Adopt a position in support of Assembly Bill 2222 (Hertzberg)which would change conditions for
radar enforcement of speed limits.
FISCAL. IMPACT
If enacted, AB 2222 could have a positive fiscal impact because it would reduce the frequency of
conducting engineering and traffic surveys on numerous roadways throughout the County, and
thereby reduce costs for the Public Works Department in preparing such surveys.

Existing law defines a "speed trap" as, among other things, a particular section of highway or
roadway with a prima facie speed limit, as specified,that is not justified by an engineering and traffic
survey conducted in 5 years prior to the date of an alleged violation, if enforcement of the speed limit
involves radar or any other electronic device that measure speed of moving object. As proposed
in AB 2222 (see attached) conditions for radar enforcement of speed limits would be changed in
the following manner:
1) Clarifies that an engineering and traffic survey is not needed for the enforcement of
maximum speed at a "school zone";
2) Provides for a longer period, up to 10 years, instead of the current five years,when a survey
can be used as justification for the speed limit if specific and stringent criteria are followed.

Radar enforcement is one of the most efficient means available to law enforcement for citing
violators of the speed limit. Under current law, radar cannot be used to enforce the speed law unless
the posted speed for the street is based on an engineering and traffic survey performed within 5
years. It is noted that the Public Works Department has received numerous and frequent
complaints from residents irate about speed limits that were raised on roadways in unincorporated
communities because of new speeds observed in the survey. The Transportation Committee
recommends the Board of Supervisors support AB 2222 because it would likely result in savings for
the Public Works Department in reducing the frequency of conducting such surveys in the
unincorporated areas by extending the applicable period of a survey from five to ten years, and it
would clarify that surveys are not needed to enforce the maximum speed at a'designated "school
zone".
