SUBJECT:ECT: Memorandum of Understanding between the Office of the Sheriff and the Contra Costa
Community College District Police Department per the Kristin Smart Safety Act of 1998
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION
Authorize the Office of the Sheriff to enter into a memorandum of understanding (MOU) with. the
Contra Costa. Community College District Police Department (CCCCDPD) regarding operational
responsibility for on campus law enforcement. The purpose of this MOU is to clarify agency
jurisdiction and response responsibility as required by the Knstin Smart Safety Act of 1998.
The site location addressed by this MOU is 3150 Crow Canyon Place, San Ramon, the Center for
Higher Education Campus of the Contra Costa Community College District(CCCCD). As a campus
of the CCCCD, it is under the primary law enforcement jurisdiction of the CCCCDPD.
Ey mutual agreement,the Office of the Sheriff,located in the City of San Ramon and operated as the
Saiz Ramon Police Department,may be called upon to assist the CCCCDPD in the handling of major
crimes, including, but not limited to, Part I violent crimes.
11. FINANCIAL IMPACT
None
The MOU stater, "In the event that the Office of the Sheriff assumes the responsibility of the
investigation,at the request of the College District Police Department,financial responsibility for the
investigation will continue to remain with the College District."

III. REASONS FOR RECOMMENDATION/BACKGROUND
The Kristin Smart Safety Act of 1998. the result of Senate Bill 1729, Chapter 284, Statutes of 1998,
rewires Community College Districts and local law enforcement to enter into a written agreement
relating to Fart I violent crimes that designates which law enforcement agency has operational
responsibility for the investigation of Part I violent crimes on District campuses. The agreement must
also delineate the specific geographical boundaries of each agency's operational responsibility.
The agreement must be made public and copies transmitted to the Legislative Analyst. The_I ristin
Smart Safetv Act of 1„998 reaffirms the Legislature's position that campus law enforcement agencies
have the primary authority for providing police or security services to their campuses.
By this MCU, the CCCCD will be fulfilling the requirement of the aforementioned act.
IV. CONSEQUENCES OF NEGATIVE ACTION
Education Cade Section 67381 (C) states that local law enforcement shall enter into written
agreements with campus law enforcement agencies ifthere are college or university campuses located
in the jurisdictions of the local law enforcement agencies.
Negative action would place the County in violation of the requirements of the law.
