Attached please find the report covering the period through March 31, 1999. Section 3 the balance of the report is an appendix with financial data which is available for reference at the Clerk of the Board's office. The Treasurer's investment portfolio is in compliance with the Treasurer's current investment policy. The total investment pool equaled $1,272,604,574, on march 31, 1999. The fair value was $1,274,506,550, which was 100.1% of crest. The weighted average maturity of the total investment pool was 99 days. Over 93 percent of the portfolio or over $1,195 million will mature in less than a year. The County is able to meet its cash flow reeds for the next six months, The annual audit for the treasury oversight committee on the county treasury for the calendar year 1993 is in progress. All report information is unaudited but due diligence was utilized in its preparation. 2. There may be slight differences between the portfolios summary page and the attached exhibits and statements for investments managed by outside contractors or trustees. The variance is due to the timing difference in recording transactions accomplished by contracted parties during interim periods and later transmitted to the appropriate county agency and/or the Treasurer's Office. Act as Collateral Agent or acknowledge the appointment of a third party to act as Collateral Agent in the event the Prodder's credit ratings are downgraded, in accordance with the provisions of the Contract. j. Take actions specified in the Contract if any downgrade in the Provider's credit rating or event of default occurs. 4. The Provider will compensate the Trust Company for its services as Fiscal Agent and as Collateral Agent in accordance with the terms and conditions of the fee schedule attached hereto. S. '"he Guarantor waives notice of the acceptance of this Guarantee and of the Obligations, presentment, demand for payment, notice of dishonor and protest. 4. Expenses. The Guarantor agrees to pay on demand all fees and out of pocket expenses (including the reasonable fees and expenses of each Guaranteed Party's counsel) in any way relating to the enforcement or protection of the rights of each Guaranteed Party hereunder; provided, that the Guarantor shall not be liable for any expenses of a Guaranteed Party if no payment under this Guarantee is due. S. Subrogation. The Guarantor will not exercise any rights which it may acquire by way of subrogation until all the Obligations to each Guaranteed Party shall have been paid in full. Subject to the foregoing, upon payment of the Obligations, the Guarantor shall be subrogated to the rights of each Guaranteed party against the Company with respect to such Obligations, and each Guaranteed Party agrees to take at the Guarantor's expense such steps as the Guarantor may reasonably request to implement such subrogation. 6. No Waiver; Cumulative Rights. leo failure on the part of a Guaranteed Party to exercise, and no delay in exercising, any right, remedy or power hereunder shall operate as a wanner thereof, nor shall any single or partial exercise by a'Guaranteed Party of any right, remedy or power hereunder preclude any ether or future exercise of any right, remedy or power. Each and every right, remedy and power hereby granted to a Guaranteed Party or allowed it by law or ether agreement shall be cumulative and not exclusive of any other, and may be exercised by each Guaranteed Party at any time or from time to time. 7. Representations and Warranties.
