Approve and authorize the Health Services Director or his designee (Chuck
Deutschman) to execute on behalf of the County, Contract #24-913--2 with
REACH Project, Inc. in the amount of $22, 5010, for the period from January
1, 1999 through June 30, 1999, for the provision of substance abuse
prevention services and outpatient treatment services in the Brentwood.
Community. This Contract includes a six--month automatic extension through
December 31, 1999, in the amount of $22, 500.
rISC& IMPACT.
This Contract is funded 100% by Federal funds. No County match is required.
Approval of this Contract will result in a cumulative twelve-month total in
excess of $25, 000, and therefore, Beard of Supervisors approval is required.
CHILDREN'S INFANT STATEMENT:
This Alcohol and Drug Abuse prevention and treatment program supports the
Board of Supervisors ' "Families that are Safe, Stable, and Nurturing" and
"Communities that are Safe and Provide a High Quality of Life for Children
and Families" community outcomes by providing individual, group, and family
counseling; substance abuse education; rehabilitation support services; and
substance abuse prevention services. .Expected outcomes include increased
knowledge about the impact of addiction; decreased use of alcohol, tobacco
and other drugs; increased use of community-based resources.; and increased
school and community support for youth and parents in recovery.

In September 1998, the County Administrator approved and the Purchasing
Services Manager :executed Contract #24-913 -1 with REACH Project, Inc. for
the period from July 1, 1998 through december 31, 1998 for the provision of
outpatient substance abuse treatment services in the Brentwood Community.
Approval of Contract #24--91.3--2 will allow REACH Project, Inca to continue
providing services through ,lune 30, 1999.

FISCAL IMPACT:
This Contract is funded. by Federal funds (Department of sousing and Urban.
Development) through the City of Oakland (470160-CMS) . No County funds
are required.
BACKGROUND/R.EASON(S) FOR R.ECONMENDATIOST{S) :
In 1990, Congress passed the National Affordable Housing Act, including
Housing Opportunities for People with AIDS (HOPWA) . The City of Oakland
acts as the federal grantee for HOPWA funds for Alameda and Contra Costa.
Counties and has entered into a contract with Contra Costa County to
provide supportive services for County residents with HIV/AIDS and their
families .
Or. February 24, 1998, the Board of Supervisors approved Contract
,#22-435-5 with Catholic Charities of the East Bay to ,provide housing
advocacy services for people with HIV Disease, for the period from Marc;:
1, 1998 through February 28 , 1999 .
Approval of Contract #22-435-6 will allow the Contractor to continue
providing services +through February 29, 2000 .

RECOMMENDATION:
AUTHORIZE the Sheriff or his designee to execute, on behalf of the COUNTY, a contract with
Alameda County for the services of the Alameda County Sheriffs Office Explosive Ordnance
Disposal (EOD) Squad on an as-needed basis. The annual payment limitof the contract is
$15,000 and the contract shall begirt April 2, 1999 and be effective until terminated by either
party.
FISCAL IMPACT:
Funds are available in the Sheriffs Office 1998-99 budget and will be included in the 1999-2000
budget request to support the cost of this contract.
BACKGROUND:
The County has historically contracted with other law enforcement agencies to secure Explosive
Ordnance Disposal services. The frequency of incidents within Contra Costa County requiring
the specialized services of an EOD unit has not justified the establishment of such a Unit within
Contra Costa County Sheriffs Office. As such, contracting for the services of a unit of trained
and certified personnel specializing in EOD operations is an effective and efficient use of
resources.

RECOMMENDED ACTION:
AUTHORIZE the Acting County Librarian to execute a Short Form Service Contract Agreement with
Jerome J. Prideaux for County Library Facilities and Special Projects Consultation for the period of
March 1, 1999 through December 31, 1999,
FINANCIAL IMPACT:
The additional cost of $39,780 for this service is included in the FY 1998-99 budget for the County
Library.
BACKGROUND:
Consulting services are needed to provide technical assistance to the library on special projects
including the Dougherty Valley Library Project, Library Capital Facilities Long Range Plan and Library
Ballot Measure Planning. Direct the preparation and submission of the FY 1999-00 County Library
Budget; participate in employer-employee negotiations with unions for new contract, assist in the
training of new Administrative Services Officer.
The Contract includes consultation needed by the County Library on library facilities projects including
capital and maintenance. Consultant will authorize and monitor maintenance and capital projects
approved in the Library Facilities Plan for FY 97-98 and all work approved for FY 98-99, As needed,the
approved list of maintenance projects will be adjusted to meet current needs. Capital projects will be
managed as assigned by the Acting County Librarian, Work of the consultant will include such
assignments as initially meeting with county and other interested parties to determine scope and
participation of the parties in the project, negotiation and preparation of applicable operating
agreements; participation in design work on projects; review of work in progress; progress payments;
and final approval of the project.

