City of Oakland that authorizes the County to receive and administer.$428,267 in federal funds from the
.Department of Housing and Urban Development, for housing and supportive services for people with
HIV/AIDS.

B. For fiscal year 1998-99 said hours shall not exceed 5 FTES, or$6,300.00 unless mutually
agreed prior to July 1.
C. Any subsequent years student instructional hour cap shall be determined at least sixty
(60) days prior to the start of the next fiscal year.
D. COMMUNITY COLLEGE DISTRICT shall pay BETHEL ISLAND FIRE
PROTECTION DISTRICT upon submission of valid invoices as follows:
1. COMMUNITY COLLEGE DISTRICT will pay BETHEL ISLAND FIRE
PROTECTION DISTRICT no later than 45 days after the completed enrollment
applications have been presented to the COMMUNITY COLLEGE DISTRICT.
E. BETHEL ISLAND FIRE PROTECTION DISTRICT will pay the state required
registration and grade mailer fee for each registered student. BETHEL ISLAND FIRE
PROTECTION DISTRICT agrees to make a single payment upon completion of each
course.
F. Instructional hours are defined as those hours that are reported on the COMMUNITY
COLLEGE DISTRICT'S CCFS-320, California Community Colleges Apportionment
Attendance Reports, and are subject to audit by the COMMUNITY COLLEGE
DISTRICT'S independent auditor, BETHEL ISLAND FIRE PROTECTION DISTRICT
and the California Community Colleges Chancellor's Office.
IV. MISCELLANEOUS
A. If any of the provisions of this contract are found to be, or become contrary to State law
or regulations or court decisions, COMMUNITY COLLEGE DISTRICT and BETHEL
ISLAND FIRE PROTECTION DISTRICT agree that the contract shall be renegotiated as
it relates to said provision, without affecting the balance or intent of this contract.
B. The COMMUNITY COLLEGE DISTRICT agrees to indemnify and hold harmless
BETHEL ISLAND FIRE PROTECTION DISTRICT and its authorized agents, officers,
volunteers, and employees against any and all claims or actions arising from
COMMUNITY COLLEGE DISTRICT'S negligent acts, errors or omissions and for any
cost or expense 'incurred by BETHEL ISLAND FIRE PROTECTION DISTRICT on
account of any claim therefor.
C. BETHEL ISLAND FIRE PROTECTION DISTRICT agrees to 'indemnify and hold
harmless the COMMUNITY COLLEGE DISTRICT and its authorized agents,officers,
volunteers, and employees against any and all claims or actions arising from BETHEL
ISLAND FIRE PROTECTION DISTRICT'S negligent acts, errors or omissions and for
any cost or expense incurred by the COMMUNITY COLLEGE DISTRICT on account of
any claim therefor.
D. The term of this agreement shall be for a period of time commencing on July 1, 1998 and
terminating on June 30, 1999. This agreement may be extended for additional periods of

one (1) year upon agreement in writing by both parties. Notwithstanding the foregoing,

this contract may be terminated at any time, with or without cause, upon written notice
given to the other party at least sixty (60) days prior to end of the term in which classes
are currently in session. In the event of such termination, each party shall fully pay and
discharge all obligations in favor of the other accruing prior to the date of such
termination and each party shall be released from all obligations or performance which
would otherwise accrue subsequent to the date of such termination. Neither party shall
incur any liability to the other by reason of such termination.
E. If students withdraw prior to completion of a course,the COMMUNITY COLLEGE
DISTRICT shall pay only for the instructional hours which the student completed which
are eligible for state apportionment.
F. The COMMUNITY COLLEGE DISTRICT will provide their standard student liability
and medical care coverage for students attending classes. BETHEL ISLAND FIRE
PROTECTION DISTRICT, its employees and agents release the COMMUNITY
COLLEGE DISTRICT from liability for claims arising due to illness or bodily injury in
excess of this standard coverage.

