March 18, 1999 T"t C'OS1N SUBJECT: LEGISLATION: Sly 193 (BACA) SPECIFIC REQUEST(S)OR RECOMMENDATION($)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ADOPT a position in SUPPORT of SB 193 by Senator Joe Baca of San Bernardino which would create a breast cancer special license plate with the proceeds from the sale of the license plates going to grants for uninsured or underinsured women who are at, or below, the 200% federal poverty level. BACKGROUND: The Board's 1999 Legislative Program contains the following item: "Support efforts to increase funding for breast cancer awareness, public education, and treatment." Senator Baca has introduced SB 192 which, as amended March 10, 1999, would create a breast cancer special license plate. Each special license plate would cost $50 for the original issuance and $40 per year for renewal. The proceeds from the issuance and renewal of the special license plate, upon appropriation by the Legislature, would go to the State Department of Health Services to award grants to fund breast cancer treatment for uninsured or underinsured women who are at, or below, the 200% federal poverty level. Since SB 192 is consistent with the Board's 1999 Legislative Program, it is recommended that the Board indicate its support of SB 193. LEGISLATIVE COUNSELS DIGEST SB 193, as amended, Baca. Vehicles: special breast calker treatment license plates. Existing law requires the Department of Motor Vehicles to issue special interest license plates, as specified, containing a distinct design or decal of participating organizations, to any person, to be displayed in lieu of regular license plates. This bill would add a special breast cancer treatment license plate to the special interest license plate program. The bill would require the additional funds collected by the issuance of these special interest license plates to be deposited in the Breast Cancer Treatment Account, created by the bill, in the Breast Cancer Fund to be used by the SomanKrefft - Ftoo State Department of Health Services, when appropriated, to fund breast cancer treatment grunt awards 97 SB 193 —2— for uninsured or underinsured women who are at, or below, the 200%federal poverty level, as specified. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. The people of the State of California do enact as follows: I SECTION 1. Section 5070 is added to the Vehicle 2 Code, to read: 3 5070. (a) The department, in consultation with the 4 Segan Krofneft Fe"da6en­and Kaiser Permanente, shall 5 design and make available for issuance pursuant to this 6 article special breast cancer treatment license plates as 7 described in this section. Notwithstanding subdivision (a) 8 of Section 5060, the special breast cancer treatment 9 license plate shall bear a full-plate graphic design 10 depicting the same logo as the United States postal stamp 11 with the words "Fund the Fight. Find a Cure" over the 12 sketch of a woman. Any person described in Section 5101 13 may, upon payment of the additional fees set forth in 14 subdivision (b), apply for and be issued a set of special 15 breast cancer treatment license plates. Notwithstanding 16 subdivision (a) of Section 5060, the special breast cancer 17 treatment license plates may be issued as breast cancer 18 license plates, as defined in Section 5103. 19 (b) In addition to the regular fees for an original 20 registration, renewal of registration, or transfer or 21 substitution of the license plates, the following additional 22 fees shall be paid for the issuance, renewal, retention, 23 transfer, or replacement of the special interest license 24 plates authorized pursuant to this section: 25 (1) For the original issuance of the plates, fifty dollars 26 ($50). 27 (2) For a renewal of registration of the plates, or the 28 retention of the plates if renewal is not required, forty 29 dollars ($40). 30 (3) For transfer of the plates to another vehicle, fifteen 31 dollars ($15). 32 (4) For each substitute replacement plate, thirty-five 33 dollars ($35). 