3. Terra. The effective date of this Contract is March 1, 1999 and it terminates December 31, 1999 unless

5. Payment Limit. County's total payments to Contractor under this Contract shall not exceed$39,760.

8. Compliance with Law. Contractor shall be subject to and comply with all Federal, State and local laws
and regulations applicable with respect to its performance under this Contract, including but not limited to,
licensing, employment and purchasing practices; and wages, hours and conditions of employment,

9. Nondiscriminatory Services. Contractor agrees that all goods and services under this Contract shall be
available to all qualified persons regardless of age, sex, race, religion, color, national origin, or ethnic
background, or handicap, and that none shall be used, in whole or in part, for religious worship or
instruction.

SHORT FORM CONTRACT Number:
10. Independent Contract Status. This Contract is by and between two independent contractors and is not
intended to and shall not be construed to create the relationship between the parties of agent, servant,
employee,partnership,joint venture,or association.
11. Disputes, Disagreements between the County and Contractor concerning the meaning, requirements,or
performance of this Contract shall be subject to final determination in writing by the head of the County
Department for which this Contract is made or his designee or in accordance with the applicable
procedures(if any) required by the State or Federal Government.
12. Access to Books and Records of Contractor.Subcontractor. Pursuant'to Section 1 869 (v) (1) of the
Social Security Act, and any regulations promulgated thereunder, Contractor shall, upon written request
and until the expiration of four years after the furnishing of services pursuant to this Contract, make
available to the Secretary of Health and Human Services,the Comptroller General, the County, or any of
their duly authorized representatives,this Contract and books, documents and records of Contractor that
are necessary to certify the nature and extent of all costs and charges hereunder. Further, if Contractor
carries out any of the duties of this Contract through a subcontractwith a value or cost of$10,000 or more
over a twelve-month period, such subcontract shall contain a clause to the effect that upon written request
and until expiration of four years after the furnishing of services pursuant to such subcontract, the
subcontractor shall make available,to the Secretary,the Comptroller General, the County, or any of their
duly authorized representatives,the subcontract and books, documents, and records of the subcontractor
that are necessary to verify the nature and extent of all costs and charges hereunder.
This special condition is in addition to any and all other terms regarding the maintenance or retention of
records under this Contract and is binding on the heirs, successors, assigns and representatives of
Contractor,.
13. Reporting Requirements. Pursuant to Government Code §7550, Contractor shall include in all
documents or written reports completed and submitted to County in accordance with this contract, a
separate section listing the numbers and dollar amounts of all contracts and subcontracts relating to the
preparation of each such document or written report. This section shall apply only if the payment limit
under this Contract exceeds$5,000.
14. indemnification. The Contractor shall defend, indemnify, save, and hold harmless the County and its
officers and employees from any and all claims, costs and liability for any damages, sickness, death, or
injury to person(s) or from or connected with the operations or services of the Contractor or its agents,
servants, employees or subcontractors hereunder, save and except claims or litigation arising through the
sole negligence or sole willful misconduct of the County or its officers or employees. Contractorwill make
good to and reimburse the County for any expenditures,including reasonable attorneys fees, the County
may make by reason of such matters and, if requested by the County will defend any such suits at the
sole cost and expense of the Contractor.
15. Leal Authority. This Contract is entered into under and subject to the following legal authorities:
California Government Code Sections 26227 and 31000.

Withholding and FICA [deductions Addendum
Withholding and FICA Deductions: Notwithstanding Paragraph 10. (Independent
Contractor Status) of the Short Form Service Contract (Paragraph 14. of the General
Conditions), for the purposes of withholding State and Federal taxes and Social Security
only from payments due, the Auditor-Controller will make deductions for these purposes.
Contractor is not a County employee. Contractor further understands that the County has
no obligation to provide, and Contractor will not be provided fringe benefits, including but
not limited to, vacation, sick leave, retirement, and health plan coverage. The County will
provide worker's compensation coverage and unemployment insurance if County has right
to control way in which work is done.
