C1 ATIO 1. ADOPT a resolution approving the first consolidated General Plan Amendment for 1999. 2. DIRECT the Community Development Department to file the Notice of Determination for the Willow Avenue General Plan Amendment and to file the Notice of Exemption for the Whyte Park General Plan Amendment. FISCAL IMPACT: None BACKGROUND/REAS0NS FOR RECOMMENDA]EQNa: California Planning Law provides that each General Plan Element mandated by the State cannot be amended more than four times in the calendar year 1999. The Board of Supervisors considered the Willow Avenue General Plan Amendment at the February 9, 1999 meeting. The Whyte Park general Flan Amendment was considered at the March 16, 1999 meeting. On Tuesday, February 9,1999, the Board held a public hearing on said General Plan Amendment discussed by the Contra Costa County Planning Commission,Resolution No. 15-1998. Notice of said hearing was duly given in the manner required by law. The:Board at a hearing, called for testimony of all persons interested in this matter. On Tuesday, February 9, 1999, the Board APPROVER the General Plan.Amendment and directed staff to include the Willow Avenue General Plan Amendment, and text changes as attached, into the first consolidated General Plan Amendment for 1999 as allowed by State Planning Law. It amends the Land Use Element Map for the approximately Seven Acre area from Commercial to Multiple Family Residential Low Density as shown on Map A. 2. It modifies policy 3-184 to read; MThe property south of 7th Street along the east side of Willow Avenue up to Hawthorne Drive, is designated Multiple Family Residential Low Density. As maximum of 58 dwelling units shall be allowed within the plan amendment area. Development shall be for detached Single family residences. The project design will open up to the Rodeo Creep Trail in several locations and will be landscaped compatible with the adjacent public right-of-way. The site between Hawthorne and 7th Street must be developed as an integrated unit. The land from Hawthorne Drive to 1-80 retains a Commercial designation." 3. Deletes existing policy 3-185 and renumbers existing policy 3-195 to policy 3- 185. 4. Amends the Bicycle Trails Map to reflect the Rodeo Creep Trail existing location as Shown on Map B. 5. Amends the Hiking Trails Map to reflect the Rodeo Creek Trail as shown on Map C. Contra Costa County is carrying out a program to systematically review the County General Plan for the purposes of keeping the Plan current and maintaining consistency with the County's development ordinance. California Planning Law provides that each General Plan Element mandated by the State cannot be amended more than four times In the calendar year 1999 The Board has considered the proposals described in Parts ll and III below to amend the County General Plan and at public hearings declared its intent and directed staff to prepare this resolution for adoption. The Board therefore declares that adoption actions described below are to constitute its first amendment affecting the Land Use Element and the Open Space Element. Part It - Rodeo Area. A copy of Resolution No.15-1998 adopted by the Contra Costa County Planning Commission is on file with this Board in which the Commission sets forth its report on the proposed plan amendment recommending approval of the Willow Avenue General Plan Amendment. The Board of Supervisors has determined to approve this Plan amendment as described in the Board's subsequent Resolution No. 99/136. The Board hereby adopts the amendment to the County General Plan for the Rodeo area as specified in the Board Resolution No. 99/136 as part of this first amendment to the County General Plan, including the filed Plan map which was prepared by the Community Development Department. A copy of the Plan map reflecting this amendment, on file in the office of the Clerk of the Board, shall be endorsed-approved by the Clerk. Part III - Walnut Creek Area. A copy of Resolution No,14-1998 adopted by the Contra Costa County Planning Commission is on file with this Board in which the Commission sets forth its report on the proposed plan amendment recommending approval of the Whyte Park General Plan Amendment. The Board of Supervisors has determined to approve this Plan amendment as described in the Board's subsequent Resolution No. 99/117. The Board hereby adopts the amendment to the County General Plan for the Walnut Creek area as specified in the Board Resolution No. 99/117 as part of this first amendment to the County General Plan, including the filed Plan map which was prepared by the Community Development Department. A copy of the Plan map reflecting this amendment, on file in the office of the Clerk of the Board, shall be endorsed-approved by the Clerk.