BACKOWUND
The United States Department of Agriculture has available a
"Housing Preservation Grant Program" to assist low income residents
with home repair in the rural areas of Contra Costa County. The
County has received funding in prior years from this grant program.
The Contra Costa County Building Inspection Department Neighborhood
Preservation Program anticipates requesting $75, 000.

WHEREAS, the Rural Housing Service (RHS)has announcedthat it is
soliciting competitive applications under its Housing Preservation Grant (HPG)
program; and
WHEREAS, the HPG program is a grant program which provides qualified
public agencies and other eligible entities grant funds to assist very low- and low-
income homeowners repair and rehabilitate their hones in Waal areas; and
WHEREAS,RHS has indicated that preapplications must be postmarked by
March 231, 1999.
NOW, THEREFORE, BE IT RESOLVED the Board of Supervisors hereby
directs the Director of the Building Inspection Department to submit a pre-
application for the Housing Preservation Grant program.

HOUSING PRESERVATION GRANT PROGRAM
The attached preapplication packet is forwarded per your request or if you have
previously requested this information. Included within the packet are the necessary
forms,information,and regulations for filing a preapplication for a Housing Preservation
Grant(HPG).
Please thoroughly review the HPG regulations for the requirements involved in
assembling and submitting a preapplication. Section 1944.676 lists the specific
documentation required for a preapplication. All items through(h)are required. The
Poral 1940-20 required by item(c)should be completed per the instructions contained in
Exhibit P-1 to the HPG regulations.
A Preapplication Checklist is included in the packet which should be useful in organizing
and checking for completion of your preapplication.
In addition to the information required by the regulations,please include a resolution of
your governing beard authorizing application for this assistance.
HPG assistance can be provided to(1}owners of single family housing,(2)owners of
multiple unit rental properties,or(3)consumer cooperative housing projects for the
benefit of unit occupants. A preapplication must only address a proposal to assist one of
the three targeted recipients. Any combination proposal is not acceptable.
Please note the closing date for preapplication submittal is March 23, 1999.

Several.irnportant points to remember.
Start your consultation process early in order that you will have time to secure the
necessary documentation,(i.e.,local government, State and Areawide
Clearinghouses,and the State Historic Preservation Office).

Initiate your notice (publication) for public comments as soon as possible, Please
remember that you must allow adequate time for a 15-day public comment period and
to summarize any comments received before filing your preapplication with Rural
Development. The last day for publishing the notice for public comments is

days ahead of the anticipated filing date. The publication must in the form of a
"public notice". A general article is not acceptable. Secure an Affidavit or Proof of
Publication from the newspaper for inclusion in your preapplication.
• The percentage of use of HPG fluids to total cost of unit preservation(HPG and
leveraged funds)is calculated exclusive of administrative costs.
• When projecting the number of units to be assisted, HPG funds must be used for
repairs on each unit,either solely or in combination with leveraged funds, for the unit
to be considered assisted by the HPG program.
® For fiscal year 1999,the HPG allocation for California is $237,303. Please note that
the HPG regulations(section 1944.680)limit grants to no more than 50 percent of the
State allocation to a single applicant.
• Section 1944.668 states that a grant request may be for a one or two year period.
Applicants requesting a two year term may be asked to develop a feasible one year
program if sufficient funds are not available for two year program. used on activity
from previous years. one year proposals ranging from$75,000 to$150,000 have been
typical.
+ Any processing activity for a HPG preapplication involving authorizedassistance to
Rural Development employees,member of their families,known close,relatives,
business or close personal associates, is subject to Special processing provisions
provided in RD Instruction 1900-D. Applicants for HPG assistance are required to
identify any known relationship or association`with Rural Development employees.
10,311'x: Public Law 101-235 imposes registration and reporting requirements on any
person engaged for pay or for any consideration for the purpose of attempting to
influence the making of a Rural Development housing loan and/or grant and limits fees a
person may charge for this service, Although no registration/reporting requirements are
placed upon the applicant for the Rural Development housing loan and/or grant,the
failure of the person paid to influence a request for assistance to properly register and
report could adversely affect an application. It is,therefore, incumbent upon housing
applicants to ensure that any person they engage to influence their application complies
with this law. Applicants should review RD Instruction 1940-S, Section 1940.916 for
specific administrative remedies and civil penalties which may be imposed upon the
influencer an/or applicant. Forms for registration and reporting as well as RD Instruction
1940-S may be obtained from any Rural Development office.

