OPEN the public hearing and receive testimony on the Carol Lane General Plan Amendment; 2. CLOSE the Public Hearing and concur that the Notice of Negative Declaration of Environmental Significance is adequate for consideration of this request; 3. APPROVE the Carol Lane General Plan Amendment as recommended by the East County Regional Planning Commission; 4. Include the adoption of this General Plan Amendment in the next consolidated General Plan Amendment. FISCAL IMPACT All staff costs for the General Plan Amendment are covered by a fee charged to the Public Works Department acting as the applicant. AND COUNTY ADMINISTRATOR PR\h:p ��p&.� to BY , DEPUTY Carol Lane General Plan Amendment May 18, 1999 Page 2 BACKGRQU lEA ONS FOR RECC3MMEND TANS The Contra Costa Public Works Department hes requested a General Plan Amendment to re-designate a site consisting of two parcels totaling 33,000 square feet in Oakley at Carol Mane and State Route 4 from Single Family Residential-High Density to Commercial. The two parcels front State Route 4 and are situated across from the Cypress Square Shopping Center in Oakley. The Carol Lane site is a remaining unused portion of right-of- way acquired by the Public Works Department to provide for improvements to State Route 4 in the Oakley area. The site is now considered as surplus and no longer necessary for public purposes. Given the small size of the site, less than one acre, there are relatively few policy implications with the re-designation. It can be considered more of a precising of the plan boundary than a significant shift in policy. The site is within all urban service districts that have an obligation to serve the site, and there will be no violations of growth management standards with the re-designation to Commercial use. If this site was redesignated for Commercial use; there is the potential to have the site developed concurrently with or as a part of a commercially designated area covering 3.93 acres to the north. This would provide an opportunity for an integrated development that would allow for a more efficient use of the land enabling the design of a commercial development with improved access to State Route 4, and a better site layout for internal circulation and parking. The East County Regional Planning Commission conducted a public hearing on this matter on April 5, 1999, and unanimously recommended approval of the General Plan Amendment to redesignate the site from Single Family Residential-High Density to Commercial use. Although there was no objection voiced at the April 5, 1999 public hearing, the Community Development Department did receive one letter from a nearby residence on Carol Lane objecting to the proposed General Plan Amendment (see attached as Exhibit "A"). RESOLUTION NO. 11-1999 RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING COMMISSION OF THE COUNTY OF CONTRA COSTA,STATE OF CALIFORNIA.,RECOMMENDING APPROVAL OF THE CAROL LANE GENERAL PLAN AMENDMENT(GPM 97-0012) WHEREAS, the Contra Costa County Public Works Department(Applicant)requested, an amendment to the County General Plan land use designation for a two parcel site(approximately 33,000 square feet)in the Oakley area at Carol Lane and State Route 4 from Single Family Residential-High Density to Commercial lana use category;and, WHEREAS, a Negative Declaration of Significant Ipa:cts for the proposed action to re- designate the land use category for the site from Single Family Residential-High Density to Commercial use was filed on March 11, 1999 in accordance with California Environmental Quality Act; and, WHEREAS, staff prepared a report recommending changes to the General Plan for the area and circulated it to interested agencies; and, WHEREAS, after notice was lawfully given, a public hearing was scheduled before the East County Regional Planning Commission on Monday, April 5, 1999 where all persons might appear and be heard;and, WHEREAS,on Monday, April 5, 1999,the:East County Regional Planning Commission having fully reviewed, considered, and evaluate all the testimony and evidence submitted in this matter; NOW, THEREFORE BE IT RESOLVED that the East County Regional Planning Commission recommends to the Board.of Supervisors of the County of Contra Costa, State of California, Approval of the Carol Lane General Pian Amendment as recommended by staff; and, BE IT FURTHER RESOLVED that all written and graphic material developed for and pertaining to these proceedings are made part of the record; and, BE IT FURTHER RESOLVED that the Secretary of the East County Regional Planning Commission shall respectively sign and attest the certified copy of this resolution and deliver the same to the Board of Supervisors all in accordance with the Planning Daws of the State of California, The instructions by the East County Regional Planning Commission to prepare this resolution were given by motion on the East County Regional Planning Commission on Monday, April 5, 1999, by the following vote: AYES: Commissioners-Wetzel,Dell,Hanson,Harper, and MacVittie NOES: Commissioners - ABSENT: Commissioners-Nunn and Sobalvarro ABSTAIN=: Commissioners- I,Catherine Kutsuris, Secretary of the East County Regional Planning Commission,hereby certify that the foregoing was duly called and approve on April 5, 1999 ATTEST: Catherine Kutsuris, Secretary East County Regional Planning Commission, County of Contra Costa, State of California RESOLUTION NO. 11-1999 THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA Adopted this Order on Tuesday,May 18, 1999, by the following votes AYES: ;SUPERVISORS GIOIA,UILKEMA, GERBER, DeSAULNIER and GANCIAMILLA NOES: DONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 99;307 SUBJECT: In the Matter of the Carol Lane ) General Plan Amendment ) County File#GP97-0012 ) The Board of Supervisors of Contra.Costs.County RESOLVES that: There is filed with this Board and its Clerk a copy of Resolution No. 11-1999 adopted by the East County Regional Planning Commission which discusses the Carol Lane General Plan Amendment (County File#GP97-0012). Can Tuesday, May 18, 1999, the Board APPROVED the General Plan Amendment and directed staff to include the Carel Lane General Plan Amendment into the second consolidation General Plan Amendment for 1999 as allowed by State Planning Law.
