SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Consider adopting positions for the following transportation related legislation introduced for the 1999
State Legislative session:
SQRT
AB 1 166 (Frusetta-R) Extends the "safety enhancement - double fine zones" for traffic
violations through 2010.
SB 225 (Rainey-R) Codifies the definition of "consistency" with the General Plan
that is now recommended to local jurisdictions by the State
Office of Planning & Research guidelines.
SB 826 (Sher-D) Expands eligible uses for TFCA funds and repeals sunset date for
"FCA eligibility for bicycle facility improvements.

S9 65 (Murray-D) Establishes funding programs for pilot transportation project to
assist person receiving aid under the CALWORKS program to
obtain sustainable employment.

• AS 8036 (Keeley-D) Removes authority of public agencies to set appropriate amount
of retention and limits retention to 5% on public works projects.
a SR 153 (Haynes®R) Enacts the Property Owner Rights Act of 1999. It requires public
agencies to minimize actions that may impair use of private
property, and requires public agencies to conduct a private
property taking impact analysis prior to any action that would
impair use of private property.

11ACKORDUNDIREASONSLEOR RECOMMENDATIONS
The Transportation, Water, and Infrastructure (TW&I) Committee has been tracking transportation related
legislation introduced for the 1999 session of the State Legislature. At the April 19, 1999 meeting of the
TW&I Committee, staff provided the committee with a status report on several transportation related bills
pending before the State Legislature, The TW&I Committee accepted the status report and recommends
to the board of Supervisors the following recommended positions on several selected bills. Listed below
are summary descriptions of the selected bills with the TW&I Committee's recommendation:
AB 11 M lF rs 1a-; €u ways fa'tx.-Ett nc11= Double e ine Zones-Existing law established a pilot
project, until Year 2000, to identify and designate certain highway segments as "safety enhancement-
double fine zones" and impose increased (doubled) fines for traffic violations in those zones. AS 1166
would extend the date of the safety enhancement double fine zones for another ten years to 2010.
TW&I Committee recommendation 4/15/99: SUPPORT position. This bill would continue double
find enforcement for traffic violations on the section of Route 4 West through Franklin Canyon.
This bill provides that under the Planning and
Zoning Law an action, program, or project is consistent with General Flan, if, considering all its aspects,
it will further the objectives and policies of the General Plan and not obstruct their intent. This bill codifies
the definition of "consistency" with the General Plan that has been recommended in General Plan
guidelines issued by the State Office of Planning and Research.
TIN&€ Committee recommendation 4/15/99: SUPPORT position. This bill is supported by legal
experts, planning organ%nation,, and numerous jurisdictions.

Transportation Fund For Clean Air (TFCA) funds to zero emission vehicles (electric), telecommuting
projects, and incentive programs for "Smart Growth" development. This bill would also repeal the 2031
sunset date on authorization to fund bicycle facility improvements to continue indefinitely.
TW&I Committee recommendation}4115/99: SUPPORT position. TFCA has been a useful program
In Contra Costa County funcring a variety of projects and programs, including bicycle facilities. The bill
would extend and expand the list of allowable funcring to desirable categories of projects and programs
that would be beneficial to Contra Costa County residents,

introduced last year (AB2454) that would establish funding programs for pilot transportation projects to
assist persons receiving aid under the Calworks program to obtain sustainable employment,
TW&I Committee recommendation 4/15/99: SUPPORT position funqualifiedl. The Board of
Supervisors had previously adopted a SUPPORT with Amendments position on 2123199. Several
recent amendments to the bill have addressed the County's concerns, and the committee now
recommends an unqualified SUPPORT position on this bill.
AS 80 Celgy-D)Flublic Works Admip— CDatM=-This bill removes the authority of public entities to
decide the amount of appropriate retention on contracts, and would specifically limit retention of funds on
a public works contract to 5%.
TW&I Committee recommendation 4115/99: OPPOSE position. This contractor industry-sponsored
bill would undermine a long established and commonly used procedure by public entities for
contracts on Public Works projects.
- This bill would enact the Property
Owners Rights Act of 1999, which would require public agencies to minimize the number of actions that
may significantly impair the use of private property. This bill would require every public agency to conduct
a private property taking impact analysis prior to taking any action that may significantly impair use of
private property.
TW&I Committee recommendation 4/15/99: OPPOSE position. This bill would establish a new
procedural mandate for public agencies that essentially already exists in law through recent Court
rulings (i.e. Nollan and Dolan cased.
