Griffith, Building Inspector I DATE: May 26, 1998 SUBJECT: Appeal of Abatement Action at 3827 Camino Andres. , Bay Point APN# 098-230-014 SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: After hearing the appeal , it is recommended to deny the appeal and affirm the determinations of the County Abatement Officer and direct the County Abatement Officer to proceed and perform the work of abatement. FISCAL IMPACT: None if voluntary compliance. The cost to the County could be approximately $22,000.00 if owner does not voluntarily abate. BACKGR©UNDfREASONS FOR RECOMMENDATIONS: On July 16, 1996 the Building Inspection Department began an investigation regarding open, abandoned structures. The property owner was duly notified by the Building Inspection Department and given options and measures of correction. The property remained in a constant state of despair. As excessive amounts of time passed the property became a dumping ground violating the Contra Costa County Junkyard Ordinances. An attempt at securing the structures has been made on several occasions, the last being on February 15, 1998. This method has proven unsuccessful and the structures have been re- entered and are presently unsecured. On February '13, 1998 the Building Inspection Department recorded a "Notice of Violation" on the parcel at 3827 Camino Andres, Bay Point. On May 6, 1998 the same parcel was pasted with a "Notice and Order To Abate" declaring the property a Public Nuisance under CCC Ordinance Title 7, Section 712-2.002 & 712-X2.004 and the Uniform Housing Code Section 1001 Substandard Building. Staff recommends that it be directed to proceed' and perform the abatement. Ogden Lilly from the decision of the County Abatement Officer declaring a public nuisance on property located at 3827 Camino Andres, Bay Point, Castlewood Properties, Inc., owner. Tim Griffith, Building Inspection Department, presented the staff report. He commented that Mr. Lilly was currently in the process of gettingbids for the asbestos removal, and did not yet have a timetable for the work. The hearing was opened, and appellant Ogden Lilly, 1760 The Alameda, Suite 100, San Jose, presented testimony. All persons desiring to speak having been heard; the public hearing was closed. The Board discussed the issues presented. Supervisor Canciamilla inquired how long it might be before the 'asbestos work got under way. Tim Griffith noted that the best estimate was 30 days. Supervisor Canciamilla then moved to deny the appeal, affirm the determinations of the County Abatement Officer, and suggested that the abatement proceed after a 60 day delay. Supervisor Rogers seconded the motion. The Board then took the following action. Mr. Bachelor: On May 15, 1998, copy enclosed, I sent a letter to the Board of Supervisors in response to the "Order to Abate" . That correspondence is enclosed as well as a communication to Tim Griffith at that point in time. With that, copy enclosed, I mailed a letter to Tom Gonzales of the Contra Costa County Building Inspection Department, pertaining to a problem that happened in January/February, 1998, that I tried to resolve by having the subject properties "boarded up" . Unfortunately, this did not work. This letter is to update you as to what my current actions and plans are: 1. I plan to have the buildings on the property razed and removed. 2 . I obtained an asbestos inspection, dated June 12, 1998, copy enclosed. 3 . I am currently in the process of getting bids for the removal of the asbestos from the subject property. For the building removal, I have attempted and have obtained bids for removal of the subject property. Bids that have been received are from the following entities, copy enclosed, dated June 17. All three of these entities have provided a bid for the demolition of all exiting properties. Plan of Action: 1. Contact Scott Compton to determine who will most likely be the asbestos contractor for removal of that problem. 2 . Have the asbestos contractor remove the problem. 3 . Coordinate with any of the above three contractors, or more, for the demolition and removal of the subject properties. When will all this happen? I intend for this to happen some time in the time frame of June, July, early August . There is no intent here to delay the process, only that it takes time to obtain bids, review bids, and coordinate contractor work schedules . The purpose of this letter is to set forth my intent regarding the subject property. I plan to have the buildings razed and to do so in the near future. Sell the property to Community Resources Associates who want to develop the property for "affordable" housing. They are a non--profit organization. 2 . I want to take care of the nuisance that is at 3827 Camino Andres. 