SUMMARY: The Rural ;lousing Service (RETS) announces that it is
soliciting competitive applications under its Housing Preservation
Grant (HPG) program. The HPG program is a grant program which provides
qualified public agencies, private nonprofit organizations and other
eligible entities grant funds to assist very law® and low-income
homeowners repair and rehabilitate their homes in rural areas, and to
assist rentalpropertyowners and cooperative housing complexes to
repair and rehabilitate their units if they agree to crake such units
available to low- and very low-income persons. This action is taken to
comply with Agency regulations found in 7 CFR part 1944, subpart N,
which requires the Agency to announce the opening and closing dates for
receipt: of preapplications for HPG funds from eligible applicants. The
intended effect of this Notice is to provide eligible organizations
notice of these dates.
DATES: RHS hereby announces that it will begin receiving
preapplications on December 23, 1998. The closing date for acceptance
by RHS of preapplications is March 23, 1999. This period will be the
only time during the current fiscal year that RHS accepts
preapplications. Preapplications trust be received by or postmarked on
or before the closing date.

SUPPLEMENTARY INFORIIIATION: 7 CFR part 1944, subpart N provides details

Entities wishing to apply for assistance should contact the Rural
Development State Office to receive further information and copies of
the preapplica.tion package. Eligible entities for these competitively
awarded, grants include State and local governments, nonprofit
corporations, Federally recognized Indian Tribes, and consortia of
eligible entities.

Assistance under No. 10.433, Rural dousing Preservation Grants. This
program is subject to the provisions of Executive Order 12372 which
requires intergovernmental consultation with State and local officials
(7 CFR part 301.5, subpart V) . Applicants are referred to 7 CFR
Secs. 1.944.674 and 1.944.576 (d) and. (e) for specific guidance on these
requirements relative to the HPG program.
The funding instrument for the HPG program will be a grant
agreement. The term of the grant can vary from 1 to 2 years, depending
on available funds and demand. No maximum or minimum grant levels have
been established; although, based on fiscal year (FY) 1999 funding
availability, the Agency anticipates that the average grant will be
$59,000 for a 1-year proposal. For FY 99, $7,000,000 is available and
has been distributed under a formula allocation

1:3ACKGRt3UND(REASONS FOR RECOATIONS
The National Affordable Housing Act(Public Law 101-625, approved November 28, 1990)
authorized the Housing Opportunities for Persons with AIDS Program(HOPWA)to provide
states and localities with resources to devise long-term comprehensive,strategies for meeting the
housing needs of persons with HIV/ADS and related diseases.
Approval of the contract with the City of Oakland will provide $428,267 to the County as
administering agent on behalf of the Contra Costa Entitlement Jurisdictions (the Urban County'
and Cities of Antioch, Concord, Pittsburg, Richmond, and Walnut Creek). These funds may be
used for aquisition, rehabilitation, and new construction of housing, supportive services, housing
information services; and certain other housing related activities for persons with HIV/AIDS.
These funds will be allocated through a competitive application process.
' The Urban County includes the unincorporated County and the following cities and towns:
Brentwood,Clayton,Danville,El Cerrito,Hercules,Lafayette,Martinez,Moraga,Orinda,Pincle,Pleasant
Hill,San Pablo and San Ramon.

