BACKGROUND: The Central Contra Costa Transit Authority (CCCTA) has advised the County that Supervisor Uilkema's term of office on their Board of Directors expires May 1, 1999. The Transit Authority asks that the Board of Supervisors take action to appoint a director for a new two year term. Supervisor Uilkema has indicated she would like to continue to serve on CCCTA's Board of Directors and I am, therefore, recommending that the Board reappoint her for a new two year term. Rice enclosures AB 260: BROWN GIVES NEEDLE EXCHANGE ANOTHER SHOT by Jim Rice After seeing similar legislation vetoed by Governor Wilson last year, Assembly Speaker Willie Brown hes introduced another bill authorizing local government agencies to establish needle exchange pilot programs. Assembly gill (AB) 260 would establish the Glean Needle and Syringe Exchange Pilot Project, which would allow pharmacists, physicians, and other persons authorized under the project to furnish needles and syringes without a prescription, within the project guidelines. Governor Wilson explained his decision to veto last year's bill by citing a report from the Office of National Drug Control Policy which concluded that"distributing needles facilitates drug use and undercuts the credibility of society's message that using drugs is illegal and morally wrong...and there is no conclusive evidence that exchange programs reduce the spread of AIDS." Wilson added that "I am concerned that a so-called pilot project legalizing needle exchange would make of that community a magnet for IV drug users...(and) might actually increase the hazard of infection in the pilot community and throughout California, were I to sign the bill." Although we all know that statistics can be found to support virtually any position, in this case the preponderance of evidence appears to contradict Wilson's statements. There is a growing body of evidence that needle exchange programs, when properly administered, do avert new cases of HIV infection. A recent article in U.S. News & World Report examined needle exchange programs presently operating in New Fork City and New Haven, Conn., and concluded that the programs were working. According to the article, the New Haven experience is the most convincing. A team of researchers from Yale has been studying the city's needle exchange program, launched in 1990. The Yale researchers have thus far observed that the share of returned needles testing positive for HIV has dropped sharply; addicts are holding on to needles for a shorter time, suggesting that they are sharing them less; and there has been an estimated drop of at least 33 percent in the rate of new HIV infections among IV drug users. In New York, previously underground exchange programs were legalized last year, after Mayor Dinkins dropped his previous resistance. Early indications point to success: Needle sharing has declined, referrals to treatment are up, and there has been no - 2 - evidence that the programs have attracted new drug users. Results similar to those seen in New York and New Haven have been observed with numerous other exchange programs, both in the U.S. and abroad. In fact, a recent article in the highly respected Annals of the American Academy of Political and Social Science noted that "programs to increase the use of sterile injection equipment by intravenous drug users appear to have almost universally achieved their desired effect of reducing AIDS risk behavior....The consistency of the reported results in reducing AIMS risk behavior is quite striking." Opposition to needle exchange programs is strongest among many religious leaders and conservative politicians (witness last year's party-line vote in the California Legislature on the bill ultimately vetoed by Gov. Wilson), Many opponents of needle exchange programs seem to base their position more on idealogy or personal opinion than on objective evidence. Indeed, President Bush ignored the recommendations of his own National Commission on AIDS last year when he extended a ban on federal funding for exchange projects. In recognition of potential opposition to the concept of government-sanctioned needle exchange programs, the tent of the AB 260 states that "scientific data from needle exchange programs in the U.S. and in Europe have shown that the exchange of used hypodermic needles and syringes for clean hypodermic needles and syringes does not increase drug use in the population, can serve as an important bridge to treatment and recovery from drug abuse, and can curtail the spread of human immunodeficiency virus (HIV) infection among the intravenous drug user population." In an attempt to further diffuse arguments that such programs will encourage drug use,the bill also stipulates that the needle exchanges will be on a strictly "one-for-one" basis. It is vital that Gov. Wilson and other policy makers be made aware of the truth about the efficacy of needle exchange programs, and be convinced of the importance of not allowing their personal feelings of distaste to blind them to the lifesaving potential of this legislation.
