Donaghue Benicia, CA 94510 Lister Construction Salinas, CA 93907 Blythe & Associates Fairfield, CA 94533 The above-captioned project and the specifications therefor having been previously approved, Addendum No. 1 having been issued and approved, and bids having been duly invited and received by the {office of the County Administrator, and The bidder listed first above, RemCon having submitted the lowest monetary bid, which is $6,960 less than the next lowest bid; and P.J. Atkinson Construction (2`d bidder) having submitted a letter protesting the lowest bid by RemCon, and the Board having considered the protest and the response by RemCon; and The County Administrator recommending that the bid submitted by RemCon is the lowest responsive and responsible bid, and this Board concurring and so finding„ The Board DETERMINES that the bid protest filed by P.J. Atkinson Construction is without merit and OVERRULES the protest; and The Board FINDS that any irregularities in the list of subcontractors submitted by RemCon were minor and did not give RemCon an unfair advantage, and the Board WAIVES and such irregularities; and The Board ORDERS that the contract for the furnishing of labor and materials for said work is awarded to Rem. Con at the listed amount and at the prices submitted in said bid, and that said contractor shall present two good and sufficient surety bonds as indicated above, and that the County Administrator shall prepare the contract therefor; and The Board FURTHER ORDERS that after the contractor has signed the contract and returned it, together with the bonds as noted above and any required certificates of insurance or Bather required documents, and the County Administrator has reviewed and found them to be sufficient, the County Administrator or his designee is authorized to sign the contract for this Board; and The Board FURTHER ORDERS that in accordance with the project specifications and/or upon signature of the contract by the County Administrator or his designee, any bid brands posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and The Board FURTHER ORDERS that the County Administrator or his designee is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the county to ensure performance under the contract, pursuant to Section 22300 of the Public Contract Code; and The Board DECLARES that, should the award of the contract to RemCon be invalidated for any reason, the Board in any event would not have awarded the contract to any other bidder, but instead would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in cases where the successful bidder establishes a mistake, refuses to sign the contract, or fails to furnish required bonds or insurance (see Public Contract Cade Sections 5100-5107). Date March 23, 1999; Authorization No. WH229B; Pride House, 220 Glacier Drive, Martinez Bids for Pride House, 220 Glacier Drive, Martinez were received on March 8, 1999. The County Administrator's C)Tfice recommends that the Board of Supervisors award the construction contract to the low bidder, RemCon (Remodel and Construction Company), of Concord, in the amount of$204,786, including $171,286 base bid, $6,500 Add Alternate No. 2, $7,540 Add Alternate No. 3, and $19,500 Add Alternate No. 4. The consultant's cost estimate for the base bid construction was $171,959. Cather bids received were as follows: Base Bid 1. P.J. Atkinson Construction, Walnut Creek, California $178,246 2. Blythe & Associates, Fairfield, California $261,170 A bid protest letter dated March 9, 1999 (see attached) was received from P.J. Atkinson Construction(second bidder). The protest alleges the following irregularities in the list of subcontractors submitted by RemCon (low bidder): 1. The door subcontractor(Amex) is a supplier and not licensed to install doors. 2. The concrete subcontractor(Delta Bay) is licensed to perform concrete demolition but not to install concrete. 3. The HVAC subcontractor (Ass. Mech.) is located in San Leandro, not in San Pablo as listed by RemCon. 4. leo subcontractors are listed for ceramic tile, painting, flooring, cabinets, and plumbing. We have investigated the bid protest and have received a response from RemCon dated March 14, 1999 (see attached). Based upon the response and our own investigation, we have made the following determinations: 1. Amex was listed as a door supplier only. The door installation will be performed by RemCon. Since Amex is not installing the doors, they do not need to be licensed. 2. Delta Bay was listed for concrete demolition only. The concrete work will be performed by RemCon. This complies with Delta Bay's license. 3. Associated Mechanical (Ass. Mech.) is located in San Leandro, not San Pablo. However, this irregularity is minor, is not misleading, and does not warrant the invalidation ofRemCon's bid. 4. The ceramic tile, painting, flooring, cabinets, and plumbing work will be performed by RemCon themselves. RemCon's B license covers this work. Moreover, staff has contacted the City of Walnut Creek and has received information that RemCon previously performed similar work for the city without and quality problems. Based on the results of our investigation, we recommend that the Board overrule the above bid protest. Written notice of this recommendation has been sent to P.J. Atkinson Construction, and they have been afforded an opportunity to address the Board on this matter, if they wish. The proposed Board order contains language overruling the bid protest. PRIDE HOUSE, 220 GLACIER DRIVE, MARTINEZ (WH229B); Bid Protest Dear Mr. Atkinson: We have reviewed your bird protest dated March 9, 1999, which alleges certain irregularities in the subcontractor list submitted by RemCon. In your bid protest, you state that Amex is a door supplier and is not licensed to install. RemCon has indicated that Amex was listed as a supplier only and that the installation work will be performed by RemCon. You also state that Delta Bay performs concrete demolition, and is not licensed to install concrete. RemCon has indicated that Delta Bay was listed for concrete demolition only and that the concrete work will be performed by RemCon. You noted that Ass. Mech. is located in San Leandro, not in San Pablo as listed by RemCon. Although your observation is correct, this irregularity is not significant enough to warrant invalidation ofRemCon's bid. You noted that subcontractors were not listed for ceramic tile, painting, flooring, cabinets and plumbing. RemCon has indicated that they will perforin this work themselves. Finally, you questioned whether the listed subcontractors are licensed and in good standing with the State of California Contractor's State License Board (CSLB). Based on the information available at the CSLB web site, all listed subcontractors are properly licensed and in ,good standing with the CSLB. Mr. Atkinson Page 2 March 18, 1999 We are recommending that the Beard of Supervisors award the contract to the low bidder, RemCon, at the Board's March 23, 1999 meeting. For the reasons mentioned above, we pian to recommend that the Board reject your bid protest. Should you disagree with that recommendation, you may attend the March 23, 1999 Board meeting and address the Board at the appropriate time. Mech.We assume is Associated Mechanical is listed to be in San Leandro not San Pablo. Are they licensed to do plumbing? Are they doing the plumbing? 4) In addition to the above discrepancies there are no Subs listed for Ceramic File, Painting, Flooring, Cabinets, and Plumbing. All of these categories are more than 1/2 of I% of the job. Are all of their Subs properly licensed and in good standing with the C.S.L.B.?
