SPECIFIC REQUEST(S)rR RECOMMENDATION(S)7 BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the Chief Engineer of the Contra Costa County Flood Control and,Water Conservation District to vote and sign the ballot received to levy a CSA L-100 Lighting District annual assessment upon parcels in Subdivision 8145. 11. Financial Impact- There will be no financial impact to the County General Fund. All costs will be covered with revenue from the Countywide Street Light District, CSA L-100. DATE: APRIL 20, 1999 PAGE: -2- 111. Reasons for Recommendations and Background: On September 1. 1998, the Board of Supervisors approved the conditions for the development of Subdivision 8145 consisting of two (2) parcels. The developer is required by the Condition of Approval to install street lighting fixtures and annex to the County's street light program, CSA L-100, for continued maintenance and operation of those fixtures. Proposition 218 provides that any new assessment must be approved by a majority of the property owners voting on the proposed assessment. Both parcels are currently in the process of being sold to the developer(De Nova Homes) of Subdivision 8145. Current ownership of APNI 148-291-022 is Oscar Otterbeck and of APN 148-110-XXX is Contra Costa County Flood Control and Water Conservation District. On February 16, 1999,the applicant for the Development submitted a request to the Department of Public Works for inclusion of the Development into CSA L-100. On March 16, 1999, the Board of Supervisors adopted Resolution No.99/111 directing the filing of the engineer's report for street light charges for CSA L-100. As directed by the Board,the Engineer of Work filed the engineer's report. On March 16, 1999,the Board adopted Resolution No. 99/1 declaring the Board's intention to levy and collect street light charges to operate and maintain facilities and services within CSA L-100 for fiscal year 199900 and setting a public hearing for May 11, 1999. Resolution No. 99/_UL directed the Engineer of work (Public Works Director)to cause to be mailed to the property owners within Subdivision 8145 the notices and ballots required by Section 4 of Article X111 D of the California Constitution(Proposition 218). The notices and ballots were mailed to the property owners. This Board Order will facilitate the actions necessary to comply with the requirements under Proposition 218 and the Conditions of Approval for Subdivision 8145. IV. ConsMuences of Negative Action: This project will not be in compliance with the Conditions of Approval for Subdivision 8145, and an alternative means to finance public right away street lighting would have to be found.
