HomeMy WebLinkAboutMINUTES - 04201999 - C25 THE BOARD OF SUPERVISORS, CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 20, 1999, by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, GERBER, DESALINIER, AND CANCIAMILLA NOES. NONE ASSENT. NONE SUBJECT: Litigation Authority, County of Sonoma v. Commission on State Mandates, et al., Sonoma Sup. Ct. No. SCD221243 WHEREAS, Contra Costa County previously joined with forty-seven other counties to petition the Commission on State mandates concerning prior years' taking of local property tax proceeds as part of the "ERAF legislation"; and WHEREAS, the Commission on State Mandates has now denied all of these forty-eight counties (including Contra Costa) applications and if this matter is to be brought to the attention of the courts, action must now be initiated; and WHEREAS, Contra Costa County has been asked to intervene and join the above-subject action which has been filed by Sonoma County concerning the Commission's denial of county claims and that the County provide some financial assistance for this pending litigation; and WHEREAS, intervention and financial assistance has been recommended; and NOW, therefore it is by the Board ORDERED that: 1. Authorization is hereby approved for Contra Costa County's "Ex parte Application for Leave to Intervene" in the above-subject pending action. 2. County Counsel is further authorized to execute on behalf of the County and provide for filing in the above-noted action the "Ex Parte Application For Leave To Intervene" and the execution on behalf of Contra Costa County of the involved "Complaint In Intervention". 3. The sum of$4,200 is hereby approved to assist Sonoma County with its incurred or yet to be incurred costs for the lead handling of the above-noted litigation. 4. The County Administrator is hereby authorized to pay the above noted sum when he deems it appropriate to the Sonoma County Counsel's office from any available county funds.
