The Public Works Director has recommended that this Board execute an extension of the deadline of a Deferred Improvement Agreement with Ronnee Ann Hiles,Heidi Praw and Carlo and Frances Zocchi, as provided in the original Deferred Improvement Agreement approved by this Board on January 15, 1985, and recorded in Book 12196,Page 268 of the Official County Records. This Board Order extends the deferment of construction of permanent improvements along Flora Street, Walnut Creek area, and as otherwise called for in the original agreement, until a date no later than 30 calendar days prior to the first sale of an individual condominium unit in Subdivision 5775 (as opposed to a sale of the entire subdivision project). This approval modifies Land Use Permit 103-70 for the Flora Apartment Complex to permit conversion to condominiums. Approval is based on the revised plans received by the Planning Department can May 6, 1980, for 98 units. 2. This subdivision shall conform to the provisions of Title 9 of the Contra Costa County Ordinance Cade. Any exceptions therefrom must be specifically listed in this conditional approval statement. 3. Replace uneven sections of existing sidewalk that create a tripping hazard for pedestrians. 4. Comply with Section 66427.1 of the Subdivision Map Act. 5. Prior to recording the final reap, submit documentation pertaining to Growth Equities senior citizen 3 year lease offer, including special notification of such tenants, copy of lease, listing of tenants and whether such lease is desired. 6. Articles of Incorporation, By-Laws, and Covenants, Conditions and Restrictions shall be submitted to the Planning Department prior to recording the final subdivision map. The Covenants, Conditions and Restrictions shall provide for ownership and main- tenance of all project improvements. 7. The condominium owners are responsible for maintaining the existing underground telephone conduit distribution system serving the project. 8. The following language shall be included in the Covenants, Conditions and Restric- tions to adequately protect telephone service within the condominiums: "The Pacific Telephone and Telegraph Company shall be authorized to enter any portions of the units whenever restoration of any telephone service requires such entry. "The Pacific Telephone and Telegraph Company shall have the right to install, move, remove, or run new lines in or on. any portion of the common area, including the interior and exterior of the units as is necessary to maintain telephone service within the subdivision in the Pacific Telephone and Telegraph Company's reasonable discretion.. This provision may not be amended, or terminated without the consent of the Pacific Telephone and Telegraph Company, as long as the subdivision remains a condominium." 9. The Covenants, Conditions and Restrictions shall prohibit parking or storage of recreational vehicles, mobile homes, boats or similar vehicles within the develop- ment. 10. All portable fire extinguishers and other fire protective appliances (fire alarm system) shall be retained in an operable condition at all times. The fire alarm system shall be extended to serve the entire project. The ennunciator panel in the present manager's office may be removed prion to sale of the unit. 13. Each living unit, the hallways, and the laundry shall be provided with fire district approved smoke detectors. The detectors shall be mounted on the ceiling at a point centrally located in the corridor or area giving access to rooms used for sleeping purposes. 14. If battery operated smoke detectors are installed in the apartment units, the Covenants„ Conditions and Restrictions for the project shall provide for a home- owners' association program for testing semiannually and battery replacement not less than annually. 15. The homeowners' association shall be provided with plans for the project which shall include locations of all utilities. 16. Mass doors in the halls of the main building accessing the courtyard shall be modified to allow their use by the residents to enter or exit the complex. The doors may be modified to be self-closing or the project secured by locking gates at the access points to the courtyard from the parking areas or security gates to the parking areas may be utilized. 17. All outside doors shall be fitted with panic hardware. 18. Solid wood fencing shall be continued eastward to match existing along the north boundary to screen the project from the P.C.& E. corporation yard, or an alternate as reviewed and approved by the Planning Department. 19. Refuse areas shall be located in permanent enclosures. Location and plans for the enclosures shall be subject to Planning Department review prior to issuance of a building permit. 20. Each unit shall have at least 200 cubic feet of enclosed weather-proofed and lockable private storage space in addition to guest, linen, pantry and clothes closets customarily provided. Such space may be provided in any location approved by the Planning Department, but shall not be divided into two or more locations. If the subdivider can demonstrate that this standard cannot or should not reasonably be met, the size of the storage space may be modified by the Planning Department. 21. The drainage ditch along the north portion of the east boundary shall be cleaned of dirt and debris. 22. Prior to filing the final subdivision map, the space between the south parking area and the units shall be stuodle-' for upgrading. The parking stalls shall be screened with a landscape or structural barrier. Consideration should be given to increasing the private yard areas of the ground floor units. 23. Prior to filing a. final subdivision map all buildings, fences, sidewalks, driveways, landscaping, etc., shall be repaired, refurbished and/or renovated to enhance the project's appearance and utility. Prior to installation or filing of the final map plans shall be submitted for review and approval by the Planning Department for the changes, improvements, and upgrading of the project as required by these conditions and as recommended by a landscape architect or architect to improve the project's appearance and utility. The irrigation system shalt be inspected by a landscape architect for adequacy and areas of dificient landscaping upgraded. 25. The household of each unit renting at the time of tentative snap approval and not electing to purchase their unit when offered for sale, .shall be provided with a moving expense allowance equal to 1.501 percent of one month's rent for that unit and shall be provided with 60 days notice of the actual moving date.
