RECOMMENDATIONS
AUTHORIZE the Community Development Director or his designee to execute a
contract amendment with Brown & Caldwell, in an amount of $ 106,400.00 to
complete the preparation of an Environmental Impact Report (EIR) for the West Contra
Cotsa Sanitary Landfill Hazardous Waste Management Facility Closure/Post-closure
plans. �+y�Thiis amendment increases the contract amount from $452,900.00 to
$559r� 00.00.
FIS!QA IMP-ACT
No impact to the County General Fund. The cost of the EIR, including the consultant
contract and this contract amendment as well as the County's administrative
surcharge, has been paid by the project sponsor (West County Landfill Inc.).
BACKGRQUINIDIREASONS EOR R RECOMMENDATIONS
The California EPA - Department of Toxic Substances Control (DTSC) has determined
that an EIR is necessary for considering the approval of the West County Landfill Inc.'s
proposed Closure/Post-Closure Plan for the West Contra Costa Sanitary landfill
Hazardous Waste Management Facility. DTSC is the lead Agency for California
Environmental Quality Act (CEQA) purposes.

On December 6, 1994 DTSC requested the assistance of the County Community
Development Department under a 1969 Agreement between the state and the County. On
December 13, 1994 the Board authorized the Community Development Department to
provide administrative environmental review services to DTSC pertaining to the
development of an EIR for the closure of the West Contra Costa Sanitary Landfill
Hazardous Waste Management Facility pursuant to the 1969 Agreement between the
County and DTSC. The firm of Brown and Caldwell was selected through a consultant
recruiting process conducted by DTSC and the Community Development Department. Can
September 19, 1995, the Board of Supervisors authorized the Director of Community
Development to execute a contract with Brown and Caldwell for an amount not to exceed
$375,000.00 (the actual contract amount was $370,700.00). On March 18, 1997; the
Board of Supervisors authorized the Director of Community Development to execute a
contract amendment with Brown and Caldwell for an amount not to exceed $82,200.00
(raising the contract amount to $452,900.00)
During the preparation of the EIR, the consultant determined, and DTSC and Community
Development concurred, that additional time and effort would be necessary to complete
the Ellin DISC and Community Development agreed that a contract amendment should
not be processed until the extent of the additional work and associated costs could be
clearly determined. This contract amendment is intended to cover the additional
consultant work needed to complete the EIR and related documents covered in the
contract.
This contract amendment will increase the contract amount by an additional $106,400.00
raising the payment limit to $559,300.00.

the scope of services and increases the Payment limit, as modified by Amendments No. 1,No. 2
and No. 3, from$607,050.00 to $621,550.00, an increase of$14,500.00.
B. AUTHORIZE the Director of General Services to execute the Fourth Amendment to the
consulting services agreement, and to issue written authorizations for extra work, in addition to
the authorization for Amendment 4,provided that the cumulative total extra cost for such
additional authorizations shall not exceed$25,000.00.
II. MA!' T T AL..LMPACT
Sufficient funds are available in the bond financing for this project to cover this increase in the
Consultant's payment limit.

A. The Director of General Services executed a consulting services agreement with Fong& Chan
Architects effective August 4, 1998, for Tenant Improvements, 2311 Loveridge Road,Pittsburg,
for Health Services Department.
E. The First Amendment increased the scope of services to provide an alternative design for the
Fourth Floor Pediatric Primary Care Suite, data communication upgrade, replacing existing main
switchgear and upgrading Second Floor Fire-Rated Corridor. The Second Amendment increased
the scope of services to provide a design-build fire alarm system. The Third Amendment increased
the scope of services to provide for an uninterruptible power supply system on the First Floor to
serve LAN and phone switches.
C. The Fourth Amendment increases the scope to provide Architectural and engineering services for
Sanitary Sewer System repair work.

2. Purpq : On August 4, 1998,the panics entered into a contract entitled "Consulting Services Agreement,"referred to as the "Agreement,"which
covers architectural services for Tenant Improvements, 231: Loveridge Road,Pittsburg for Health Services. The Agreement has previously been
amended as follows: First Amendment dated January 26, 1999;Second Amendment dated February 24, 1999; and Third Amendment dated March
8, 1999.The parties desire to further amend the Agreement to expand the scope of service and to increase the payment limit accordingly.
3, Amendmenta to Agreement:
A. In the Agreement, Section 1(e),change the Payment Limit, as modified by the First, Second, and Third Amendments, from$607,050.00 to
$621,550.00,at,increase of$14,500.00.This change shall apply to charges from and after February 1, 1999.
B. In accordance with Section 14 of the Agreement,provide the following extra services:
Design and Construction Documents for Sanitary Sewer System repair.
C. In Appendix B,Paragraph F,increase the reimbursement limit,as modified by the Second Amendment$10,800.00 to$11,800.00.

Subject to the revisions made by this and any prior amendments,the Agreement shall remain in full force and effect.

I. RECOMMENDATION
A. APPROVE a Third Amendment authorizing extra work under the Consulting Services Agreement
elated March 1, 1998, with Marcy Li Wong, Architect for architectural services for a covered
walkway and parking lot expansion at the Technical Services Administration Building, 30 Glacier
Drive, Martinez. The Third Amendment increases the scope of services and Increases the payment
limit, as modified by Amendment No. 2, from$114,246.25 to $131,546.25, an increase of
$17,300.00.
B. AUTHORIZE the Director of General Services to execute the Third Amendment to the consulting
services agreement, and to issue written authorization for extra work, in addition to the authorization
for Amendment No. 3, provided that the cumulative total extra cost for such additional authorizations
shall not exceed$15,000.40.
II, FINANCIAL IMPACT
Sufficient funds are available to the Sheriff-Coroner's budget to cover this increase in the Consultant's
payment limit.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND
Amendment No. 1 increased the Fixed Limit of Construction Contract Cost from$684,544.00 to
$756,105.04. Amendment No. 2 increased the scope of services and payment limit to include review and
administration of requested electrical changes and attendance at additional weekly site meetings. The Third
Amendment increases the scope of services to cover architectural and engineering services for a covered
walkway and parking lot expansion.

BACKGROtTND/F,EASONS FOR RECOMMENDATIONS
In October, 1.998, the Board approved the settlement of the
above class litigation. The employment of this contractor to
provide specialized expert claims administration services was
approved as a part of the settlement . This contract implements the
previously approved settlement .
