LEGAL SERVICES SPECIFIC REQUESTS) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECQMMENDATTQNS APPROVE, and AUTHORIZE County Counsel to execute, an amendment to correct a clerical error in a legal services contract with Crosby, Heafey, Reach and May. BACKGROTj_ND/REASONS FOR OMMENDATTONS On December 1, 1998, the Board approved a contract for legal services to fallow and continue an earlier purchase order legal services contract executed for the initial handling of the Lucy Sales v. County of Contra Costa case. The purpose of the contract approved by the Board on December 1, 1998 was to enter into a longer term contract which would pick up where the limited amount contract left off so that the representation would be continuing. Additionally, the new contract also assigned to the Crosby firm the case Wilkes v. County of Contra Costa case for representation of Dave Dornaus n post trial motions and appeal following an adverse verdict which included punitive damages . A clerical error occurred due to the failure to appreciate that the purchase order contract had been :dully consummated by October 1, 1998 and not by the December 20, 1998 date provided by the December 1s} approved legal services contract . The purpose of this amendment that County Counsel is recommending is to correct that error by amending the beginning date of the December lit approved contract to be the date that initial purchase order contract was fully consummated so that the attorneys may be paid for their work on and after October 1, 1998 . The only change contemplated by this amendment is to change the start date for the legal services contract from December 20 , 1998 to October 1, 1998 . All other terms remain the same. Authorize the Health Services Director to contract with St. Vincent de Paul for up to $25,000 to help fund staff for the rotating church-based family shelter in central and east county. 2. Direct the Health Services Director to negotiate with St. Vincent de Paul an appropriate scope of work for the contract. 3. Direct the Health Services Director to work with the Greater Richmond Inter-faith Project and other appropriate agencies in west county to identify how the County Homeless Programs can support emergency and transitional family housing programs in west county. BACKGROUND: St. Vincent de Paul in collaboration with the FERST Advisory Board and the Inter-faith Rotating Steering Committee is operating a Rotating Emergency Family Shelter in central county for the second year. St. Vincent de Paul and the Inter-faith organizations would like to expand the rotating shelter program into east county, and also increase the number of weeks this winter and spring that the family shelters are operating. St. Vincent de Paul has provided a program budget to the County Homeless Program for east and central county rotating shelters, which has been reviewed by the Inter-faith Steering Committee. That budget identifies over$44,000 in cash which has been contributed by the faith community organizations, as well as extensive in-kind contributions from the faith community,including food and other living sundries and supplies. St. Vincent de Paul has also identified$13,000 of FEMA funding in the budget, and approximately$73,000 contributed by St. Vincent de Paul in staffing, supplies, and in-kind support services. St. Vincent de Paul and the Inter-faith Steering Committee are asking for $25,000 from the County to supplement an additional $54,000 which they are providing to support paid staff working with the volunteers for the Rotating Shelter Program. The staffing pattern identified in the budget is reasonable and is similar to the staffing pattern used by the Greater Richmond Inter-faith Program for the rotating west county shelter. The Health Services Homeless Program believes that the program is very valuable and the budget presented is reasonable and realistic. We would contract with St. Vincent de Paul as the fiscal agent for up to the full $25,000, depending upon the ability of the Rotating Shelter Program to open in east county and to continue through the end of May as projected. As the total amount contracted would be$25,000 or less,no further Board action would be required to finalize the contract. FISCAL IMPACT: Cost to the County General Fund would be up to $25,000. CONSEQUENCE OF NE ATIVE ACTION: Failure to financially support this faith-based family shelter would greatly diminish the possibility of opening this largely volunteer-supported family shelter program in east county this year.
