RECOMMENDED ACTION: AUTHORIZE the Community Services Director or designee to execute and submit to the California Department of Community Services and Development 1997 State Standard Agreement #97ECF-177, Amendment No. 2 (County #39-847-2) to change the term of the 1997 Low-Income Home Energy Assistance Program/Weatherization Emergency Contingency Funds contract period from January 1, 1997 through December 31, 1997 to January 1, 1997 through April 30, 1998. II. FINANCIAL IMPACT: This Contract is Federally funded through the California Department of Community Services and Development. The maximum reimbursable amount does not increase with this extension. No County funding is required. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: On June 17, 1997, the Board approved the 1997 Low-Income Home Energy Assistance Program/Weatherization Emergency Contingency Funds (ECF) State Standard Agreement with the California Department of Community Services and Development (State) for a maximum reimbursable amount of $136,815 to provide emergency weatherization assistance, Home Energy Assistance Program (HEAP), and Energy Crisis Intervention Program (ECIP) assistance to eligible county individuals and families for the period from January 31, 1997 through December 31, 1997. In order to facilitate this requirement, existing contracts must be extended. Approval of this amendment will allow the County to use approximately $27,320 in unspent ECF dollars, which previously would have been returned to the State. Funding will be used to continue emergency weatherization assistance, Home Energy Assistance Program (HEAP), and Energy Crisis Intervention Program (ECIP) assistance to eligible county individuals and families throughout Contra Costa County. RECOMMENDED ACTIt}N: APPROVE and AUTHORIZE the Community Services Director or designee to execute and submit to the California Department of Community Services and Development State Standard Agreement #97F- 1710 Amendment No. 1 (County #39-835-4) to increase the maximum reimbursable amount by $8,000 for a new total Contract Payment Limit of $63,000 and to change the contract term from April 1, 1997 through May 31, 1998 to April 1, 1997 through September 30, 1938. II. FINANCIAL IMPACT: No County funding is required. Funding is from the California Department of Community Services and Development. Funding through June 30, 1998 will be added to the Department's Fiscal Year 1997.98 budget via appropriation adjustment. Funding from July 1, 1998 through September 30, 1998 will be reflected in the Department's Fiscal Year 1998-99 budget. 111. CHILDREN'S IMPACT STATEMENT: The Community Services Department Mentoring Collaborative supports two of Contra Costa County's community outcomes: "Children Ready for and Succeeding in School" and "Children and Youth Healthy and Preparing for Productive Adulthood." This program was 'created with the specific mission to provide support and ,guidance to low-income youth in at-risk conditions through adult volunteer mentors. Desired goals are to reduce alcohol/drug use, teen pregnancy, educational failure, gang participation, and violence. On that same day, the Board also approved four sub-contracts with community-based organizations to provide mentoring services to a total of forty (40) at-risk youth. Each subcontractor agreed to match ten (10) at-risk youth with ten (10) adult volunteer mentors. Agreement No. 98-0010 Page 3 AMENDMENT/CANCELLATION This agreement may be amended upon written mutual consent, or cancelled by either party, upon thirty (30) days written notice unless otherwise stated. AMERICANS WITH DISABILITIES ACT By signing this contract, Contractor assures the state that it complies with the Americans with Disabilities Act (ADA) of 1990, (42 U.S.C, 12101 et seq.), which prohibits discrimination on the basis of disability, as well as all applicable regulations and guidelines issued pursuant to the ADA. APPROVAL This contract shall not be considered effective until signed by both parties and approved by the Department of General Services if required (State Administrative Manual Sections 1215 and 1216). AUDIT It is hereby mutually agreed that Contractor shall be subject to the examination and audit of the State Auditor for a period of three years after final payment under this agreement (Government Code Section 8546.7). The examination and audit shall be confined to those matters connected with the performance of this contract including; but not limited to the cost of administering the contract. BUDGET ACT It is mutually agreed that if the Budget Act of the current year and/or any subsequent years covered under this agreement does not appropriate sufficient funds for the program, this contract shall be of no further force and effect. In this event, the State shall have no liability to pay any funds whatsoever to the Contractor or to furnish any other considerations under this contract, and the Contractor shall not be obligated to perform any provisions of this contract. DISPUTES Any dispute concerning a question of fact arising under the terms of this agreement which is not disposed of within a reasonable period of time(ten days) by the Contractor and State;employees normally responsible for the administration of this contract shall be brought to the attention of the Chief Executive Officer(or designated representative) of each organization for joint resolution(Public Contract Code Section 22200 and California Code of Regulations, Title 1, Section 300 et seq.). INVOICES AND PAYMENTS The Contractor shall render invoices for total monthly or quarterly charges in the month or quarter following the month or quarter for which the charges accrue. Invoices will be submitted in triplicate. Allow up to sixty(60) calendar days for payment of invoices. 