SUBJECT: Permission to encroach into a portion of the scenic easement to construct a pool, spa
and install irrigation and landscaping. The property is addressed 2454 Alamo Country
Circle and is lot #27 of "The Trails in Alamo", Subdivision 7818 in the Alamo area
(County File #ZI 998222).
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Permit encroachment into a portion of the scenic easement to construct pool,
spa, irrigation and landscape improvements as shown on plans.
Require certified arborist to be on site when the corner of the pool area
nearest the oak tree is excavated.
Prohibit drip watering system under the existing oak tree.

BACKGROUND/REASONS FOR RECOMMENDATIONS
The scenic easement encompasses nine (9) other properties in the area and was
recorded on December 14, 1995 (attached). Development rights are restricted
within the scenic easement area and any improvement within this area requires the
approval of the County. Furthermore, it restricts installing irrigation and landscaping
improvements within the dripline of any oak tree situated within the scenic easement
unless a licensed arborist has determined that it will not injure or threaten the health
of the oak tree.

Several property owners within the scenic easement area have installed irrigation and
landscape improvements. Since landscape improvements do not require any permits
from the County, these landscape and irrigation improvements were not reviewed or
approved by the County.
The applicant has submitted an Arborist report dated September 4, 199 , It confirms that
there will be no activity inside the dripline of the tree so there will not be any root cutting.
The proposed improvement is consistent with the majority of the homes within the
development including those within the affected scenic easement. Planting appropriate
ground cover on the hillside will also reduce the fire hazard and the potential erosion.
This application was reviewed by the Alamo Improvement Association at their February
10, 1999 Board meeting. The Alamo Improvement Association recommended approval
subject to the certified arborist being on site when the corners of the pool area nearest
the oak tree is excavated and the proposed drip watering system being located outside
the dripline of the tree.
