SUBJECT: A RESOLUTION OF THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY
AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE BAY AREA AIR
QUALITY MANAGEMENT DISTRICT FOR FUNDS PURSUANT TO HEALTH AND
SAFETY CODE SECTIONS 44225 AND 44241 FOR THE PURPOSE OF CENTER
AVENUE/MARSH DRIVE BIKE LANES, AND BLUM ROAD/IMHOFF DRIVE/ARNOLD
INDUSTRIAL WAY BIKEWAY FACILITIES IMPROVEMENTS; AND AUTHORIZING THE
IMPLEMENTATION OF SAME IF THE APPLICATIONS ARE APPROVED BY THE BAY
AREA AIR QUALITY MANAGEMENT DISTRICT BOARD OF DIRECTORS.
WHEREAS, Contra Costa County is a supporter of clean air and wishes to take action to enhance air
quality within the San Francisco Bay Area; and
WHEREAS, Contra Costa County intends to submit a funding application to the Bay Area Air Quality
Management District for funds pursuant to Health and Safety Code Sections 44225 and 44241 for the
Center Avenue/Marsh Drive bike lanes, and Blum Road/Imhoff Drive/ArnoldIndustrial Way bikeway
facilities improvements.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Public Works Director is authorized to submit such applications for the Board of
Supervisors.
2. That the Public Works Director is authorized to execute a funding agreement with the Bay Area
Air Quality Management District for the purpose of the above mentioned projects if said
applications are approved for funding by the Bay Area Air Quality Management Disrict Board of
Directors.
Adopted by the Board of Supervisors at a regular meeting held on June 23, 1998, by the above listed
vote.

Grading,Inc.,the low bidder,in the amount of$178,157.20 and at the unit prices submitted; and REQUIRE
the contractor to present surety bonds for Payment and Faithful Performance in the amounts of$89,078.60
and$178,1.57.20, respectively.
DIRECT the Public Works Director to prepare the contract for the project.
AUTHORIZE the Public Works Director to sign the contract on behalf of the Board subject to the Director
having reviewed and found sufficient all required documents, including the contract signed by the contractor,
the aforementioned surety bonds, and a certificate of insurance. ,,.

DIRECT that, in accordance with the project specifications and/or upon the execution of the contract by
the Public Works Director, any bid bonds posted by the bidders be exonerated and any checks or cash
submitted for bid security be returned.
Pursuant to Public Contract Code Section 4114, the Board DELEGATESits functions under Public
Contract Code Sections 4107 and 4110 to the Public Works Director or his designee.
Pursuant to Section 6705 of the Labor Code,the Board also DELEGATES to the Public Works Director
or to any registered civil or structural engineer designated by him the authority to accept detailed plans
showing the design of shoring,bracing,sloping or other provisions to be made for worker protection during
trench excavating covered by that section.
DECLARE that, should the award of the contract to be invalidated for any reason, the Board would not
in any event have awarded the contract to the second listed bidder or any other bidder, but instead would
have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from
reawarding the contract to another bidder in cases where the successful'bidder establishes a mistake,refuses
to sign the contract or fails to furnish required bonds or insurance(see Public Contract Code Sections 51.00-
5107).
II. FINANCIAL IMPACT:
The project, including engineering and appropriate overhead charges, is funded by Transportation Fund for
Clean Air(TFCA) (75%)and Navy Mitigation(25%).

The plans and specifications were approved and the project advertised'for bids by the Board of
Supervisors on May 19, 1998. The bids were received and opened at 255 Glacier Drive,
Martinez, California, on Tuesday, June 16, 1998. The construction bids received were as follows:

DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk for filing of the Notice of Exemption.
DIRECT the Clerk of the Board to publish the Notice to Contractors in accordance with Section
20392 of the Public Contract Code, and
ADVERTISE for bids to be received on Tuesday, July 14, 1998, at 2:00 p.m.
II. FINANCIAL. IMPACT:
The estimated contract cost of the project is $286,300 funded by SB-300 funds (11.2%), Town
of Danville (19%), and Measure C funds {69.8010},
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project is needed to improve the roadway surfacing from Cole Court to Green Valley Road.
The project has been determined to be in compliance with the General Plan and is exempt from
CE+QA because the project is a minor alteration of existing facilities.
The Public Works Director has filed with the Board of Supervisors the Plans and Specifications
for the project.
The general prevailing rates of wages,which shall be the minimum rates paid on this project, have
been filed with the Clerk of the Board and copies will be made available to any interested party
upon request.
IV. CQNSEQUENCES OF NEGATIVE ACTION:
If the project is not approved for advertising, it will not be constructed.

The project will not have a significant effect on the environment. The recommendation is based
on the following: The road overlay project consists of a routine maintenance activity-on an existing road
surface and will not result in any expansion of use beyond that previously existing. No right-of-way will
be acquired and no removal of scenic resources will occur as a result of the activity.

GENERAL CONSIDERATIONS:
1. Location: The project is located on Stone Valley Road Between Cole Court and Green Valley
Road in the central county area of Alamo (Figures 1-3).
2. Project Description: The project consists of placing asphalt concrete overlay on the existing road
surface and associated ancillary activities. Road surface treatments maintain the structural
integrity of the roadway and include features such as repairing roadway base failures, sealing
cracks where necessary, installing shoulder backing, and applying an overlay material to the road
surface. The length of the project is approximately 4,200 linear feet and will include pavement
striping. Stone Valley Road is a commuter route so the contractor will be instructed to work only
during non-commute hours so as not to interrupt the flow of traffic, and will phase the work if
necessary to minimize disruption to motorists.

Ill, REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The project is needed to mitigate shoulder erosion along Stone Valley Road.
The Public Works Director has filed with the Board of Supervisors the Plans and Specifications
for the project.
The general prevailing rates of wages, which shall be the minimum rates paid on this project,
have been filed with the Clerk of the Board and copies will be made available to any interested
party upon request.
The Board reviewed and approved the project on May 12, 1998 and determined the project to
be exempt from the California Environmental Quality Act as a Class 1c Categorical Exemption.
A Notice of Exemption was filed with the County Clerk on May 13, 1998.
A Notice of Determination was filed with the County Clerk on May 13, 1998.
IV. CONSEQUENCES OF NEGATIVE ACTION.
If the project is not approved for advertising, it will not be constructed.