Island Fire Protection District and Contra Costa Community College District

RECOMMENDATIONS.
APPROVE and AUTHORIZE the Chair, Board of Supervisors, as the Board of Directors of the
Bethel Island Fire Protection District (BIFPD) to execute a Master Course Agreement and Ota-Site
Supervisor Agreement with Contra Costa Community College District (CCCCD) for the purpose
of CCCCD providing affiliated education coarses for BIFPD. BIFPD will provide needed
supervisory services to CCCCD.

Prig to being hired or promoted, BIFPD fire fighters must complete a variety of California State
Fire Marshal courses. The water Agreement between CCCCD and BIFPD will provide various
programs designed to meet the Fire District's training requirements. BIFPD will provide
classroom space, instructors, equipment, day-to-day management support, and all other related
overhead necessary to conduct the program. CCCCD will pay BIFPD for student instructional
hours that are eligible for state general apportionment. Additionally, fire fighters receive college
credit for completing the training.
The non-financial On-Site Supervisor Agreement provides for an employee of BIFPD to be
assigned to CCCCD as an at-will uncompensated temporary academic employee of CCCCD to
provide executive services with regard to class instruction. Among other things, the supervisory
services include ensuring that training time is expended in full compliance with the course
objectives, ensuring accurate and current daily student attendance records, and ensuring the
accurate calculation of final student grades and the prompt s bmission of thein to CCCCD.

This agreement is made and entered into this 1st day of July_ 1998_, by three parties:
The Centra Costa Community College District(hereinafter the "COMMUNITY COLLEGE
DISTRICT"), Bethel Island Fire Protection District(hereinafter "BETHEL ISLAND FIRE
PROTECTIONT DISTRICT") and I)AVi,0 4VAH/_ (hereinafter"BETHEL ISLAND FIRE
PROTECTION DISTRICT'S ON-SITE SUPERVISOR")an employee of BETHEL ISLAND
FIRE PROTECTION DISTRICT who is being assigned to the COMMUNITY COLLEGE
DISTRICT on a part-time basis pursuant to Title 5, California Code of Regulations, Section
58058(b), and shall be an employee of the COMMUNITY COLLEGE DISTRICT on a limited
'oasis during this part-time assignment pursuant to this Agreement.
RECITALS
WHEREAS,the COMMUNITY COLLEGE DISTRICT needs supervisory services with
regard to instruction for classes offered by the COMMUNITY COLLEGE DISTRICT in
cooperation with.BETHEL ISLAND FIRE PROTECTION DISTRICT, subject to the terms and
conditions set forth in the separate master agreement between BETHEL ISLAND FIRE
PROTECTION DISTRICT and the COMMUNTITY COLLEGE DISTRICT; and,
WHEREAS,BETHEL ISLAND FIRE PROTECTION DISTRICT has duly qualified
employees who can competently provide supervisory services with regard to instruction for
classes offered by the COMMUNITY COLLEGE DISTRICT in cooperation.with BETHEL
ISLAND FIRE PROTECTION DISTRICT; and,
WHEREAS, BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE
SUPERVISOR agrees to be assigned to the COMMUNITY COLLEGE DISTRICT as an at-will

DISTRICT to competently provide executive services with regard to instruction for classes

employee of BETHEL ISLAND FIRE PROTECTION DISTRICT who shallmeet "Minimum
Qualifications" for the academic position of BETHEL ISLAND FIRE PROTECTION
DISTRICT'S ON-SITE SUPERVISOR as established by the COMMUNITY COLLEGE
DISTRICT and as determined by the COMMUNITY COLLEGE DISTRICT.
2. BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE SUPERVISOR is
professionally and specially trained and competent to provide the supervisory services required
by the COMMUNITY COLLEGE DISTRICT.

