RECOMMENDED ACTION: AWARD the contract for furnishing labor and materials for the subject project to California Pavement Maintenance Company, Inc, the low bidder, in the amount of$837,509.20 and at the unit prices submitted; and REQUIRE the contractor to present surety bonds for Payment and Faithful Performance in the amounts of$337,509.20 and $337,509.20, respectively. DIRECT the Public Works Director to prepare the contract for the project. RECOMMENDED ACTION: (continued) DIRECT that, in accordance with the project specifications and/or upon the execution of the contract by the Public Warks Director, any bid bonds posted by the bidders be exonerated and any checks or cash submitted for bid security be returned. Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Sections 4107 and 4110 to the Public Works Director or his designee. Pursuant to Section 6705 of the Labor Code, the Board also DELEGATES to the Public Works Director or to any registered civil or structural engineer designated by him the authority to accept detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for worker protection during trench excavating covered by that section. DECLARE that, should the award of the contract to California Pavement Maintenance Company, Inc. be invalidated for any reason, the Board would not in any event have awarded the contract to the second listed bidder or any other bidder, but instead would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in cases where the successful bidder establishes a mistake, refuses to sign the contract or fails to furnish required bonds or insurance (see Public Contract Code Sections 5100-5107). If. FINANCIAL IMPACT: The project, including engineering and appropriate overhead charges, is funded by Road Maintenance Funds (100%). III. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The plans and specifications were approved and the project advertised for bids by the Board of Supervisors on April 6, 1999. The bids were received and opened at 255 Glacier Drive, Martinez, California, on Tuesday, May 11, 1999. The construction bids received were as follows: 1. Construction activities are expected to begin in late May and is due to expire on October 1, 1999. The construction managment services include construction engineering, project managment and construction inspection, Harris and Associates, Inc, was awarded the contract from a field of ten consulting firms. IV. Consequences of Negative Action: If the Consultant Services Agreement with Harris and Associates, Inc, is not approved, it may not be possible to complete construction of the approved project. It is needed in order to improve traffic flow through the intersection of Lone Tree Way and Fairview Avenue. The project has been determined to be in compliance with the General Plan and is exempt from CEQA because it consists of the minor alteration of existing facilities and will not result in the removal of any scenic resource. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of design and construction and may jeopardize funding. The project will affect approximately 125 meters (410 ft) of Lone Tree Way. Along Fairview Avenue the widening will taper to the existing road over approximately 30 meters (88.4 ft). The existing traffic signal system will require relocation as well as joint utility poles, two roadside signs, two mailboxes and roadside delineators. Three existing drainage inlets will require relocation and re-excavation of their associated drainage ditches. 3.
