Richter, Fire Chief � ' C oda DAT : June 2, 1998 CO^ SUBJECT: Fire Service Master.Mutual Aid Agreement - Contra Costa County Fire Protection District and Concord Naval Weapons Station SPEC I r I C R 0==ST(s cia aECE'MMEMAT I ON(S) a SACHrROUND AIS JUST I V I CATION RECOMMENDATION AUTHORIZE the Chair, Board of Supervisors, as the Chair of the Board of Directors of the Contra Costa County Fire Protection District to execute an updated Fire Service Mutual Aid Agreement between the Contra Costa County Fire Protection District and the Concord Naval Weapons Station. BACKGROUND/REASONS FOR RECOMMENDATION: The present Mutual Aid Agreement dated May 15, 1990, between Consolidated and Riverview Fire Districts and the Concord Naval Weapons Station needs to be updated to reflect organizational changes and revised fire service operetionalfinformational directives. The general County Fire Service Mutual Aid updated agreement adopted by the Beard of Supervisors, September 9, 1997, has been used as the basis for the attached agreement with the Concord Naval Weapons Station. This revised and updated agreement will be signed by Capt. Bruno, Officer In Charge. Terms and format follow the general County Fire Service Mutual Aid Agreement and are consistent with past mutual agreements. The new agreement also recognizes the expanded role of fire mutual aid services beyond basic fire suppression to include other responsibilities such as emergency medical response, vehicle accidents and heavy rescue. It should be noted that the role of either party is not expanded as the result of nuclear fuel rod shipments. CONTRA COSTA COUNTY FIRE SERVICE MUTUAL AID AGREEMENT 1. PARTIES. This Agreement dated , is between these parties in this County (see Sec. 15): (a) Contra Costa County Fire Protection District (Health and Safety Code Section 13801 ff.), and (b) the Concord Naval Weapons Station Fire Department, Weapons Support Facility Seal Beach Detachment Concord (by the Officer in Charge). 2. PURPOSES. Conditions providing the potential for widespread, large fires, or depleted fire protection resources which constitute hazards to life and property can occur within the County. When the fire protection and other emergency resources of any one fire protection agency are depleted, the combined resources of several such fire agencies may be required to provide a necessary level of fire and other emergency protection capabilities within an affected jurisdiction. These parties desire to, and shall whenever possible and when so requested, furnish emergency assistance to one another in accordance with the provisions herein, and in conformance with the California Emergency Services Act, the California Mutual Aid Agreement, the California Emergency Services Plan, the Contra Costa CountyEmergency Services Plan, and Fire Service Information Bulletins. 3. REOUESTS FOR MUTUAL AID. To insure orderly and coordinated use of resources, all requests for this mutual aid shall be made to the Fire Mutual Aid Area Coordinator, as elected and designated by the Contra Costa 'County Fire Chiefs Association, and as recorded in the Contra Costa County Emergency Services Plan, Emergency Fire Service Supporting Plan and related fire service bulletins. Any party's Fire Chief (or in the Chiefs absence, the ranking assistant) may request assistance of equipment and/or personnel when, in the Chiefs opinion, the emergency resources are insufficient to cope with the existing fire(s) and/or emergency(les) and provide for a minimum operating reserve. Alerts to the Fire Mutual Aid Coordinator shall be made when, in the opinion of any party's Fire Chief, or designated representative, the potential of need for mutual aid exists. When any party's Fire Chief or designated representative determines that only limited assistance may be needed, the Agency may directly request mutual aid from another fire agency with notification to the County Area Fire Mutual Aid Coordinator. 4. RESPONSE TO REQUEST. The Fire Chief or designated representative from whom mutual aid is requested shall comply with the request wholly or in part when; (a) The specific assistance requested is clearly referred by the Fire Mutual Aid Coordinator, or is directly requested by a Fire Chief or designated representative in a limited situation; and (b) Compliance will not deplete resources below the level needed to cope with known or anticipated hazards in the responding jurisdiction. 