BARRY, AICP County COMMUNITY DEVELOPMENT DIRECTOR DATE: April 6, 1999 SUBJECT: ORDINANCE MODIFICATION RELATING TO THE MEASUREMENT OF STRUCTURE SETBACKS FROM THE EASEMENT LINES ON PRIVATE ROADS. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1, Find that the adoption of the Ordinance is exempt from the provisions of the CEQA pursuant to the CEQA Guidelines, Section 15061(b)(3) as there is no possibility that this activity could have a significant adverse effect on the environment. 2. Introduce the Ordinance, waive reading and Fix April 20, 1999 for adoption. Ordinance 99-12 FISCAL IMPACT- The staff costs to date exceed 10,000.00. The estimated cost to prepare the ordinance code for Board approval is $2000.00 if the code modification is applied countywide. BACKtROUN©/REASONS FOR RECOMMENDATIONS On February 9, 1999, the Board of Supervisors heard the recommendation of Planning Commission and directed staff to prepare the modifications to § 82-4.244 (c)to measure primary and secondary setbacks from the easement lines of private roads for lots less than 40,000 square feet in size. The area for the private road would still be include as part of the net acreage calculations. Staff has reviewed the proposed ordinance and determined that it is exempt from the California Environmental Quality Act because it can be seen with certainty that there is no possibility that this activity could have a significant adverse environmental effect. r 41 --1� CONTINUED ON ATTACHMENT. C. § 25120] SECTION 1. 'V M- AEYY. This ordinance amends Section 82-4.244 of the County Ordinance Code to provide that for lots less than 40,000 square feet in size on private roads, the measurement of primary and secondary front yard setbacks shall be taken from the easement lines of such private roads. This amendment would be enacted Countywide. [§25129]. SECTION II. Section 82-4.244 of the County Ordinance Code is amended to read: 82-4.244 Lot Definition, dimensions, area,private road structure setbacks. (a) Defined. "Lot"means a piece,parcel, tract, or division of land, including one delineated or described as a single integral unit on a subdivision map, and two or more considered as one pursuant to Section 82-10.002(c). (b) Lawful Lot. To qualify as a building site, a lot shall have the minimum dimensions required therefor by Divisions 82 and 84 for the district where it is situated. (c) Right-of-Way Excluded. No part, nor all, of a lot within a public road, street, highway, right-of-way, or easement, for vehicles or pedestrians, existing or proposed, shall be used to satisfy minimum area,yard, dimensional or coverage requirements. (d) For lots less than 40,000 square feet in size on private roads, for purposes of measuring primary and secondary front yard setbacks, such setbacks shall be measured from the edge of the easement line of the private road abutting such lot or, if there is no recorded easement, then, from the abutting edge of such private road established by use. (a) The employment and human services department director is excluded and is appointed by the board of supervisors. (b)The assistant county social service director-exempt is excluded and is appointed by the employment and human services department director. (c) The workforce investment board executive director and the workforce services director are exempt and are appointed by the employment and human services department director. The employment and human services department director is the statutory county welfare director. (Ord. 99-13 , Ords. 97-35, § 1, 94-52 § 1, 87-17 § 2, Gov. Code § 19800, Cal.Code Regs., tit. 2, § 17200.) SECTION II: EFFECTIVE DATE. Re: Ordinance Exempting Workforce Investment Board Executive Director, Workforce f ,y Services Director from the Merit System t' Attached is the original of the ordinance changing the title of the Social Service Director and exempting the Workforce Investment Board Executive Director and Workforce Services Director from the Merit System. It is ready to be placed on the Board agenda for adoption. Regardless of when the Board of Supervisors approves the P300, the ordinance will not be effective until mid-May and the new positions cannot be filled as non-Merit System positions until that time.
