SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
ACCEPT the report from the Cable TV Administrator on cable television license
extension issues.
ADOPT the attached resolution extending the Cable TV License for Ponderosa
Cable Systems, Ltd. to August 31, 2009.

BACKGROUND:
The County has been extending cable television licenses for both Ponderosa and
TCl systems for the past year in order to review the systems for compliance.
Ponderosa Cable Systems has had several technical problems identified and staff
has been working with them to resolve these concerns before renewing their license.

In addition, staff has been working with the following jurisdictions (Cities of Antioch,
Clayton, Concord, Danville, Lafayette, Martinez, Moraga, Orinda, Pleasant Hill,
Richmond and Walnut Creek) on the development and review of a new
Telecommunications Ordinance, the conducting of a needs assessment and
developing a negotiating strategy for renewals. This collaborative effort is
anticipated to benefit all jurisdictions in renewals with the cable systems.
Staff anticipates bringing to the ward in the next month a contract request to
proceed with the above efforts. The needs assessment alone will take
approximately three to six months to complete as it involves focus groups and a
telephone survey. Needs assessments are used to support jurisdictions proposals
for additional cable services daring renewals in accordance with the
Telecommunication Act of 1996.
By extending lenses until this study is completed, the County will have valid
information with respect to the needs and interests of its citizens. In addition, some
cities have extended their licenses to August 31, 29039 and the County would then
be in a position to negotiate with these cities for renewals. This could increase the
County, s negotiating position and provide cost savings in the event a consultant
was needed to finalize negotiations.
Ponderosa has agreed to the above extension and will continue to work with the
County to meet the current cable license requirements.

to Ponderosa Cade Systems,Ltd. )
WHEREAS on July 6, 1982 , the Beard granted non-exclusive licenses to Ponderosa Cable
Systems,Ltd.to construct,operate and maintain a cable television system in specified unincorporated portions
of Contra Costa.County in accordance with Division 58 of the County Ordinance Code(Ordinance No.82-28);
and
WHEREAS the above described license expires on January 31, 1999; and
WHEREAS the licensee desires to renew its license; and
WHEREAS the County has requested additional information from Ponderosa in order to
complete its review and additional time will be needed for a consultant to review the information before staff
can make a recommendation to the Board of Supervisors; and
WHEREAS in the County's review of the information provided and the customer survey,certain
concerns about the system's compliance with.FCC technical standards and future management of the cable
system have been identified and are currently being addressed by Ponderosa; and
WHEREAS Ponderosa has agreed to provide the County with additional information regarding
the system's technical and operational stability needed for its completion of the review;and
WHEREAS the County and the Licensees desire to extend the above-described licenses to
facilitate completion of the review beyond the extension date of April 30,1999; and
NOW THEREFORE,BE IT RESOLVED that the above-described licenses are extended to and
including August 31, 2000.
BE, IT FURTHER RESOLVED that this extension. is ,granted contingent on Ponderosa's
compliance with the Cable Television Ordinance(Ord.No. 93-55) and in accordance with all the consistent
terms and conditions specified on the current license award resolution.
