Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Sections 4107 and 4110 to the Public Works Director or his designee. Pursuant to Section 6705 of the Labor Code, the Board also DELEGATES to the Public Works Director or to any registered civil or structural engineer designated by him the authority to accept detailed plans showing the design of shoring, bracing, sloping or other provisions to be made for worker protection during trench excavating covered by that section. DECLARE that, should the award of the contract to be invalidated for any, reason, the Board would not in any event have awarded the contract to the second listed bidder or any other bidder, but instead would have exercised its discretion to reject all of the bids received. Project No.: 0662-6R4136, CDD-CP# 97-36 DATE: April 20, 1999 PAGE: 2 Il. FINANCIAL IMPACT: The estimated contract cost of the project is $547,700, funded by the Redevelopment Agency (100%). Ill. REASONS FOR RECOMMENDATIONIBACKGROUND: The project is needed to revitalize the neighborhood by improving drainage, property frontage and traffic circulation. The Public Works Director has filed with the Board of Supervisors the Plans and Specifications for the project. The general prevailing rates of wages, which shall be the minimum rates paid on this project, have been filed with the Clerk of the Board and copies will be made available to any interested party upon request. The Board reviewed and approved the project on December 2, 1997 and found, on the basis of the initial study and all comments received, that there is no substantial evidence that the project will have a significant effect on the environment and adopted the Negative Declaration in compliance with the California Environmental Quality Act. A Notice of Determination was filed with the County Clerk on December 5, 1997. IV. CONSEQUENCES OF NEGATIVE ACTION. If the project is not approved for advertising, it will not be constructed. Reasons for Recommendations and Background: Waterworld USA is a recreational facility located Immediately south of the confluence of the Walnut Creek and Pine Creek Channels, on land leased from and owned by the City of Concord. On December 2, 1997, the Board of Supervisors approved a license Agreement with Waterworld for the use of a portion of Fine Creek Channel's service read for ingress and egress for deliveries and to perform maintenance on its park facilities. A condition of said License Agreement was that the City of Concord would convey to the Flood Control District a permanent access easement across a portion of the Waterworld property. The above-referenced Grant of Easement conveys this right and will provide emergency access to the District's adjacent facilities. IV. Consequences of Negative Action: The District will not be able to secure permanent rights for an alternative access route to maintain its facilities. The CITY may, upon one year's priorwritten notice to the DISTRICT, terminate this Floating Easement as to the area reasonably required for such primary use. In the event of such termination, the CITY will provide an alternate equivalent route at no cast to the DISTRICT. No such termination shall become effective until the alternate equivalent route is fully operational and the DISTRICT has received a land right with respect to such route which is equivalent to this Easement.
