ADOPT T resolutions to extend the licenses for TCI (Finale) doing business as Contra Costa Cable, Co., Teievent , Inc, and Televents of East County, Inc. FINANCIAL. IMPACT: None. BACKGROUND: The County hes extended two of the three cable systems to complete negotiations on compliance issues. It appears that most of these issues have been resolved, To go forward with renewals the Cable Act states that the renewing Cable Company can be asked to meet current customer needs and interests. Ten cities and the County are in the process of conducting e survey approved by the Board of Supervisors to obtain information from cable Subscribers about customer needs and interests, This information will not be compiled until 2000. Since the Survey information can be useful to negotiate renewal agreements with the above systems, staff recommends extension of the licenses until August 2000. ATTESTED�gil- BATCHE6 CR,CLERK OF THE BOARD OF E3Y EPUTY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this 0-rder on, by the fo-11 lowing vote: AYES: SUPERVISORS GIOIA, UILKEMA, GERBER and CANCIAMILILA NOES: NONE ABSENT- SUPERVISOR DESAW-NIER ABSTAIN: NONE SUBJECT: Extending Cable Television Resolution No. 99/3 o 9 Licenses to Televents, Inc, and Televents of East County, Inc. ) WHEREAS on November 1, 1982 and November 29, 1982, the Board granted non-exclusive licenses to Televents, Inc. to construct, operate and maintain cable television systems in the unincorporated Southern (Danville-Alamo area) and Northern (Lamorinda area) portions of Contra Costa County in accordance with Division 58 of the County Ordinance Code (Ordinance N o.82-28); and WHEREAS on December 30, 1982, the Board granted a non-exclusive license to Televents of East County, Inc. to construct, operate and maintain a cable television system in the unincorporated Eastern portion of Contra Costa County(Brentwood area) in accordance with Division 58 of the County Ordinance Code (Ordinance No. 82-28); and MRM AS the above described licenses expire on November 1, 1997,November 29, 1997 and December 30, 1997, respectively; and WTIEREAS the licensees desire to renew their licenses; and WHEREAS the County and the Licensees have resolved certain license fee matters related to the FCC's "Baltimore" decision (City of Dallas, Texas, et al. V FCC) and a payment of$179,892 has been received ; and license fees matters related to TCPs audit on advertising revenues, home shopping revenues, etc. have been resolved and a payment of$25,000 has been received; and the resolution of the issue regarding franchise fees on advertising revenues is in process; and VaIEREAS the County is conducting a cable television needs assessment in cooperation with ten cities which will not be completed until the year 2000; and WHEREAS the County and the Licensees desire to extend the above-described licenses to completion of the assessment and facilitate negotiation; and NOW THEREFORE,BE IT RESOLVED that the above-described licenses are extended to and including August 31,2000. BE IT FURTHER RESOLVED that this extension is granted upon the same terms and conditions, and subject to the same limitations,presently applicable to the licenses, including all provisions of Ordinance No. 82-28, BE IT FI, IES RESOLVED that the granting of this extension shall not: (1) be deemed a waiver of any of the requirements applicable to the above-described licenses,including without limitation the Licensees' obligation to pay license fees thereunder;(2)in any way affect the rights and remedies available to the County in the event that the license fee matters described above are not resolved; and (3) affect the County's right and ability to consider all relevant matters, including without limitation the license fee matters described above,in deciding whether to grant the Licensees' applications for renewal. W superv�i�,and C; RESOLUTION NO. 99AO9 71, 1-1/ THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY,, CALIFORNIA Adopted this Resolution on June 15, 1999, by the following vote: AYES: SUPERVISORS CIOIA, UILKEMA, GERBER and CANCIAMILLA ABSENT, SUPERVISOR OESAULNIER ABSTAIN: NONE SUBJECT: Extending Cable Television } RESOLUTION NO. 9913 10 License of Contra Costa Cable } Co. and Crockett Cable Systems, } Inc, } WHEREAS, on April 24, 1984,the Board granted a non-exclusive license to Viacom Cablevision (Contra Costa Cable Company and Crockett Cable Systems, Inc.)to construct, operate, and maintain a cable television system in the Crockett-Rodeo, El Sobrante, and San Pablo areas of Contra Costa County in conformance with the provisions of County Ordinance No. 82-28; and WHEREAS, through its acquisition of Viacom Cablevision, TCI Communications, Inc. (TCIC) has acquired control of the above-described license; and WHEREAS the above-described license expired in May, 1999; and WHEREAS the licensees (Contra Costa Cable Company and Crockett Cable Systems, Inc.) desire to renew their license; and WHEREAS the County, in cooperation with ten cities, is inthe process of conducting a cable television needs assessment that will not be completed until the year 2000; and WHEREAS the County and the Licensees desire to extend the above-described, license to facilitate completion of the assessment and negotiation of an appropriate renewal. NOW, THEREFORE, BE IT RESOLVED that the above-described license is extended to and, including August 31, 2000.
