The Public Works Department having also notified this Board that these improvements have been completed with the exception of minor deficiencies,for which a$ 75,000.00 surety bond(Bond No.3 58160,dated March 26, 1999) was made by The DeSilva Group, Inc and Greystone Homes, Inc., a Delaware Corporation to insure correction of subsurface drains to be installed both within Subdivision 7649 and offsite of Subdivision 7115 (Blackhawk Road), asphalt work including removal and replacement for a portion of Blackbawk Road at the entry gates, and slurry seal coat for a portion of Subdivision 7649,excavation and patching,and repairing/patching cracks and voids in the 96 inch pipe. PAGE: 2 DATE: April 20, 1999 BE IT FURTHER RESOLVED that the $5,300.00 cash deposit(Auditor's Deposit Permit No. 278172, dated May 16, 1996)deposited by The DeSilva Group, Inc. be RETAINED for the six-month lien guarantee period and the deficiency period until October 20, 1999 and the deficiencies have been corrected, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. BE IT FURTHER RESOLVED the payment(labor and materials) surety for$267,250.00, Bond No. 314286 issued by the above surety be RETAINED for the six month lien guarantee period until October 20, 1999,at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Director is AUTHORIZED to refixed the corporate surety bond dated April 18, 1996 issued by Seaboard Surety Company (Bond No. 314286) in the amount of $529,200.00 for faithful performance, to The DeSilva Group, Inc., and Greystone Homes, Inc., a Delaware Corporation pursuant to the requirements of the Ordinance Code.
