Recommended Action: APPROVE and AUTHORIZE William R. Gray and Company, as General Manager of the Canyon Lakes Geologic Hazard Abatement District(GRAD),to execute a professional service contract for $30,040 with Sands Construction,Lafayette,California,effective on July 1, 1998 to provide Construction and Maintenance Superintendent services to the District. TI. Financial Imvact: No impact on the County General Fund. The Canyon Lakes GRAD is funded through annual assessments levied on property owners within the District. The proposed contracts are consistent with the proposed FY 98/99 program budget. IIt. Reasons for Recommendations and Background: The Board of Directors of the Canyon Lakes GHAD retained William R. Gray and Company,effective April 1, 1998,to serve as General Manager of the CHAD. Mike Sands,President of Sands Construction,has been serving as the Construction and Maintenance Superintendent for the Canyon Lakes GHAD for approximately five years. Mr.. Sands has extensive experience in responding to and assisting the GHAD with the repair of landslides and landslide related work in Canyon Lakes and the surrounding area. Given the significant number of landslides and slip-outs that the CHAD frust respond to as a result of El Nina,time did not permit a more formal Request for Proposal(RFP)process. Given Mr. Sand's history and experience with the CHAD,District staff recommends that Sands Construction Company, Inc.,continue to be retained to act as the Construction and Maintenance Superintendent for the Canyon Lakes CHAD. The proposed contract has an effective date of July 1, 1998 and a termination date of June 30, 1999 IV. Consequences of Negative Action: Because of the number of landslides and an extremely short construction season,the GHAD will not be able to repair all of the landslides if this contract is not approved. r TO: BOARD OF SUPERVISORS, AS THE GOVERNING BODY OF THE FLOOD CONTROL & WATER CONSERVATION DISTRICT FROM: J. Recommended Action: 1. ADOPT the attached Resolution to apply for reissuance of the Municipal; tormwater NPDES Permit and ACCEPT and ADOPT the Contra Costa Clean Water Program Stonnwater Management Plan for 1998-2003; 2. AUTHORIZE the Chief Engineer to execute a program agreement with the County and its eighteen incorporated cities to jointly administer the Contra Costa Clean Water Program for the period July 1, 1998 through the life of the Program, or until such time as the agreement is terminated or amended. II. Financial Impact: None to the General Fund. The Flood Control District's participation in the Contra Costa Clean Water Program is funded with Flood Control District revenues. SECOND JOINT MUNICIPAL NPDES PERMIT APPLICATION, 1998-2003 &,CONTRA COSTA CLEAN WATER PROGRAM AGREEMENT, COUNTYWIDE JULY 14, 1998 PAGE - 2 - Reasons for Recommendations and Baftround: The Flood Control District is completing implementation of its first five year Municipal Stormwater National Pollutant Discharge Elimination System(NPDES)Permit and has developed,in coordination with the other nineteen (19) co-permittees, a Stormwater Management Plan for submittal to the State for reissuance of the Permit. This Permit is federally mandated through the Clean Water Act which was amended in 1987 to specifically address stonnwater pollution. The Permit's goal is to stop the discharge of pollution from storm drain systems. Adoption of this Resolution will begin the formal application process with the San Francisco and Central Valley Regional Water Quality Control Boards for reissuarice of the Permit. Adoption of the Resolution on July 14, 1998 is essential. The Contra Costa Clean Water Program Manager plans to submit the Resolutions from the Flood Control District and the other co-permittees to the State on July 16, 1998. The San Francisco Regional Water Quality Control Board asked for the submittal several months ago. Because the Permit requires co-permittees to work together as one program,the Board of Supervisors is also being asked to authorize execution of a Contra Costa Clean Water Program Agreement (Program Agreement). Together the Flood Control District, County, and its 18 incorporated cities form the Contra Costa Clean Water Program. The Program Agreement outlines the organizational framework of the joint Clean Water Program, responsibilities of Group Program staff and of participating agencies, and cost allocation of the Group Program to the participating agencies. This Board Order is requesting the Board of Supervisors to authorize the Flood Control District to enter into the Program Agreement as a participating agency.The Program Agreement encourages consistency between the different agencies' activities,enables Group Program staff to represent agency members at State and other governmental meetings,and provides for joint activities such as monitoring and payment of Permit fees. Specific tasks to be performed by the participating agencies and Group Program staff are outlined in detail in the Stormwater Management Plan. The Board of Supervisors approved a similar Program Agreement in 1993 for the first Permit. At that time, the agreement included both program and cost payment components. During revisions of the Program Agreement,most of the cost payment component was removed and will be sent separately as a stand alone agreement to the Board of Supervisors at a later date. The central and substantive core of