88.04-PE,(Rev. (/46) (2) Agreement No. 98-0010 Page 4 DRUG FREE WORKPLACE CERTIFICATION By signing this contract, the contractor or grantee hereby certifies, under penalty of perjury under the laws of the State of California, that the contractor or grantee will comply with the requirements of the Drug-free Workplace Act of 1990(Government Code Section 8350 et seq.) and will provide a drug- free workplace by taking the following actions: I) Publish a statement notifying employees that unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited and specifying actions to be taken against employees for violations. 2) Establish a Drug-Free Awareness Program to inform employees about all of the following: a) the dangers of drug abuse in the workplace; b) the person's or organization's policy of maintaining; a drug-free workplace; C) any available counseling, rehabilitation and employee assistance programs; and d) penalties that may be imposed upon employees for drug abuse violations. 3) Provide that every employee who works on the proposed contract will: a) receive a copy of the company's drug-free workplace policy statement; and, b) agree to abide by the terms of the company's statement as a condition of employment on the contract. Failure to comply with these requirements may result in suspension of payments under the contract or termination of the contract or both, and the contractor or grantee may be ineligible for award of any future state contracts, if the department determines that any of the following has occurred: (1) the contractor or grantee has made false certification, or(2) violates the certification by failing;to carry out the requirements as noted above. NONDISCRIMINATION CLAUSE (OCP-1) During the performance of this contract, contractor and its subcontractors shalt not unlawfully discriminate, harass or allow harassment, against any employee or applicant for employment, because of sex, race, color, ancestry, religious creed, national origin, physical disability(including HIV and AIDS), mental disability, medical condition(cancer), age(over 40), marital status, and denial of family care leave. Contractor and subcontractors shall insure that the evaluation and treatment of their employees and applicants for employment are free from such discrimination and harassment. Contractor and subcontractors shall comply with the provisions of the Fair Employment and Housing Act (Government Code Section 12990(a-f)et seq.)and the applicable regulations promulgated thereunder(California Code of Regulations, Title 2, Section 7285.0 et seq.). The applicable regulations of the Fair Employment and Housing Commission implementing Government Code Section 12990 (a-f), set forth in Chapter 5 of Division 4 of Title 2 of the California Code of Regulations, are incorporated into this contract by reference and made a part hereof as if set forth in full. Contractor and its subcontractors shall give written notice of their obligations under this clause to labor organizations with which they have collective bargaining or other agreement. FINANCIAL IMPACT: Matching funds are made available by Project Second Chance, Inc. The Library's costs will include staff time for administration, and delivery of books purchased with RIF funds. The Library will also provide administrative and clerical support and space. BACKGROUND: Funds have been made available through Reading Is Fundamental,Inc. for the past five years, with matching funds supplied by Project Second Chance, Inc. This project allows the Contra Costa County Library, its literacy program, Project Second Chance and its Families for Literacy program, to provide inexpensive, age- appropriate books to children in selected Head Start Programs in Central and East Contra Costa County; in order to encourage reading readiness skills and appreciation for books, for children not included in Families for Literacy funding. Examples of activities include: 1. Training Head Start parents in methods specific to enhancing parent's skills as their children's first teachers. 2. Providing inexpensive,age-appropriate books for Head Start children to select and keep. 3. Issuing institutional library cards to Head Start Programs and introducing the library to Head Start families to make it less intimidating and more accessible to them. 4. Cooperating with Head Start Programs at Head Start sites including:Cambridge, Lavonia Allen, George Miller, Sunset, and Los Nogales; as well as the Home Base program in Contra Costa County. FISCAL IMPACT: This Contract is funded by County Mental Health Realignment (offset by 50k reimbursement from the County Social Services Department) .' CHILDREN'S IMPACT STATEN': The Contract between Contra Costa County childrens " Mental Health and Edgewood Center for Children & families support. three of Contra Costa County' s community outcome: 1) "Childrenready for and succeeding in school" , 2) "Families that are safe, stable and nurturing" , and 3) "Communities that are safe and provide a high quality of life for children and families.
