RECOMMENDATION:
APPROVE the refitnd of overpayment of transfer tax and AUTHORIZE the County Auditor-
Controller to issue warrants in the amount and to the parties listed.
BACKGROUND:
The County Recorded, having advised that funds to cover the payment of the Documentary
Transfer Tax when recording certain grant deeds have deposited in excess of the amount required
under the law, and having requested that the County Auditor-Controller be authorized to issue
warrants refunding the following amounts:

To Whom 1t May Concern:
on july 9 1998 a grant deed was recorded on my property located at parcel
118 1.50 033 in concord. We were granting out of our revocable trust and to
ourselves as ioint tenants. Moving property from a revocable trust to the
same .individuals in not a taxable transaction. `-"here are no new owners so
no tax applies. At the time the deed was recorded, the co"nty was paid
$126.58 for the tax. 1t was not due. Therefore, a refund is requested with
interest at this time.

Dear Barbara,
It is any belief that we should no be subject to the tax we paid to record the two deeds attached,
and would request a refund, season.
Lucinda Ely and my corporation purchased the lots, and intended from the beginning to each
own a lot. However, the bank wanted both of us on the title together to make the initial loan
since a structure on one parcel hangs over the lot line and we are going to have to do a lot-line
adjustment to correct the problem.. So, we took title together with the intent of immediately
transferring each ether's interest to each other. The initial transfer of title took place on
February 9, and we recorded the correction deeds on February 10, one day later. It is obvious
that this was/planned from the start, as the correction deeds were notarized on February 4,
before we even took title.
It seems to me that the intent of the transfer tax is to tax an actual exchange of ownership. Our
transaction was clearly only done this way for administrative purposes, and only truly
represents one transfer of title, not two.
A sketch and copies of the second deeds are attached.