3 . Tim Truesdale, the President of Community Resources Associates, is trying to find a contractor to deal with the problem that the nuisance has created. The owner is not Castlewood Properties but is actually Lincoln Trust Company who administers self-directed IRA. See the enclosed copy of the deed from Castlewood Properties to my IRA. Let me update you on a few things . 1 . I have an option agreement with Community Resources Associates to sell the property to that non-profit organization so they can successfully develop the land for `,low income housing" or „affordable housing" . A copy of the Option Agreement signed by 'Tim Truesdale, President and CEO, is enclosed. I have not signed it because of our recent communication pertaining to the nuisance with the existing buildings on the subject property. As you can see, a copy of this letter is going to Tim Truesdale as well. He is currently trying to get a >contractor to take a look at this issue so we can get these buildings razed. As you can tell from the option Agreement, Tim is under a 150 -day option Agreement. To eliminate the nuisance at 3827 Camino Andres Bay Point, I want to get the buildings razed and he is helping to find a contractor. In addition, we may contact some of the other people on your "demolition" contractor list as well. Mr. Timothy B. Ogden billy Boitano, Sargent & Lawrence 1760 The Alameda, Ste 100 San Jose, CA 95126 June 1 , 1998 RE: ASBESTOg SURVEY #8061: Effective June 10, 1998, FINIA was asked to provide an inspection and reporton present and/or potential asbestos hazards relative to asbestos containing building materials (ACBM) of six (6) buildings located at 3827 Camino Andres, West Pittsburg, California. PROTOCOL: It was reported that the structures have been scheduled for demolition. Therefore, the survey was conducted in conformance with the Say Area Air Quality Management District's Regulation 11, Rule 2, Section 303.8. The survey was conducted by an asbestos consultant who has been certified by the State of California's Division of Occupational Safety and Health, and accredited under the EPA AHERA program for building inspection and management planning for asbestos. PLM laboratory analysis was conducted by an independent NVLAP accredited facility. I_IVSPECT1N and SAMPLES: The property location had been abandoned for some extended time, and occupied by unauthorized tenants. Significant damage had occurred to the properties, and most (if not all) would be deemed unsafe for routine entry. The survey team was accompanied by representatives of the county building department and an armed officer from the Sheriffs department. Persons entering the structures were equipped with disposable coveralls and respiratory protection. Six structures were present on the property and are identified as (1) the main house, located on the northern end of the property nearest Camino Andres, (2) a three car garage/storage building located slightly south and to the west of the main house; (3) a single family residence above a three car garage/storage area located south of the main 01998 HN4A 8061 page 1 1933 Davis Street, Suite 303, San Leandro, California 94577-1259 Office(510)638-48+01 CD(-XDOO Fax(510)538-4803 house, (4) an animal bam located slightly southwest; (5) a single family residence located on the western edge of the property southwest of the barn, and (6) a compartmented storage building on the southwestern comer. Building 1: The main house was a one and a half story structure, wood framed with',stucco exterior and hot tar roof. Sample of the stucco was reported as no asbestos detected. Not tar roofing sample results were 40% chrysotile asbestos. Regulatory restrictions may apply to asbestos roofing removal. Interior ceilings were of the sprayed acoustical type, significantly damaged and collapsed to the floor throughout most of the building. Analysis of samples found 10% chrysotile asbestos. This building should be Immediately placed "off limits" ,and restricted for access. Severe asbestos contamination is present throughout. The asbestos containing ceiling material would be required to lie removed prior to demolition. Interior walls were variously wood lath and plaster or sheetrock with joint compound. Sample analysis indicated no asbestos detected in the plaster, howevera trace (less than 1%) chrysotile asbestos was found in the sheetrock joint compound composite. Note: Only these materials with greater than 1% asbestos content are considered to be asbestos for purposes of EPA and 8AAQMt7 regulations for demolition, renovation and disposal. CAL-OSHA, however, has issued an interpretive letter indicating that they will require those materials with greater than 0.1 f asbestos content to be removed by a Cal- OSHA registered abatement contractor, even though Class I, 11, 1I1 or IV asbestos abatement procedures are not required. The flooring of the approximately 220 square feet of kitchen/dining area was vinyl on the upper layer, and an undetermined number of sub layers. Sample