SUPERVISOR is performing the required supervisory services for the COMMUNITY
COLLEGE DISTRICT, BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE
SUPERVISOR shall be under the direct control and direction of the COMMUNITY COLLEGE
DISTRICT, and shall be a temporary academic employee of the COMMUNITY COLLEGE
DISTRICT. The COMMUNITY COLLEGE DISTRICT retains the sole right to select, assign.,
evaluate, discipline and terminate BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-
SITE Supervisor at any time.
4. BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE SUPERVISOR
shall be an at-will and uncompensated temporary academic employee of the COMMUNITY
COLLEGE DISTRICT during the hours of assignment to the COMMUNITY COLLEGE
DISTRICT and may be terminated at any time for any reason and without cause by the
COMMUNITY COLLEGE DISTRICT.
5. BETHEL ISLAND FIRE PROTECTION'DISTRICT'S ON-SITE SUPERVISOR'S
responsibilities and duties as an employee of the COMMUNITY COLLEGE DISTRICT shall
include, but are not limited to, the following:
a. Ensure that training time is upended in full compliance with the coarse
obiectives determined by the COMMUNITY COLLEGE DIS'T'RICT.
b. Ensure the safety and well-being of students.
C. Ensure the proper coordination of the delivery of instruction in order to achieve
full compliance with State Fire Marshall's Office regulations.

d. Ensure continued physical presence at the work place assigned by the
COMMLJNITY COLLEGE DISTRICT during all hours of the assignment as an
employee of the COMMUNITY COLLEGE DISTRICT.
e. Ensure the accuracy of all information on all time sheets of technical officers and
facilitators.
f Ensure the immediate notification to the Co-director of a student drop rate.
g. Ensure the proper and timely assignment, scheduling and notification of
facilitators.
h. Ensure the complete, accurate and timely evaluation of facilitators.
i. Ensure regular attendance at periodic staff meetings with the COMMUNITY
COLLEGE DISTRICT employee who serves as Co-director.
3. Ensure that all handouts prepared or utilized by facilitators are appropriate prior to
submitting them to the Co-director for approval.
k. Ensure accurate and current daily student attendance records.
1. Ensure the effective use of instructional methods, technology,testing and
remediation.
M Ensure the proper administering and scoring of Learning Domain tests.
M Ensure the accurate calculation of final student grades and the prompt submission
of them to the Co-director within two weeks of course completion.
o. Ensure the competent and prompt completion of all other assigned duties.
6. The COMMUNITY COLLEGE DISTRICT shall provide no compensation to
BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE SUPERVISOR for any
services rendered pursuant to this Agreement, but compensation shall be provided by BETHEL
ISLAND FIRE PROTECTION DISTRICT in accordance with its established and standard
practices and including workers' compensation insurance.
7. For purposes of'indemnification and defense of any claims, actions or lawsuits,
BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE SUPERVISOR shall be
considered an employee of the COMMUNITY COLLEGE DISTRICT only during those times
when BETHEL ISLAND FIRE PROTECTION DISTRICT'S ON-SITE SUPERVISOR is
actually performing on behalf of the COMMUNITY COLLEGE DISTRICT the responsibilities
and duties listed in this Agreement at the work place assigned by the COMMUNITY COLLEGE

