indirectly to significant physical changes in the project, nor does it alter the adequacy or the completeness of the environmental impacts and mitigation measures identified in the Litigated Negative Declaration. Therefore, the Addendum to the Litigated Legative Declaration is appropriate. IV.