97 -3— SB 193 1 (5) In addition, for the issuance of an environmental 2 License plate, as defined in Section 5103, the additional 3 fees prescribed in Sections 5106 and 5108, which shall be 4 deposited in the Environmental License Plate Fund. 5 (c) Except as provided in paragraph (5) of subdivision 6 (b), all fees collected under this section shall, after 7 deduction of the department's costs in administering this section, be deposited in the Breast Cancer Treatment 9 Account, which is hereby created in the Breast Cancer 10 Fuad, as that fund is established in Section 30461.6 of the 11 Revenue and Taxation Code. February was a very active month for transportation related legislation with the introduction of numerous bills that are of interest to Contra Costa County. Listed below are summary descriptions of these selected bills followed with the TW&I Committee's recommendation to the Board of Supervisors: AS 102 (Wildman-D): High>&ay Soundwalls Funding - This bill would require that expenditures for soundwall projects identified by Caltrans in 1989 be funded prior to funding projects in the 1998 STIP. Bill Status: Introduced 12/21/98; referred to Assam. Transp. Comm. TW&I Committee Recommendation (3175/99): OPPOSE position. This would program funds for soundwall retrofit in LA Co. off the top"of STIP and would reduce Contra Costa's STIP fund level by approx. $2,9 M. AS 2.83 (Longvills-D): Highway Pro arty Acauisition and County Coo2eration -This bill would prohibit Caltrans from conducting a separate eminent domain condemnation proceeding for acquisition or property interest if a county board of supervisors has passed by resolution a 4/5 vote, to proceed to acquire real property or interest that has been determined to promote the interests of the county and be necessary for state highway purposes,unless it becomes necessary to do so after the county's condemnations proceeding has terminated. Bill Status: Introduced 2/4/99; referred to Assam. Judiciary and Transp. Committees, TW&I Committee Recommendation (3/15/99): SUPPORT in concept position. This bill could potentially simplify and streamline condemnation proceedings for transportation projects in Contra Costa County. AS 779 (Torlakson-D): Land Use Planning Transit Facilities-This bill would authorize Metropolitan Planning Organizations (MTC) and transportation planning agencies under certain conditions to establish transportation planning revolving funds and make loans available from these funds to cities and counties to prepare specific land use plans that link land use and transportation, otherwise known as transit village plans. Bill Status: Introduced 2/24/99; referred to Assem. Transp. Comm. TW&1 Committee Recommendation (3/15/99): SUPPORT in concept position. This bill could promote improved land use planning around transit facilities by making funds available to cities and counties to prepare specific plans. The bill's language needs clarification about the potential fund source for the loan, and potential terms and conditions for a loan. AD 1032 (Torlaks n-D)• Pro act Delivery for Transportation -This bill would enact major reforms in the project delivery process for transportation projects. Key features of this bill include: Require Caltrans to establish project delivery teams in each district office to assist in the expeditious delivery of state transportation projects. The team would consist of key Caltrans representatives and staff from agencies responsible for approving a County's STIP submittal. The team would compile an annual report of County's prioritized STIP projects which indicates those projects that could be accelerated and/or measures necessary to accelerate the projects. The report would be submitted to Governor and State Legislature. • Require Caltrans to develop a management information system, in consultation with local and regional agencies, to track these projects. Authorize Caltrans District Directors to approve contracts of $50,000 or less for consulting services and supplies; Instead of a 4-year horizon, allow a 6-year time period for estimating and allocating amount of state and federal funds to be available for transportation projects ® Provide State Legislature with a report on converting state transportation budget process to a biennial budget process of submission to State Legislature only in even-numbered years beginning in Yr. 2000. Creates a reimbursable work subaccount in the State Highway Account. ® Enable loans to local agencies of unallocated State Highway Account funds to advance projects eligible to receive funding in the STIP. Bill Status: Introduced 212.5199 as urgency bill; referred to Assem. Transp, Comm. for hearing on 3/28/99 and hearing on 4/22199 in Contra Costa Co. TW&I Committee Recommendation (3/15199): SUPPORTIn concept. Provide testimony for 4122/99 hearing in Contra Costa County. Adopt Positions on Proposed Transportation Related Legislation March 15, 1999 Page 3 I"ACKGBOUND/R ASONS FOR RE MMENDATIONS (continued) X47 (Torlakson 12): Bicycle Tra(smortat1on Plans -This bili would delete an existing