The Board of Supervisors of Contra Costa County RESOLVES that:
The County of Contra Costa on March 31, 1999 contracted with bless Concrete Construction Company,
Inc., for the reconstruction of a portion of California Street in the Rodeo area, with Reliance Insurance
Company as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with the approved
plans, special provisions and standard specifications and recommends its acceptance as complete as
of May 7, 1399.
Therefore, said work is ACCEPTED as completed on said date, and the Cleric shall file with the County
Recorder a copy of this resolution and Notre as a Notice of Completion for said contract.

Illi. Reasons for Recommendations and Background:
The construction contract for the Camino Tassajara Realignment Project was awarded to the lowest
responsible bidder on March 16, 1999. Construction activities were expected to begin on May 10,
1999 and the Consulting Services Agreement is due to expire on December 31, 1999.
The construction management services include construction engineering, project management and
construction inspection. Nolte Assoctiates, inc. was awarded the contract from a field of ten
consulting firms.
IV. Consequences of NUative Action:
If the Consultant Services Agreement with Nolte Associates, Inc. is not approved, it may not be
possible to complete construction of the approved project.

DIRECT that, in accordance with the project specifications and/or upon the execution of the
contract by the Public Works Director, any bid bonds posted by the bidders be exonerated and
any checks or cash submitted for bid security be returned.
Pursuant to public Contract Code Section 4114, the Board DELEGATES Its functions under
Public Contract Code Sections 4107 and 4110 to the Public Works Director or his designee.
Pursuant to Section 6705 of the Labor Code, the Board also [DELEGATES to the Public Works
Director or to any registered civil or structural engineer designated by him the authority to accept
detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for
worker protection during trench excavating covered by that section.
DECLARE that, should the award of the contract to Carone & Company, Inc. be invalidated for
any reason, the Board would not in any event have awarded the contract to the second listed
bidder or any other bidder, but instead would have exercised its discretion to reject all of the bids
received. Nothing herein shall prevent the Board from reawarding the contract to another bidder
in cases where the successful bidder establishes a mistake, refuses to sign the contract or fails

III, REASONS FOR RECOMMENDATION/BACKGROUND:
The project is needed to mitigate shoulder erosion along Stene Valley Road.
The Public Works Director has filed with the Board of Supervisors the Plans and Specifications
for the project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project, have
been fled with the Clerk of the Board and copies will be made available to any interested party
upon request.
The Board reviewed and approved the project on May 12, 1996 and determined the project to be
exempt from the California Environmental Quality Act as a Mass 1 C Categorical Exemption. A
Notice of Exemption was filed with the County Clerk on May 13, 1998,
A Notice of Determination was filed with the County Clerk on May 13, 1996,
IV. CONSEQUENCES OF NEGATIVE ACTION:
If the project is not approved for advertising, it will not be constructed.

GENERAL CONSIDERATIONS:
1. Location:
The project Is located on two areas of Pinehurst Road.The first Is located approximately 0.55 mile
from the intersection of Pinehurst Road and Skyline Boulevard and the second Is located
approximately 0.75 mile from the same Intersection(Figures 1,2). Bath locations are near the
Cities of Orinda and Moraga In the antral County area,.
2. Project Description.
The project will mitigate roadway surface Wicking and settlement due to slope creep and/or
shallow sliding within the slope. At the 0.55 mile area,the concrete retaining wall will be extended
approximately 5.7 meters(19 feet)to the south. In this area a 3.1 rater(10 foot)aide by 10.7
meter(35 feet)hong area:of pavement will be reconstructed. At the 0.75 axile area,the existing
dmber posts on the wood retaining wail will be replaced with steel/concrete plies. The wall will be
extended 4.6 meters(15 feet)to the south. In this area a 3.1 meter(10 foot)wide by 4.6 meter
(15 foot)wide area of pavement will be reconstructed, Relocation of existing utilities and roadway
signs will not be necessary. All areas disturbed by the construction will be covered with straw
blankets and seeded with a mixt that will germinate In a shaded area. No tree removal will be
necessary.
