ENVIRONMENTAL REVIEW PROCESS FOR THE INDUSTRIAL SAFETY ORDINANCE BY THE COUNTY AND THE CITY OF RICHMOND SPECIFIC REQUESTS)Oft RECOMMENDATION(S)A SACKGROUND AND JUSTIFICATION Recommendation. It is recommended that the Sward discuss moving forward in coordination with the City of Richmond in the environmental review process to consider the Industrial Safety Ordinance (ISO) and any potential amendments, and to direct County staff to prepare a timeline for the environmental review and report back to the Board within two weeks. Background: As the result of the settlement of the CSE and Contra Costa County lawsuit, the County will be going through the CEQA environmental review process of the Industrial Safety Ordinance (ISO). During that process, the County will be required to consider certain potential changes to the ISO and may consider any other amendments it believes are appropriate. In addition, the City of Richmond passed a resolution on March 30, 1999, directing their staff to meet with County representatives "to explore a coordinated review of the ISO and possible amendments to it with the ultimate goal of adopting the ISO (including any amendments during the environmental review process)." In the course of the environmental review, the existing ISO remains in full force and effect in the unincorporated areas of the County. Coordinating the environmental review of the ISO with the City of Richmond presents an opportunity to have a consistent set of gui lines governing all refineries in the County. (1) regulatory requirements alone will not guarantee public health and safety, (2)that the public is a key stakeholder in chemical accident prevention, preparedness, and response at the local level, (3)preventing accidental releases of regulated substances is the shared responsibility of industry, government and the public,(4)the first steps toward accident prevention are identifying the risks, and(5)once information about chemical hazards in the community is openly shared, industry,government and the community can work together towards reducing the risk to public health and safety; and, WHEREAS, the success of a safety program is dependent on the cooperation of industrial, chemical and oil refining facilities and the public must be assured that measures necessary to prevent incidents are being implemented, including changes or actions required by regulatory agencies necessary to comply with applicable regulations; and, WHEREAS,Contra Costa County will soon be starting the environmental review process under the California Environmental Quality Act(CEQA)to review the Contra Costa County Industrial Safety Ordinance [Ordinance 98-48] and consider proposed amendments to the ordinance, WHEREAS, starting this environmental review process presents the City and Contra Costa County a unique opportunity to coordinate their efforts in achieving strengthened oversight and safety regulation of industrial facilities; WHEREAS,The Chevron Richmond refinery is the only refinery in Contra Costa County not governed by the Contra Costa County Industrial Safety Ordinance.. NOW, THEREFORE BE IT RESOLVED,that the City Council of the City of Richmond directs the City Manager,Planning Director and City Attorney to meet with Contra Costa County representatives(County Administrator,County Counsel, Community Development Director and County Supervisor John Gioia)to explore a coordinated environmental review of the Industrial Safety Ordinance ("ISO")and possible amendments to it with the ultimate goal of adopting the ISO(including any amendments during the environmental review process)and contracting with the County Health Department as the enforcement authority under the direction of the City Council for Chapter 450-8 (Risk Management)of the ISO.
