SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMELMATIONS: After hearing the appeal, it is recommended to
deny the appeal and affirm the determinations of the County
Abatement Officer and direct the County Abatement Officer to
proceed and perform the work of abatement .
FISCAL IMPACT: $8, 000 . 00, if the County does the
abatement .
BACKGROUND IREASCn QR RECOMMENDATIONg: On June 4 , 1998 a
complaint was received regarding open and abandoned dwellings,
including large amounts of garbage and debris on the property.
On June 26, 1.998 a site inspection was conducted and the
inspection revealed two substandard, fire damaged dwellings
with piles of garbage and debris on the property. The
properties lave undergone cycles of being secured and broken

The following violations of the County Ordinance exist :
Title 7, Chapter 712-2 . 004 (substandard building)
Chapter 74-3 . 101 (permits required for construction)
Title 8, Chapter 88-4 . 206 (junkyard conditions)
The owner of the property has been notified through written
correspondence and certified mail . As of this date compliance
has not been gained.
On January 21, 1999, the Building inspection Department-
declared
epartmentdeclared the property a public nuisance and posted a Notice
Order to Abate under Title 1, Chapter 14- 6 . This appeal is
being made under the provisions of this 'title �

Dear Mr. Shafique;
In accordance with Contra Costa.County Ordinance Code Section 14-6.410 (public nuisance),
you are hereby notified that Tuesday, March 9, 1999, at 9.00 a.m. is the date and time
set for the hearing of your appeal from the decision of the County Abatement Officer declaring
the abandoned dwellings at 57 Poinsettia Avenue, Bay Point, in violation of Section 712-2.002
and 712-2.2004 of the Contra Costa County Ordinance Code and declaring said violation a
public nuisance.
The hearing will be conducted in accordance with procedures set forth in Contra Costa County
Ordinance Code Section 14-6.410. A copy of the Uniform Public Nuisance Abatement Procedure
is enclosed for your reference.
If you challenge this matter in Court, you may be limited to raising only those issues you or

6.410, 301 U.B.C. per 712-2.042 and 712.2404 of the Contra Crista County
Ordinance Code), on property located at 57 Poinsettia Avenue, Bay Point.
This office is in receipt of the attached Appeal and check in the amount of$12.5 from Sean
Safique from the decision of the County Abatement Officer declaring as a public nuisance,
the abandoned dwellings in violation of(C.C.C. Ordinance Code 14-6.414, 301 U.B.C.
per 712-2.002 and 712.2004 of the Contra Costa County Ordinance Code), on property located
at 57 Poinsettia Avenue, Bay Point.
The Board of Supervisors has tentatively scheduled this appeal for hearing on March 9, 1999, at

On 1./8/99 your property was posted with a Notice of Order to Abate.
Our ordinance requires certified mailing to parties known to be it
possession of the property and on the last equalized assessment
roll .
The notification was sent via first class mail therefore,
unacceptable. In error, a belated certified copy was sent. Please
disregard any correspondence dated '-/8/99 involving the abatement .
The property will be reposted today and new notification sent via
certified mail with new dates, granting additional time for you to
appeal this process .