requirement for a city or county to prepare a bicycle transportation plan with certain elements in order to be eligible for State Bicycle Transportation Account funds, and, it authorizes certain alternative documents to be used by a city or county for State Bicycle Transportation Account fund eligibility instead of a bicycle transportation plan. Bill Status: Introduced 3/5/99; referred to Assam. Transp. Comm. for hearing 4/8/99. TW&I Committee Recommendation (3/15/99):SUPPORT with amendments position. Amendments striking language permitting Bicycle Transportation Plan requirements to be met through local General Plans, and adding language to establish a deadline to prepare guidelines and evaluation criteria for grant applications to the Bicycle Transportation Account. The stricken language removes objections to the bill by the California Bicycle Coalition. SB 117 (Murray-J-2): Environmantg( f nhianrg1 Ment and Mitigation Program -This bill would remove the July 1, 2001 sunset on the state's Environmental Enhancement and Mitigation Demonstration Program Fund. It states legislative intent that $10 million be allocated annually to the fund and renames the fund "Environmental Enhancement and Mitigation Program Fund.' The State Resources Agency would evaluate and recommend funding proposals under this program. Bill Status: Introduced 12/18/98; referred to Sen. Transp, Comm. TW&I Committee Recommendation (3/15/991. SUPPORT in concept position. This bill would continues a successful statewide program to mitigate impacts of highway improvement projects. This program has been used extensively for projects in Contra Costa Co. SB a64 (Perata-D): State-Laval ParSnarsh#l2 Program - This bill would extend the State-Local Partnership Program by an additional year to July 1, 2000 (due to expire 6130/99), and make other changes in the law to extend various deadlines for completion of project eligible to receive funding under the program. Bill Status: An urgency bili introduced 2/11/99; referred to Sen. Transp. Comm. for hearing 3/16/99. TW&I Recommendation (3/15199): SUPPORT in concept position. Although this bill more directly impacts highway projects in Alameda Co. that may miss the existing 6130199 deadline, there are two construction projects on Route 4 (East and West) that could benefit from extending State- Local Partnership Program an additional year. 5494(Figueroa-D)• San Eranclsco Bay Trail -This bill would appropriate an unspecified amount from the General Fund to the Department of bark and Recreation to fund a competitive grant program to construct new segments of the San Francisco Bay Trail, employing members of the California Conservation Corps, wherever possible, for trail construction, landscaping and maintenance. Bill Status: Introduced 2/18/99; referred to Sen. (vat. Res. and Water Comm. TW&i Committee Recommendation(3/15/99): WATCH position. Uncertain of fiscal impact because amount set aside from the general Fund not specified. Once fiscal impact is resolved consider a SUPPORT position since Contra Costa Co. segments of SF Bay Trail would be eligible. SGA 3 (Burton/Karnette-CJ) Allow Maiority)&Je On I( nsl2ortalign Taxes - A resolution originating in the State Senate proposing State Constitutional Amendment changing the two-third vote requirement for approval by a local jurisdiction of a special transportation tax to a simple majority vote. Bill Status: Introduced 2/8/99; referred to Sen. Transp. Comm. TW&I Committee Recommendation (3/15/99): SUPPORT position. This legislation would give the state's voters an opportunity to decide if the two-third vote requirement should be repealed to allow simple majority vote on transportation tax measures. SB 315 (Burton/Karnatte-121: Transportation Infrastructure Bonds - This bill would provide for the Transportation Bond Infrastructure Acts of 2000, 2002, 2004, and 2006, to be placed before the voters in the statewide general elections held in November of each year. Voters would be asked to authorize the sale of General Obligation Bonds up to $16 Billion ($ 4 Billion per general election) to fund transportation infrastructure improvements statewide. Bill Status: Introduced 2/8/99; referred to Sen. Transp. Comm. TW&I Committee Recommendation (3/15/99): WATCH position. Need to evaluate impact of the bonded indebtness on State General Fund and on local government finance? The needs for transit operating assistance should also be addressed in this funding package. County's Legislative Advocate should direct these concerns to the bill's authors.