analysis found 70% chrysotile asbestos in the backing of the flooring material. This flooring would be required to be removed prior to demolition. The flooring of the basement room was approximately 250 square feet of gray 9 inch floor tiles, found to contain 3% chrysotile asbestos in the floor tiles and 3% chrysotile asbestos in the mastic. This flooring and mastic would be required to be removed prior to demolition. The perimeter flower beds were lined with corrugated transite which was confirmed to contain 20% chrysotile asbestos. This transite would be required to be removed prior to demolition. Heating system appeared to be localized and had been removed. The hot water heater(s) in the basement were not asbestos insulated, and the flues appeared to be 0 1998 HMA 8061 page 2 sheet metal where observable. Tranite flue segments are possible within walls, however they would not be exposed until time of demolition. No other suspect materials were identifiable. Building 2: The second building was a three car garage/storage area, wood frame construction with stucco exterior and composition panel roof. Samples of the stucco and !roofing found no asbestos in the stucco, however 45% chrysotile asbestos in the interior layers of roofing. Regulatory requirements may apply to asbestos roofing removal. Building 3: The third building was a single family residence built above a triple garage/storage area. Construction was wood frame with transite shingle exterior. Analysis of the exterior shingles confirmed 25% chrysotile asbestos. Gray sheeting beneath the shingles was sampled and laboratory analysis indicated 75% chrysotile asbestos. Both the shingle siding and the underlayment sheeting would be required to be removed>prior to demolition. Plaster (stucco?) was found in the entry portico on the second level. Analysis found no asbestos detected. Interior walls were sheetrock with joint compound which was identified as no asbestos detected. Resilient flooring of the kitchen and bath was the same vinyl, and laboratory analysis found 60% chrysotile asbestos in the backing. This flooring would be rewired to be removed prior to demolition. No other suspect materials were identified Building 4: This structure was a wood animal barn with wood and tin roofing. No suspect materials were identified. Building 5: This structure was a single story, wood frame, single family residence with transite asbestos siding over gray sheeting, with the addition of gray fiber panel siding, and hot tar roof. The transite was confirmed to contain 20% chrysotile asbestos. The gray underlayment was sampled and analysis found 75% chrysotile asbestos. The dray fiber panels on the exterior were found to contain 25% chrysotile asbestos. The hot tar roofing 01998 HMA 8061 page 3 was reported as 40% chrysotile asbestos. These materials would be required to be removed prior to demolition. Regulatory requirements may also apply to the hot tar roofing. Heating system was local, and there was an old abandoned flue on the south exterior wall. Analysis confirmed 20% chrysotile asbestos. This flue would be required to be removed prior to demolition. Interior walls were sheetrock with joint compound. Sample analysis reportedno asbestos detected. Two types of resilient flooring were identified; a brown flooring in the living area and a lighter color vinyl in the kitchen area. Sample analysis indicated no asbestos detected in either flooring. No ether suspect materials were identified. t Building 6: This structure was a compartmentalized storage shed, with recent signs of animal activity. Building components were wood, with the addition of composite panel shingle roofing. Analysis of the roofing found 80% chrysotile asbestos. Regulatory requirements may apply to asbestos roofing removal. No other suspect materials were identified. The ower is not Castlewood Properties but is actually Lincoln Trust Company who administers self-directed IRA. See the enclosed copy of the deed from Castlewood Properties to my SRA. Let me update you on a few things. 1. I have an option agreement with Community Resources Associates to sell, the property to that non-profit organization so they can successfully develop the land for "low income housing„ or "affordable housing" . A copy of the Option Agreement signed by Tim Truesdale, President and CEO, is enclosed. I have not signed it because of our recent communication pertaining to the nuisance with the existing buildings on the subject property. As you can see, a copy of this letter is going to Tim Truesdale as well. He is currently trying to get a contractor to take a look at this issue so we can get these buildings razed. As you can tell from the Option Agreement, Tim is under a 150-day Option Agreement. To eliminate the nuisance at 3827 Camino Andres Bay Point, I want to get the :buildings razed and he is helping to find a contractor.
