THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS in its capacity as governing Beard of the
County of Contra Costa and all districts of which it is ex-officio governing Board RESOLVES THAT:
1. In accordance with Section 211.1 of the County's Personnel Management Regulations, the following
named individual is appointed as Appeals officer effective May 5, 1999:
• Fred Golinveaux
Antioch, California
2. Mr. Golinveaux is a retired Fire Chief from a County Fire District and is very well qualified to consider
appeals in fire service promotional examinations.

Appointment of Appeals Officer
AGENDA BLURB:
ADOPT Resolution appointing Fred Golinveaux to the roster of Appeals Officers
as provided by Personnel Management Regulation Section 211.1 Appeals From
Decisions of the Director of Human Resources (Non-Cost Action)
• This action is at the request of the Director of Human Resources and will include
Fred Golinveaux; retired Fire Chief , Riverview Fire District, on the roster of Appeals
Officers who are empowered by the Personnel Management Regulations to resolve
appeals from the decision of the Director of Human Resources in certain situations.
• Chief Golinveaux has agreed to serve in this capacity for the purpose of providing
technical expertise in the resolution of appeals from written test items contained in
fire district promotional examinations. In recent such examinations, the County has
been criticized by fire district promotional candidates for the use of'lay persons
without adequate knowledge of fire science technology from the Appeals Officer
roster in the resolution of disputes as to the correctness of questions and their
answers.
• This selection of a fire professional for appointment to the Appeals Officer roster to
serve in this specific capacity has the recommendation of the Fire Chief and of the
Fire District Promotional Task Force. The appointment is pertinent to the
promotional examination for Fire Engineer which is now in progress and for which a
written examination is scheduled on April 24, 1999. The professional testing firm
which has conducted the job analysis and prepared the written examination for Fire
Engineer, as well as the District Subject Matter Experts who have reviewed all the
test questions, support the use of an expert Appeals Officer.
• This appointment has been discussed with IAFF Local 1230 which supports it.

The Contra Costa County Board of Supervisors RESOLVES THAT:
1. In accordance with Section 211.1 of the County's Personnel Management
Regulations, the following named individual is appointed as Appeals Officer
effective May 5, 1999:

(a) unlawful discrimination appeals or complaints,
(b) appeals from denial of flexibly staffed promotions.
211. DIRECTOR of PERSONNEL POWERS AND DITTIES. Except to the extent that the
power to make a decision is expressly conferred upon the Merit Board,. the
appointing authority, or an employee, and subject to the provisions of
Section 211.1, the Director of Personnel , or the Director's designee, shall make
determinations with respect to all matters expressed in these regulations.
211.1 Appeals from Decisions of the Director of Personnel . Employees may
appeal to the Appeals officer from decisions of the Director of Personnel in
promotional. examinations under the following regulations.
Section 404. Disqualification of Applicants
Section 513. Review, Audit, Protest and Appeals Procedures
Section 514. Review of Written Test Key
Section 515. Review of Written Test Paper
Section 516. Appeals from other Selection Procedures except ratings
received from promotional Qualifications Appraisal Boards
which may be appealed to an Examination Appeal Committee
as provided for in Regulation 517
Section 610. Removal of games from Lists
Appeals are limited to the grounds provided for in the above regulations.
Appeals must be in writing, and filed by appellant with the Director of
Personnel within five (5) business days of the mailing of the Director's
decision. No such appeal will be considered unless it contains specific
allegations of fact citing the exact cause and the relief requested. Decisions
of the Appeals officer as to examinations are limited to adjustments of any test
item or portion of the test which do not have the effect of setting aside the
test as a whole; awarding a passing score; or permitting the appellant to retake
the test. The Appeals officer must consider th, fairness of possible relief to
all the other competitors in the examination. The decision of the Appeals
Officer shall be final , and shall be transmitted by written report to the
Director of Personnel . The Appeals officer shall be appointed by the Board of
Supervisors.

21.2. MEETINGS OPEN To PUBLIC. All meetings and hearings shall be open to the
public, provided that the Merit Board may adjourn to executive session when
permitted by law.
21.3. RULES. The Merit Board may adopt such rules and procedures as may be
necessary to conduct its business.
214. MERIT BOARD SUBPENAS.
214.1 Sub ena Powerr and Policy.
(a) Pursuant and subject to Government Code Section 31110.2 and Section 10
of County Ordinance 80-47 the Merit Board subpena power shall be exercised as
set forth here.
(b) As used herein, unless the context otherwise requires, "subpena"
includes "subpena duces tecum". Where no contrary provision is made here, the
general practices of the courts concerning subpenas shall be a guide for the
form and issuance of subpenas.
