SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Receive this report concerning subject final settlement and payment from the Medical Liability
Trust Fund in the amount of$600,000, subject to the approval of the Superior Court in a Petition
for Approval of Minor's Compromise.
BACKGROUND/REASONS FOR RECOMMENDATION:
Gregory C. Harvey, defense counsel for the County, has advised the County Administrator that
within authorization an agreement has been reached settling the medical liability claim of Devin
Wilkes vs. Contra Costa County.
This Board's March 16, 1999 closed session vote was: Supervisors Gerber, DeSaulnier, Gioia,
and Uilkema, yes; Canciamilla, no.
This action is taken so that terms of this final settlement and the earlier March 16, 1999 closed
session vote of this Board authorizing its negotiated settlement are known publicly.

SUBJECT: Wilkes vs. County of Contra Costa
The liability case of Wilkes vs. County of Contra Costa has been scheduled for ratification in
open session on May 25, 1999. The Board has already approved settlement in closed. session.
As past of the settlement the County will be required to cut a check to purchase an annuity and
another check as part of the cash settlement. These payments are to be made not later than
June 1, 1999.
The purpose of this memorandum is to request that our office be notified at the earliest possible
time regarding receipt of the signed Board Order. Please call our office and arrangements will
be made to take the signed Board Order along with the payments request directly to the Office of
Auditor-Controller.