MASTER AGREEMENT
BETWEEN
CONTRA COSTA COMMUNITY COLLEGE DISTRICT
AND
BETHEL ISLAND FIRE PROTECTION DISTRICT

This agreement is made and entered into by and between the CONTRA COSTA COMMUNITY
COLLEGE DISTRICT, (hereinafter referred to as COMMUNITY COLLEGE DISTRICT), and
BETHEL ISLAND FIRE PROTECTION DISTRICT, (hereinafter referred to as BETHEL
ISLAND FIRE PROTECTION DISTRICT), for the purpose of outlining the duties and
responsibilities of each party as they relate to providing affiliated educational courses for
BETHEL ISLAND FIRE PROTECTION DISTRICT, COMMUNITY COLLEGE DISTRICT
and BETHEL ISLAND FIRE PROTECTION DISTRICT mutually agree as follows.
I. RESPONSIBILITIES OF THE COMMUNITY COLLEGE DISTRICT
A. COMMUNITY COLLEGE DISTRICT shall offer approved educational courses through
its various programs to meet the needs of BETHEL ISLAND FIRE PROTECTION
DISTRICT Training Program. I
B. COMMUNITY COLLEGE DISTRICT shall provide a coordinator to work with
BETHEL ISLAND FIRE PROTECTION DISTRICT's Training Coordinator. Said
coordinator shall act as the Training Co-Director for all COMMUNITY COLLEGE
DISTRICT-affiliated educational courses. Instruction shall be under the immediate
supervision and control of the coordinator.
C. COMMUNITY COLLEGE DISTRICT shall assist BETHEL ISLAND FIRE
PROTECTION, DISTRICT in registration and other support services to students in order
to adequately manage and control its course offerings. The enrollment period and student
fees for those educational courses shall coincide with the enrollment period and fees
provided by the District for its other course offerings.
D. COMMUNITY COLLEGE DISTRICT shall approve of the selection of instructors,
facilitators, and evaluate the quality of instruction to ensure that it meets the needs of the
students and the accreditation requirements of the COMMUNITY COLLEGE
DISTRICT. District is responsible for the educational programs conducted under this
Agreement.
E. COMMUNITY COLLEGE DISTRICT shall ensure that course offerings meet all
appropriate State of California Code of Regulations(hereinafter referred to as Title 5)and
State of California Education Code(hereinafter referred to as Education Code)
requirements.
F. COMMUNITY COLLEGE DISTRICT shall consult BETHEL ISLAND FIRE
PROTECTION DISTRICT on any revisions to existing COMMUNITY COLLEGE
DISTRICT courses, initiation of new courses, or any other changes, in order to ensure the
quality of educational services and to meet the needs of BETHEL ISLAND FIRE
PROTECTION DISTRICT.
Il. RESPONSIBILITIES OF BETHEL ISLAND FIRE PROTECTION DISTRICT
A. BETHEL ISLAND FIRE PROTECTION DISTRICT shall provide classroom space at
the Bethel Island Fire Protection Station 95 building free of charge to the COMMUNITY
COLLEGE DISTRICT.
B. BETHEL ISLAND FIRE PROTECTION DISTRICT shall provide instructors,
facilitators,equipment, materials, day-to-day management support, and all other related
overhead necessary to conduct the COMMU-LAITY COLLEGE DISTRICT'S affiliated
educational programs.
C. BETHEL ISLAND FIRE PROTECTION DISTRICT shall provide supervision and
evaluation of students in accordance with the accreditation requirements of the
COMMUNITY COLLEGE DISTRICT.
D. BETHEL ISLAND FIRE PROTECTION DISTRICT shall cooperate with the
COMMUNITY COLLEGE DISTRICT to ensure that all personnel, equipment,and
materials used in carrying out its responsibilities under this contract conform to the
Education Code and Title 5 mandated standards governing instructional programs,
including class hours sufficient to meet performance objectives.
E. BETHEL ISLAND FIRE PROTECTION DISTRICT shall use the money received as
compensation for services under this contract for educational and training related
purposes as they relate to public safety courses.
F. BETHEL ISLAND FIRE PROTECTION DISTRICT shall assist the COMMUNITY
COLLEGE.DISTRICT in collecting and submitting to the COMMUNITY COLLEGE
DISTRICT all registration fees and applications associated with the class offerings under
this contract by providing a listing of students by name scheduled to attend each course.
G. BETHEL ISLAND FIRE PROTECTION DISTRICT shall maintain records of student
attendance and achievement. These records will be open for review at all times by
officials of the COMMUNITY COLLEGE DISTRICT.
III. PAYMENT FOR SERVICES
A. In consideration for the services provided hereunder COMMUNITY COLLEGE
DISTRICT shall pay BETHEL ISLAND FIRE PROTECTION DIS'T'RICT$2.40 per
student instructional hour that is eligible for state general apportionment.