5. LIMITATION ON REQUESTS. It is not the intent of the Contra Costa County Mutual Aid Plan to provide "day-to-day", full and continuing fire and other emergency protection to an affected jurisdiction. The affected jurisdiction shall have committed its fire protection resources prior to requesting mutual aid. However, local agencies may supplement day-today emergency fire and rescue operation on an automatic aid basis without restriction of jurisdictional boundaries. The affected jurisdiction shall make every effort to release responding mutual aid or automatic aid resources as soon as possible. G. ASSISTANCE NOT MANDATORY. The rendering of mutual aid hereunder shall not be mandatory, but the party receiving the requestfor assistance shall immediately inform' the party requesting service if, for any reason, assistance cannot be rendered. 7. NO COMPENSATION. All services rendered under this Agreement shall be performed without reimbursement to the participating party or parties hereto, in consideration of their mutual promises and services; each party shall bear its own costs hereunder. Except that the Contra Costa County Fire Protection District shall be entitled to seek reimbursement pursuant to Section 11 of the Federal Fire Prevention and Control Act of 1974 (15 U.S.C. 2210) and Federal Regulations Part 151) for all or any part of direct expenses and losses (additional fire fighting or emergency assistance costs over and above normal operating costs) incurred in fighting fires on property under the jurisdiction of the United States. However, nothing herein precludes any party from claiming from any other agency not a party to this Agreement such payment or reimbursement to which it may be legally entitled to. 8. WAIVER. Subject to the provisions of Government Code 1850.6, each party hereto waives all claims against any other participating party for compensation for any loss, damage, personal injury, or death which may arise due to conformance, or lack of conformance, under this Agreement. 9. EFFECTIVE DATE. This Agreement supersedes the prior Fire Service Mutual Aid Agreement of May 15, 1990 and becomes effective as to each party when signed by the person authorized by its respective governing body and filed with the Clerk of the Board of Supervisors with a certified copy of the authorizing minute, order or resolution. Any fire protection agency not listed in Section 15 may become a party, to this Agreement by an amendment hereto including it as a party, effective when approved by all other parties. 10. NOTICE OF PARTIES. Upon receipt of a certified copy of the minutes, order or resolution authorizing or terminating a party's participation in this Agreement, the Clerk of the Board of Supervisors shall so notify the Fire Mutual Aid Coordinator in writing, who then shall immediately so notify the governing bodies of all other parties in Section 15(a) and (b). 11. TERMINATION. Any party may terminate its participation in this Agreement by filing, with the Clerk of the Board of Supervisors (with copies to the governing bodies of all parties listed in Section 15(a) and (b), a ;certified copy of the resolution of termination adopted by its governing body. Such termination shall be effective 30 days after the last such filing, unless all parties mutually agreed in advance to make it effective immediately upon the filing of said resolution or at some other time. 12. DIRECTION OF WORK. Except as provided in Section 13, the Fire Chief or designated representative of the requesting party has authority and responsibility to assign and direct resources made available hereunder by other parties. 13. INSUFFICIENT RESOURCES COUNTYWIDE. Except as provided herein, when the resources of all parties are committed to the extent available, but are found to be insufficient to cope with the emergency condition, the Fire Mutual Aid Coordinator has the authority and responsibility for overall fire service coordination, procurement and assignment of fire and emergency resources, and is also responsible for obtaining additional assistance through the Regional Fire Mutual Aid Coordinator and/or adjacent County Operational Fire and Rescue Coordinators. 14. RECORDKEEPING. When mutual aid is provided, the requesting and assisting agencies should keep account records of the personnel, equipment, and materials as required by Federal and State and FEMA guidelines to maximize the possibility of Federal and State disaster reimbursement. Each participating agency shall have access to the other parties' records for this purpose. 15. PARTIES ELIGIBLE TO PARTICIPATE. This agreement shall not be construed as, or deemed to be an agreement for the benefit of any third party or parties, and no third party or parties shall have a right of action hereunder for any cause whatsoever. 16. Each participant's assent to this agreement is evidenced by signature on the attached individual signature pages, i.e., each fire entity governing board or designated representative will execute a separate signature.