the application is the Stormwater ManWAM-eii—t Plan. It is an exhaustive list of tasks the Flood Control District plans to undertake during the next five years to prevent,reduce and/or eliminate the discharge of pollution from the storm drain system. The tasks include: 1) Inspection and regulation of commercial and industrial operations,with a strong focus on new development and construction; 2) In-house maintenance activities of the Public Works and General Services departments; 3) Public education outreach to explain storniwater pollution and to encourage voluntary pollution prevention; 4) Controls on illegal dumping; 5) Monitoring activities to determine the effectiveness of various pollution prevention and reduction practices; and 6) Watershed management activities that will involve both citizens and government agencies. Many of the tasks were begun under the Stormwater Management Plan for the first five year permit. Other tasks, such as watershed management activities, are new. SECOND JOINT MUNICIPAL NPDES PERMIT APPLICATION, 9998-2003 &CONTRA COSTA CLEAN WATER PROGRAM AGREEMENT, COUNTYWIDE JULY 14, 1998 PAGE - 3 - The Stormwater Management Plan has undergone some public review.It will be more thoroughly reviewed during the Permit reissuance application period that requires a formal public hearing process. The proposed Stormwater Management Plan and Annual Reports summarizing Flood Control District and otherco- permittees accomplishments are available for review in the Public Works department. The Annual Report is submitted each year in September to the Regional Water Quality Control Boards. Both documents are several hundred pages long. IV. Consequences of Negative Action: The Flood Control District will most likely be found not in compliance with the Federal Clean Water Act. Administrative fines by the Regional Water Quality Control Boards for non-compliance can be in the thousands of dollars per day. THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY,CALIFORNIA AS THE GOVERNING BODY OF CONTRA COSTA COUNTY FLOOD CONTROL &WATER CONSERVATION DISTRICT Adopted this Resolution on July 14, 1998 by the following vote: AYES: Supervisors U lkerta, Gerber, DeSaulnier, Canciamilla, and Rogers NOES: Nome ABSENT: None ABSTAIN: Nene RESOLUTION NO.98/ 370 SUBJECT: APPLICATION FOR REISSUANCE OF THE FLOOD CONTROL DISTRICT'S MUNICIPAL STORMWATER NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT and TO ACCEPT AND ADOPT THE CONTRA COSTA CLEAN WATER PROGRAM STORMWATER MANAGEMENT PLAN FOR 1998-2003 WHEREAS, the U.S. Environmental Protection Agency, under amendments to the 1987 Federal Clean Water Act, unposed regulations :mandating local governments to reduce to the maximum extent practicable the amount of pollutants in stormwater discharged from municipal storm drain conveyance systems; and, WHEREAS, the San Francisco Bay and Central Valley Regional Water Quality Control Boards have specifically required all municipalities in Contra Costa County to have municipal stormwater NPDES permit coverage; and, WHEREAS,under the authority of California Porter-Cologne Water Quality Act,the State Water Resources Control Board and its regional boards have been delegated the authority to adopt NPDES permits and waste discharge requirements for municipal stormwater discharges; and, WHEREAS, in April 1991, the San Francisco Bay and Central Valley Regional 'Nater Quality Control Boards notified all municipalities in Contra Costa County of the requirement to submit a NPDES Permit Application by May 17, 1993; and, WHEREAS, the San Francisco Bay Regional Nater Quality Control Board adopted a municipal stormwater NPDES permit CA0029912 and waste discharge requirements for all municipalities within its jurisdiction in Contra Costa County on September ,15, 1993; and, the Central Valley Regional Water Quality Control Board adopted a municipal stormwater NPDES permit CA0083313 and waste discharge requirements for all municipalities within its jurisdiction in Contra Costa County on January 28, 1994 with both permits remaining in effect for five years; and, WHEREAS,the adopted NPDES permits require all affected municipalities in Contra Costa County to apply for reissuance of their municipal stormwater NPDES permits by the San Francisco Bay Regional Water Quality Control Board on September 15, 1998 and the Central Valley Regional Water Quality Control Board on January 1, 1999; and, RESOLUTION NO. 981 370 Application for Reissuance of Municipal Stormwater NPDES Permit and Adoption of Contra Costa Clean Water Program Stormwater Management Plan.for 1998-2003. NOW,THEREFORE,BE IT RESOLVED by the Contra Costa County Flood Control and Water Conservation District that 1. The Contra Costa County Flood Control and Water Conservation District hereby agrees to apply to the San Francisco Bay and the Central Valley Regional Water Quality Control Board(s) for reissuance of its municipal stormwater NPDES permit(s)to discharge water from its municipal storm drain system, and 2. A description of the offered area to be terminated is described in Exhibit"A" and shown on Exhibit "B" attached hereto and is located in the Byron area. This termination of an offer of dedication is for a sanitary sewer easement which was dedicated less than five years, and more than one year, immediately preceding the proposed termination, and the easement was not used continuously since that date.
