Designated Employees ) Resolution No. 98-3.
The Lamorinda School Bus Transportation Agency is required to enact a Conflict of
Interest Code,under Government Code section 87300; and
The regulations of the Fair Political Practices Commission (Title 2, Division 6, California
Code of Regulations), section 18730, authorizes the adoption of the Conflict of Interest Code by
incorporating section 18730 by reference and designating the employees and disclosure categories
to which the code applies.
The adoption of a Conflict of Interest Code by the Lamorinda School Bus Transportation
Agency is not effective until it is approved by the Contra Costa County Board of Supervisors,
which acts as the code reviewing body.
On September 15 , 1998, the Lamorinda School Bus Transportation Agency held a
public hearing to consider approval of the proposed Conflict of Interest Code.
NOW, THEREFOA , the Lamorinda School Bus Transportation Agency resolves as
follows:
I. APPROVAL AND AMETION OF CONFLICT OF INTEREST CODE
The proposed Conflict of Interest Code set forth in this Resolution is approved for
the Lamorinda School Bus Transportation Agency. Upon approval of the code-reviewing
body, it shall be deemed adopted and promulgated.

The terms of Section 18730 of Title 2, Division 6 of the California Code of
Regulations as it now reads or may hereafter be amended by the Fair Political Practices
Commission to conform to the Political Reform Act are incorporated by reference.
A copy of Section 18730 as it reads on the date of this Resolution is attached
hereto and marked as"Appendix 1."

The persons holding positions listed in Appendix 2 are designated employees. The
Lamorinda School Bus Transportation Agency determines that these persons make or
participate in the making of decisions that may foreseeably have a material effect on
financial interests.
The disclosure category set forth in Appendix 2 specifies which kinds of financial
interests are reportable. The Lamorinda School Bus Transportation Agency determines
that the financial interests set forth in the disclosure category are the kinds of financial
interests that a designated employee foreseeably can affect materially through the conduct
of his or her office.

In accordance with the procedures prescribed in Section 18730, each designated
employee shall file statements of economic interests with the Program Administrator, who
will make the statements available for public inspection and reproduction. (Govt Code
§81008.) Upon receipt of the statements of the Treasurer, the Program Administrator
shall make and retain a copy and forward the original to the Fair Political Practices
Commission. Statements for all other designated employees will be retained by the
Agency.

this Appendix. An investment, interest in real property, or income is reportable if the business
entity in which the investment is held, the interest in real property, or the income or source of
income may foreseeably be affected materially by any decision made or participated in by the
designated employee by virtue of the employee's position.
All investments, interests, in real property, income, including gifts and any business entity
in which the person is a director, officer, partner, trustee, employee, or holds any position of
management. Financial interest are reportable only if located within the Hospital District or if the
business entity is doing business or planning to do business within the Hospital District (and such
plans are known by the designated employee) or has done business within. the Hospital District at
any.time during the two years prior to the filing of the statement.

WHEREAS,the Contra Costa Transportation Authority(the"Authority")has adopted a Conflict of Interest Code
regulating the conduct of members of the Board of the Authority and certain persons designated as required filers
with respect to the provisions of the Political Reform Act(California Govexnmcnt Code Sections 81000 at seq.)
(the"Act");and
WHEREAS,in accordance with the provisions of the Act,the Authority is required to review and amend its
Conflict of Interest Code each even numbered year and to submit any amendments to Contra Costa County(the
"County")as the Authority's Cade Reviewing Agency,and
WHEREAS,this code is incorporated in Chapter Four of the Authority's Administrative Code
WHEREAS,the Authority has dettrrnined that modifications to the list of designated persons which is attached
to the Conflict of Interest Code as Exhibit A would be advisable,

1. Exhibit "A" to the Conflict. of Interest Code of the Authority is amended to read as set forth in

WHEREAS, the Political Reform Act of 1974, enacted as part of Proposition 9, requires
every local agency to adopt and promulgate a Conflict of Interest Code applicable to designated
employees within the jurisdiction of the local agency; and
WHEREAS, the Board of Directors of the Kensington Fire Protection District adopted on
March 8, 1977 a Conflict of Interest Code for the District,and this Code.was approved by the Contra
Costa.County Board of Supervisors on March 21, 1978; and.
WHEREAS, subsequent to the enactment of the Conflict of Interest Code for the Kensington
Fire Protection District,the Fair Political Practices Commission enacted amendments to Regulation
187313 regarding provisions of Conflict of Interest Codes; and
WHEREAS,Exhibit"A"of the Conflict of Interest Code adopted by the Board of Directors
of the.Kensington Fire Protection District listed the designated positions subject to the Conflict of
Interest Code; and Exhibit "B" of the Conflict of Interest Code adopted by the Board of Directors
identified the specific financial disclosures which would be applicable to the designated employees;
and
WHEREAS, the Kensington Fire Protection District is required to regularly amend its
Conflict of Interest Code to correspond to changes in the District resulting from reorganization of
operations, and to respond to changes in State law; and
WHEREAS, Government Code Section 87336.5 requires local agencies, such as the
Kensington Fire protection District,to review its Conflict of Interest Code each even-numbered year
to determine whether changed circumstances necessitate revisions to the Conflict of Interest Code;
and
WHEREAS,this review has been completed and it has been determined that such changes
are necessary due to changes in District organization;
NOW,THEREFORE,BE IT RESOLVED that the Board of Directors of the Kensington Fire
Protection District hereby amends the District's Conflict of Interest Code to incorporate by reference
the current terms and conditions of Title 2, Division 6, Section 18730 of the California Code of
Regulations pertaining to provisions of the Conflict of Interest Code and promulgated by the Fair
Political Practices Commission;
BE IT FURTHER RESOLVED that the Board of Directors of the Kensington Fire Protection
District hereby amends Exhibit"A"of the District's Conflict of Interest Code to reflect changes in
Resolution 98-23

All sources of income as defined in Government Code Section 82030, as amended. Not
included as income in this disclosure category is income received from any source outside the
jurisdictional boundaries of the Kensington Fire Protection District if that source is not presently
doing business within the District and has not done business within the District during the two years
prior to the time this disclosure statement is made.
Category 2: Interests in Real Property
All interests in real property in excess of$ 1,000 held by the designated position holder, the
holder's spouse or dependent children located in whole or in part within the jurisdictional boundary
of the Kensington Fire Protection District or within a two mile radius of the boundaries of the
District. Included within this disclosure category is any leasehold,beneficial or ownership interest
or an option to acquire such an interest in real property. Included within this disclosure category is
any pro rata share of interests in real property of any business entity or trust in which the designated
position holder,the holder's spouse or dependent children,owns directly, indirectly or beneficially,
a 10 percent interest or greater.An"interest in real property"does not include the principal residence
of the position holder making the disclosure.
