Gilbert, Director of General Services Contra DATE May 25,19Crista Chun SUBJECT: SUBORDINATION,NONEDISTURBANCE AND ATTORNMENT AGREEMENT FOR 1026 OAK.GROVE ROAD, CONCORD SPECIFIC REQUESTS OR RECOMMENDATION(S)&BACKGROUND AND SUSTIFICATION 1. RECOMMENDATION APPROVE the Subordination, Nondisturbance and Attornment Agreement between the County, Spectrum Center for Educational and Behavioral Development, Inc. and U.S. Trust Company for the premises located at 1026 Oak Grove Road, Concord, and AUTHORIZE the Director of General Services to EXECUTE said Agreement on behalf of the County! 11. FINANCIAL IMPACT No financial impact. 111. REASONS FOR RECOMMENDATION/BACK-GROUND The ownership of 1026 Oak Grove Road, Concord, a facility which the County leases, has changed. The change in ownership does not affect the terms of the County's leasehold interest. However the mortgagee and new lessor require that the County sign a Subordination, Nondisturbance and Attornment Agreement. Under the terms of the lease, upon written request of any first mortgagee or first deed of trust beneficiary of the lessor, the County shall subordinate its rights to the lien of any first mortgage or deed of trust. However, as long as the County is not in default, the County's lease remains in effect.
